사이버테러에 대한 중국법률의 대응

네트워크 과학기술의 급속한 발전, 나날이 세계가 밀접해지고, 네트워크 기술의 발전은 인류에게 아주 큰 편리를 가져다 줄뿐만 아니라, 동시에 또한 문제도 가져다주었다. 전통적 테러도 인터넷 기술의 발달로 인하여 네트워크 영역까지 확대되었으며, 여기에서 사이버테러가 출현하게 되었다. 미국은 가장 빨리 사이버테러의 개념을 제기하였으며, 이후 학계는 사이버테러에 대한 상당한 연구를 진행하였다. 그러나 지금까지 사이버테러에 대해서 여전히 명확한 정론이 없다. 테러리스트들이 첨단 네트워크 과학기술을 이용하고, 인터넷을 통하여 테러리즘 사상을 전파하며, 테러행위를 계획하고, 테러리스트를 모집하며, 서로 연락하는 것을 사이버테러에서 흔히 볼 수 있는 행위방식이다. 네트워크는 전세계에 존재하며, 사이버테러의 영향도 국가의 범위를 초월하여 나타나며, 국제평화와 안전에 중대한 위해를 미친다. 이에 대해 국제사회도 중요하게 보고 있으며, 국제회의에서 국제입법 등 일련의 수단을 추진하여 사이버테러 확대에 대한 대응을 강구하고 있으며, 유엔안전보장이사회는 전 세계의 테러방지 업무를 중요한 의제로 삼고 있다. 최근 테러 관련 결의에서도 여러 차례 사이버테러를 언급하였다. 유럽연합법 중 사이버테러의 입법에 초점을 맞춘 국제적으로 앞장선 규정이 있다. 중국은 사이버테러공격의 행동과 사이버테러행위에 대한 국제사회와 국제정치에 적극적으로 참여하고 있다. 중국은 지역보안협력을 통하여 유엔안전보장이사회 등을 통하여 자신의 네트워크 안보관을 알리고 사이버테러 방지 협력을 추진하고 있다. 동시에 중국은 끊임없이 시대에 맞는 국내법률을 완비하였으며, 「형법수정안(9)」의 시행으로 일련의 테러와 관련된 죄명을 새로 추가하였다. 이러한 죄명은 행위방식으로 모두 규정하고 있지 않아서 테러리스트들이 네트워크 실행을 이용한 사이버테러행위도 법률적 조정범위 내에 존재하는 것이었다. 신형법수정안은 사이버테러범죄의 위해성과 그에 대한 처벌 정도를 명확하게 하였으며, 사이버테러를 중시하고 있음을 더욱 명확하게 표명하였다. 그 밖에 중국은 사이버테러 공격에 대해 반드시 네트워크 과학기술 수준을 높여야 하고, 외국어, 법률, 외교적 이해에 부합한 인재를 대대적으로 양성하여야 한다. 대외적 교류에 적극적으로 참여하고, 국제입법 촉진을 통하여 국내입법을 단계적으로 완비하고, 국내입법의 완비를 통하여 진일보한 국제입법을 추진하게 되면 법률상으로는 사이버테러 관리에 대한 순조로운 순환이 달성되는 것이다. 더욱이 사이버테러의 발전에 대한 적절한 대응으로 사이버테러의 글로벌 거버넌스와 인류운명공동체 건설을 추진한다. With the rapid develop of network science and technology, the world is getting closer. The development of network technology not only brings great convenience to mankind, but also brings some problems. The traditional terrorism also began to expand the field of cyberspace, there has been cyber-terrorism. The United States is the first to put forward the concept of cyber-terrorism, but so far after many researches, the concept is still not have a clear conclusion. The terrorists use internet to dissemination of terrorist ideas, preparing act and recruiting, communicate with each other. The international community has adopted a series of means, such as international law to deal with cyber-terrorism. The United Nations Security Council has been the world's anti-terrorism as an important issue in the work, on the resolution of the Security Council, cyber-terrorism has been mentioned several times. China participated in it and issued our own voice, promoted the legislation of cyber-terrorism international law. Furthermore, China improved its domestic law to answer the cyber-terrorism. In the number.9 amendments to the Criminal code, added many new charges to copy with the cyber-terrorism. In order to promote global governance of cyber-terrorism and promote the construction of human destiny community.

An Analysis of Multi-form Expression ofFlexible Logo Design in Digital Media EraYang Pian & Jaewuk Chang Abstract: With the development of digital media, promotional methods have diversified through more media, and many brands have tried to build their images with newer designs to attract consumers’ attention. ‘Flexible’ is a popular trend that has led logo design in this era. However, the flexible logo cannot always be a successful case. Therefore, in this study, the characteristics of the flexible logo and the multi-form expression methods of design were analyzed. As a result of the analysis, it was confirmed that the most important characteristic of the flexible logo is unity that can integrate various applied designs into one identity, and sufficient understanding of the multiform brand’s diversified value is essential for effective expression. 中国互联网金融的发展与法律应对思路

Internet technology and internet society promotes the development of internet finance. It is argued that the characteristic of China’s development, market structure and status of the finance industry has facilitated the rapid development of China’s internet finance. However, there are some theoretical and practical disputes exiting between academics, both traditional & internet finance institutions and regulators in terms of the future development of internet finance, its system construction and supervision regulations. It is further stated that there is almost no basic agreement on these aspects. Therefore, after considering the propriety of China’s internet finance, the main forms of China’s internet finance and the trend predictions of China’s internet finance, this study argues that a specially designed system is required to regulate internet finance in China. The regulations can be formed as general rules, or special rules, on internet finance and a regulation system which concerns to a special extent internet finance. This paper will contribute to internet finance supervisions by providing fair standards, regulatory thought which combines proper supervisions and innovative supervisions. The introduction of a new legal treatment to internet finance will also solve the newly appeared issues in the development of internet finance. Finally, after an effective regulation is established, the regulated entity will operate within the allowance of regulations and the whole internet industry will step into a sound development track. 互联网技术与互联网社会正在推动世界互联网金融的发展。中国发展阶段的特殊性、市场结构与金融业现状的特殊性等因素使得中国互联网金融市场较其他国家的互联网金融发展更为迅速。不过,学术界、互联网金融机构、监管部门、传统金融机构等,对于互联网金融的发展定位、制度供给、监管政策等诸多问题在理论上与监管实践中都有不少争议,甚至缺乏一些基本的共识。本文在分析互联网金融的性质、中国互联网金融所涉及到的主要形态以及对中国互联网金融发展趋势初步判断的基础上,提出要针对互联网金融给予专门的制度安排,包括互联网金融适用一般法律规则、互联网金融特殊规则、特殊互联网金融形态针对性规则相结合的互联网金融规范体系。同时,就互联网金融的监管,提出坚持平等规制、适当监管与创新监管相结合的规范思路,着重解决业务创新过程中的新情况、新问题,采取有效手段督促参与主体合规经营,维护互联网金融市场的良性发展。

支遁即色义重探

支遁即色义作为一种对空的理解,本质上是缘起性空的思想,并非如后世所言的显然对空理解有偏差。从内涵上来说,即色义包含两方面:一是“即色本无”,即色义本质上也是一种本无思想,即将空理解为彻底的无。二是“即色游玄”,体现了一种“至人”的逍遥的境界。这两方面在《大小品对比要抄序》中皆有体现。 Theory of Ji-se (thus form) of Zhi-dun as a kind of understanding to emptiness (śūnyatā), is still the theory of dependent origination and the emptiness of nature from Indian Mādhyamika school. This understanding should not be understand as wrong understanding to śūnyatā from of interpreting pattern sinolization of Buddhism. Theory of Ji-se embraces two aspects: one aspect is “form is empty thus it is completely not exist”. That is to say, Theory of Ji-se is a kind of Ben-wu (completely not exist), and it understand emptiness as completely not exist. Another aspect is “thus form to wander in darkness”which implies a kind of spiritual sphere of saint who can wander in absolute freedom as described in the Book of Chuang-tzu. Although this two aspects can’t be specified very detailed, still many contents can be found in Zhi-dun’s extant article named Preface to Extraction from Comparison between two Chinese translation of mahāprajñāparamitā-sūtra (Da-xiao-pin-dui-bi-yao-chao-xu).

Carry forward the Excellent Traditional Culture and Create A Strong Sense of Community for the Chinese Nation

The Chinese excellent traditional culture is the cultural symbol of the Chinese nation and the common spiritual home of all nations in China. This paper explains the essence and characteristics of the content of Chinese excellent traditional culture from the perspective of strengthening the consciousness of the Chinese nation community, and strives to reveal the relationship between the consciousness of community for the Chinese Nation and Chinese excellent traditional culture.

特色小镇的非遗活化共生系统构建研究 ——以东阳木雕技艺为例

The natural ecosystem provides a sufficient theoretical and practical basis for the study of the intangible cultural heritage symbiotic system in Dongyang Woodcarving Town. From the perspective of ecology, this paper first uses the STEEP analysis method to analyze the symbiotic environment in which the system operates. Secondly, the operation of the symbiotic system also involves the cooperation of many stakeholders. At present, Dongyang woodcarving intangible cultural heritage skills have formed a relatively mature woodcarving industry in Dongyang, so the woodcarving industry has become the core group in the symbiotic system. On this basis, on the one hand, it analyzes the interaction process between the basic units of the wood carving population, that is, the symbiotic units; It also discusses the system benefits of the intangible cultural heritage symbiosis system in Dongyang Woodcarving Town. Finally, combined with the current national rural revitalization strategy, the future development and research direction of the evolution of the intangible cultural heritage activated symbiotic system in woodcarving towns are prospected.

Research on The Enlightenment of High-Level Sports Teams to Grassroots Youth Training——Based on the Successful Experience of Chinese Track and Field Team in Recent Years

近年来中国田径在世界大赛中的成绩突飞猛进。剖析近年来中国田径成绩飞速增长的主要原因,整理并研究其训练方法和训练理念,对服务青少年运动日常训练,助推基层青少年田径训练的新路径意义重大。本文通过查阅文献资料逻辑分析等方法,对中国田径取得成绩进行了经验总结,以求为青少年训练获得启示。研究表明:国家队运动员训练目的很明确,注重技术训练、节奏训练;准备活动在训练中占比很大,跟基层训练有着较大的差距,注重训练的细节化;有先进的训练理念,并且不断尝试创新训练。 In recent years, China s track and field achievements in the world championships have made rapid progress. It is of great significance to analyze the main reasons for the rapid growth of China s track and field achievements in recent years, and to sort out and study the training methods and training ideas, so as to serve the daily training of youth sports and boost the new path of track and field training of grassroots youth. This paper summarizes the experience of China s track and field achievements through logical analysis of literature, in order to get enlightenment for youth training. The research shows that: the national team athletes have a very clear training purpose, pay attention to technical training, rhythm training; Preparation activities in the training accounted for a large proportion, with the grassroots training has a large gap, pay attention to the training of the details; Have advanced training concept, and constantly try innovative training.
