이 연구의 목적은 교육법학의 핵심적 주제, 성격, 기본원리 및 연구대상을 고찰하고 한국의 교육법학의 과제를 제시하는 데에 있다. 연구내용을 정리하면 다음과 같다. 첫째, 교육법학의 핵심주제는 공교육체제에서 교육당사자간의 권리-의무관계라고 할 수 있다. 따라서 교육법학은 교육현상에서 제기되는 법률관계 즉 교육법현상을 교육학과 법학의 연구성과를 토대로 독자적 이론을 정립하면서 교육관계당사자의 법익을 조화롭게 규명하기 위한 학문 영역이라고 정의할 수 있다.둘째, 교육법학의 성격은 통합적, 독자적, 사회법적 성격을 지닌다고 할 수 있다. 셋째, 교육법학의 대상은 교육법의 이념과 기본원리 및 교육철학, 헌법을 포함한 교육관련 법령과 교육기관과 교육당사자의 교육활동 등이다. 교육법학의 목적은 국민의 교육을 받을 권리의 실현과 보장을 위한 이론을 구성하여, 교육당사자 상호간의 교육권의 충돌을 조정하며 교육입법과 교육재판에서 교육이론 및 공교육법리의 적용을 통하여 교육에서의 정의를 구현하기 위한것이다. 넷째, 교육법학의 과제는 교육관련 법령의 헌법 적합성을 제고하고, 교육당사자의 교육권 개념의 정립과 조화로운 보장, 교육입법 및 교육재판 과정에서의 교육의 특수성 반영, 교육학과 교육법학의 학제적 연구의 활성화, 교원과 국민의 교육법의식의 향상 그리고 한국 교육법학의 독립성 확립 등이라고 할 수 있다. The main purpose of this research is to identify the research areas of Educational Law and important issues for futher study. First, the main subject of the educational law is the right-duty relationship among the interested parties in the public education system. Educational law is to investigate the important legal issues which can be raised in the actual educational activity. Therefore, educational law is a science of originally theorizing about the various legal issues of the educational law based on the research products of both the education and the law, eventually pursuing to harmonize the legal rights of those who are engaged in the education activity. Second, the main characteristics of the educational law are its synthesis, originality and relationship with social law. Third, educational law has important purposes; to establish the theory regarding the realization and security of the right to education for all, to resolute the conflict among various interest groups over the educational rights, to realize the educational just through the application of the educational theory and public educational law theory. Fourth, the research areas of educational law are the fundamental and basic principle of educational law and educational activities and raws related educational administration and policy. Lastly, the important issues for futher study are to improve its consistency with the constitution, to establish and secure the right to education of all concerned parties, to examine its distinctiveness of legislation and legal judgement process, to increase the interdisciplinary research between education and education law, to raise the educational law-conscious of all, and to establish the independence of Korean educational law as a science.

서울특별시교육청의 학부모교육 정책과 학부모와 교사의 인식 연구

본 연구는 2019년 서울특별시교육청 학부모교육 현황을 파악하고, 현행 정책에 대한 서울특별시교육청 소속 초·중·고 학부모와 교사의 인식을 체계적으로 조사하여 학부모교육 내실화를 위한 시사점을 제공하고자 하였다. 모집단의 실제를 추정해 볼 수 있는 무선표집방식으로 실시한 설문조사를 통하여 양적·질적자료를 수집하였으며 질적자료의 경우, 의미 있는 자유응답 내용들의 범주별 퍼센트를 산출하였다. 양적자료의 경우, 기술통계량 산출 외에도 Kruskal-Wallis 검정법에 의한 통계적 유의도 검정을 실시하였고 비모수 검정법에 적합한 효과크기인 에타자승을 산출하였다. 또한, 정책의 우선순위를 파악하고자 보정된 보리치 지표를 산출하였다. 현황조사의 결과, 정책 추진 기관들 간 역할과 업무 분장 그리고 컨트롤타워를 중심으로 한 효율적인 협업체계로의 운영시스템 개선이 필요했다. 설문조사의 결과, 현행 정책의 필요성에 대하여, 3차원(학교·가정·사회)에서 학부모 역량 강화를 위하여 제안된 교육 내용들에 대하여, 제안된 학부모교육 발전 방안들에 대하여 학부모의 지지는 높은 편이었다. 현행 정책 중 [전환기 교육]과 [온라인 교육]에 대한 요구도가 최상위였다. This study examines the Seoul Metropolitan Office of Education s parent education policies in 2019 and investigated the perceptions of parents and teachers from primary and secondary schools regarding the current policies. A random sampling survey design was used. The qualitative data was categorized into themes and frequencies were obtained. For the quantitative data, Kruscal-Wallis tests were conducted for statistical significance and nonparametric effect-size eta-squares were obtained. An adjusted Borich index was computed to prioritize current policies. The study suggests that the operation system be transformed into a more coherently collaborative one with a control tower centered on and having a clear division of roles and duties among the policy enforcement agencies. Parents support was relatively high for the necessity of the current policies, for the educational contents proposed to enhance parents’ competency in the three dimensions (school, home, society), and for the proposed ideas to improve the city’s parent education. Among the current policies, the demand for [Transition education] and [Online education] programs were the highest.

The internal and external effect of strategic subcoalition : research joint venture vs. R&D cartel

This paper examines the effect of subcoalition in R&D on R&D investment, consumer surplus and producer surplus compared to the industry-wide coalition. The main result of this paper is as follows. First, when spillover rate is in a medium range, the R&D cartel lowers social welfare relative to R&D competition, while welfare rises by R&D cartel when spillover rate is high or low enough. Second, for the subcoalition case, the producer surplus under RJV competition can be higher than that under RJV cartel for low spillover rate contrary to the case of industry-wide coalition. third, for the subcoalition case, an RJV competition can be better than R&D cartel in terms of consumer welfare for low spillover rate, which never happens for the industry-wide coalition case. Fourth, for the subcoalition case, consumer surplus under an RJV competition can be greater than that under R&D competition case for low spillover rate contrary to the industry-wide coalition.
