공공정보화사업에서의 중소 소프트웨어사업자의 사업 참여 지원에 대한 법제도적 고찰 -대기업 참여 제한- = Legal and institutional considerations on support for business participation of SME in public informatization projects

다국어 초록 (Multilingual Abstract)

The software industry is obviously considered a new engine of growth that creates values and economy in so far as it consists of innovative technologies related to platform, big data etc. However, the government in 2003 adopted a measure to limit entry into the market for procurement software project towards large enterprises to protect and develop small and medium enterprises and establish good market order on the matter. The measure in question involves mainly the exclusion of large companies in the software market, the amount of the contract of which is below a certain level and the competence to determine the amount of criteria in the form of go-si. In spite of this, the practice of major domination by large enterprises in this area is not improved. So was passed in May 2012 the law that contains a new sanction that companies which are subject to mutual investment prohibition under Article 14 of the anti-trust law are excluded in all markets. But the objects in public procurement market are often the elements that belong to public service which are sometimes sovereign services whose operation is vital for the achievement of the general interest as well as defense or police service.
Thereby in the Act for the promotion of industry SW, while the principle of exclusion in the market against large enterprises remains an exception is admitted in favor of large companies on projects for national security which includes defense, diplomacy, the police and electricity. Finally, the questin of exclusion criterion relates to the optimum and harmonization between the protection of small and medium enterprises and the achievement of the general interest. So determining the correct standard will decide the success of the system. In this context, this paper is devoted to analyze the current state of the system of exclusion of large enterprises in the public market of software in order to make a few considerations to take into account for the determination of sovereign services. In addition, are developed problems and solutions in the practice of implementation of the Council was adopted as a major instrument for the system.
