Upon reading and watching news on the rampant killing spree of the IS, a perennial question surfaces once again: “Does the Qurʾān teach Muslims to kill non-Muslims, considering them as unbelievers (kuffār), apostates (murtaddūn), and polytheists (mushrikūn), as the IS militants have done so?” In delineating the meaning and usage of the terms unbelief, apostasy, and polytheism, this paper attempts to examine against the Qurʾān the killing of unbelievers the IS militants commit in the name of God for the purpose of forging a “pure Islam.”

대화와 소통의 관점에서 본 이슬람교-전통 샤리아의 소통구조-

서방과 무슬림 세계의 정치, 경제, 문화적 갈등이 지속됨에 따라 충돌을 방지하고 공존을 모색하기 위한 이슬람과 비이슬람 전통 간 대화의 중요성이 날로 강조되고 있다. 그러나 이슬람 고유의 소통구조, 즉 자신의 전통을 이해하고 타인을 바라보는 틀을 고려하지 않고 시도하는 대화에서 진지한 결과를 기대하기는 어렵다. 필자는 그러한 틀을 주류 종파인 순니(Sunnī) 전통의 샤리아(Sharī⊂ah 이슬람법)로 본다. 그리하여 본문에서 하나님과 예언자 무함마드의 소통의 장(場)인 꾸란(Qur⊃ān), 예언자 무함마드와 무슬림 공동체의 대면(對面)의 장인 하디스(Ḥadīth), 이 두 텍스트를 근간으로 무슬림 공동체가 하나님의 법을 탐색하는 데 중요한 장치로 작동한 이즈마(Ijmā⊂, 합의 合意)와 끼야스(Qiyās, 유추 類推) 등 전통 샤리아의 제1법원(法源)이 지닌 구조와 원리를 일별하며 무슬림이 세상과 대화하고 소통하는 틀을 설명한다. 이를 통해 비무슬림의 이슬람 이해를 도와 종교간 대화에 일조하고, 무슬림에게는 다원화된 현대 사회에서 이슬람 전통이 외부세계와 의미 있게 소통하려면 샤리아가 제공하는 틀에서 소통, 공존, 대화에 대한 하나님의 보편적인 가르침을 재해석할 것과 아울러 현대적 독법(讀法)을 위한 여러 개념적 장치들을 발굴하여 가르치는 종교교육의 필요성을 제안한다.

Purpose The purpose of this study is to identify problems and suggest solutions by investigating the work process at the crime scene at the Metropolitan and Provincial Police Agency. Methods We investigated the distribution of staff and the type of work of dead body investigators in each of the four Metropolitan and Provincial Police Agencies, and compared the differences between the areas where the dead body examiners appeared at the scene and the areas where they did not. In addition, the problem was found by examining the process of handling the legal affairs of the detective in charge of the dead body investigation on behalf of the prosecutor. Result Compared to the police, it was difficult to see that the staffing of dead body investigators working at Metropolitan and Provincial Police Agency was rationally assigned. This irrationality of personnel allocation is thought to be the cause of increased fatigue of dead body investigators and lowering of work efficiency. In areas where an optometrist comes to the scene and fills out an autopsy report, it helps the detective in charge of his/her work, but for dead body investigators who perform overlapping tasks, it was found that the meaning of performing the task was lower than in areas where the dead body examiner did not appear at the scene. And if the guidelines are changed so that, in the case of a death due to an obvious disease, the police are closed without the direction of the prosecutor, the work of the detective in charge will be reduced and the bereaved family will be able to proceed with the funeral more quickly. Conclusion In order to proceed more rationally with the work process at the site than the current one, it is necessary to change the number of staff or work patterns of the dead body investigator, and since a corpse autopsy is required, it is necessary to find a way to work with the optometrist smoothly. It is necessary to provide convenience for funerals to the bereaved family while reducing the work of the detective. 연구목적 시·도 경찰청에서 이루어지고 있는 변사현장의 업무처리에 대해 조사하여 문제점을 파악하고 해결방안을 제시하는데 그 목적이 있다. 연구방법 시·도 경찰청 각 4곳의 변사업무처리를 하는 검시조사관의 인원배분과 근무형태를 조사하였고 검안의사가 현장에 나오는 지역과 나오지 않는 지역의 차이를 비교하였다. 또한 검사를 대신하여 검시를 진행하는 담당형사의 변사업무처리과정을 조사하여 문제점을 찾아보았다. 결과 시·도 경찰청에서 근무하는 검시조사관의 인원배치가 경찰과 비교해보았을 때 합리적으로 배치되었다고 보기 어려웠으며 이런 인원배치의 불합리는 검시조사관의 피로도 증가와 업무의 효율성을 떨어뜨리는 원인이 될 것으로 생각된다. 검안의사가 현장에 나와 시체검안서를 작성해 주는 지역에서는 담당형사의 업무처리에 도움을 주지만 중복되는 업무를 진행하는 검시조사관에게는 업무를 수행하는 의미가 검안의사가 현장에 나오지 않는 지역보다 낮은 것으로 나타났다. 그리고 분명한 질환으로 인해 사망한 경우, 검사의 지휘를 받지 않고 경찰 내부에서 종결하도록 지침을 변경한다면 담당형사의 업무는 감소하고 유가족은 보다 빠르게 장례를 진행할 수 있다. 결론 변사현장의 업무처리를 현재보다 합리적으로 진행하기 위해서는 검시조사관의 근무인원이나 근무형태에 변화가 필요하며 시체검안서가 필요하기 때문에 검안의사와의 업무를 원활히 할 수 있는 방안을 모색할 필요가 있으며 담당형사의 업무를 줄이면서 유가족에게는 장례를 위한 편리를 제공할 필요가 있다.
