Characteristics of Localized Surface Plasmon Resonance of Nanostructured Au Patterns for Biosensing

<P>Periodic arrays of pseudotetrahedal-shaped gold nanoparticles were fabricated using nanosphere lithography (NSL) and examined for localized surface plasmon resonance (LSPR). The dependence of the LSPR on particle size of the periodic gold nanostructures was explored for potential application as a new biosensor. With increasing size and height of the Au nanoparticles, the absorption peak of the LSPR shifts to the longer wavelength and becomes relatively sharper. With thinner metal deposition or finer Au nanostructure, the absorption signal varies more sensitively for the changes in the Au particle size. The binding affinity study for biotin-streptavidine system on the Au nanopatterns resulted in blue-shifted absorption signal, opening up the possibility of the nanostructured Au pattern as a new LSPR biosensor.</P>

Gelatin from yellowfin tuna (Thunnus albacares) dorsal skin was optimized for adhesive strength to plywood using surface response methodology of a central composite design with a dependent variable of adhesive strength (Y, kgf/cm2) and two independent variables of gelatin concentration (X1, %) and hardening time (X2, hrs). From the above design, a maximum adhesive strength of 49.84 kgf/cm2 was obtained under the optimal treatment condition of 15.85% gelatin concentration and 25.68 hr hardening time. The adhesive strength under optimum conditions was 50.93 kgf/cm2. The adhesive strength of the tuna gelatin was shown to be superior to that of bovine and porcine gelatins which had adhesive strengths of 34.75 and 34.9 kgf/cm2, respectively

역사적으로 볼 때 동물에 대한 사회적 인식이 법에 반영되었다. 따라서 고대로부터 서구사회를 지배하고 있던 인간중심적인 계층적 우주관의 영향으로 영국의 코먼로(common law)는 동물을 단순한 물건으로 취급하였으며, 영국의 코먼로를 계승한 미국의 코먼로 역시 동물의 재산적 지위에 바탕을 두고 있다. 1970년대 이후 동물복지와 권리에 관한 논의는 주로 윤리적 또는 철학적 관점에서 이루어졌으나, 1990년대 이후부터는 법적인 관점에서도 동물의 복지와 권리에 관한 논의가 본격적으로 이루어지기 시작했다. 본 논문은 현재 논의 되고 있는 이슈들 중에서 동물에게 법으로 권리의 주체가 될 수 있는 지위인 권리능력, 즉 법인격을 부여할지 여부에 관한 찬반논쟁을 주요 인물들과 그들이 주장하는 논거를 중심으로 살펴본다. 동물에게 법인격을 부여하는 문제에 적극적으로 찬성하는 측의 주요논거로는 우선 먼저, 지능이 매우 높은 일부 동물에게 기본적 존엄권을 인정해야 하며 둘째로, 법인격개념의 유연한 해석을 통해 법인격을 동물에게 까지 확장해야 하며 셋째로, 지능, 지각력, 이성에 바탕 둔 법인격의 확대를 주장하고 있다. 반면에 동물에게 법인격을 부여하는 것에 반대하는 측의 주요 논거로는 먼저, 동물에게 법인격과 권리를 부여하는 것은 사회 계약원리에 위배되며 둘째로, 동물을 인간인 영유아, 정신지체 성인과 비교하는 것 그자체가 부당하고 셋째로, 만일 이를 인정하게 되면 과학적 연구퇴보 등 막대한 사회적 비용이 초래될 것이라고 주장하고 있다. 법은 인간사회의 필요에 의해 흑인노예, 태아는 물론 회사와 같은 비생명체에게 까지도 법인격을 부여해 왔다. 따라서 동물에게도 동물의 이익을 보호해줄 사회적 필요가 있으면 일정한 조건하에, 예컨대 인간처럼 매우 높은 지능과 속성을 지닌 대형 유인원 및 돌고래 등 에게 제한적인 법인격을 부여한다는 법률규정을 두는 것은 가능하고 또한 바람직하다고 본다. 이 경우에 인정되는 권리는 인간과 동일한 권리가 아닌 해당동물의 기본적인 이익을 위해 반드시 필요한 기본적인 권리에 국한시킬 수 있다. We deny the personhood of animals because we claim that animals have certain defects, such as the inability to use language or a supposedly inferior intelligence. However, such defects have been possessed by some group of human beings, such as infants, mentally incapable adults. Nevertheless, law assigns rights only to human beings, not to animals. Logically, something must be wrong. The first part of this article briefly examines backgrounds to discuss the legal status of animals and legal personality for animals. Part II of this article discusses the legal status of animal from historical perspectives and introduces the new concept of property, so called “living property”. The last part of the paper introduces the prominent figures and their arguments for/against assigning rights to animals. Animal rights advocates emphasize that rights are assigned even to artificial entities, such as corporations and ships, in arguing by analogy that highly intelligent animals should have rights. They focus on arguments for extending some basic level of liberty and equality rights to highly intelligent animals, such as great apes, dolphin. The concept of legal personality is a construct of the law. Therefore it can be extended to animals, particularly to highly intelligent animals if the law so chooses. Ultimately, the issue depends on whether human beings are prepared to acknowledge that animals deserve legal protection for their rights and interests.
