Copyright has traditionally been regarded as a distinct rights system in each country, operating under the territoriality principle of intellectual property rights. However, the issue of international jurisdiction over copyright infringement remains a contentious subject. Beyond its non-formality, the proliferation of cross-border, ubiquitous infringement cases driven by the advancement of the internet and digital technology has resulted in an increased significance of international jurisdiction. In the context of international jurisdiction law, the concept of the place of infringement assumes particular significance in copyright infringement cases. If this concept is not established with precision amidst theoretical conflicts, the predictability and stability of international jurisdiction may be undermined. In light of this, the 2022 amendment to South Korea's Private International Law introduced a specific jurisdiction provision for cases pertaining to the infringement of intellectual property rights.
This study establishes the legal foundation for the concept of the place of infringement in international copyright infringement cases, based on the traditional understanding of the place of the tort. The subsequent examination investigates methodologies for constraining the concept of the place of infringement within the framework of the general theory of international private law concerning torts and copyright infringement acts. To achieve this objective, it is first necessary to examine the conflicting academic theories regarding the concept of the place of infringement, while considering the characteristics of territoriality in copyright infringement and the non-formality of copyright. In the following step, the study examines international trends based on international norms, including the ALI Principles, the CLIP Principles, the Joint Korean-Japanese Proposal, the ILA Guidelines, in addition to discussions during the drafting process of the 2019 Hague Judgments Convention. Furthermore, the study considers the influence that these discussions have had on South Korea's private international law provisions. In accordance with the preceding comparative legal analysis, this study investigates the specific jurisdictional criteria under international private law that are pertinent to copyright infringement cases. This will enable effective responses to copyright violations in the digital age within the framework of international normative harmonization. Finally, the conclusions of the aforementioned inquiry are examined within the interpretive limitations of Article 39 of the South Korea’s Private International Law. In addition, legislative issues and supplementary measures that have been identified are presented.
