지방의회 기능과 지방의원의 역할 강화방안에 관한 연구 : 서울특별시 성동구의회를 중심으로 = A study on strengthening the function of local council and councilmen: focused on Seongdong-Gu council, Seoul

국문 초록 (Abstract)

1948년 7월 17일 제헌헌법에서 도입된 우리나라의 지방자치제도는 1949년 7월 지방자치법이 제정 ․ 공포를 통하여 1952년부터 1961년까지 9년 동안 도․읍․ 면의회를 구성하여 운영하였으나, 1961년 5월 16일 군사정변으로 인하여 지방의회가 해산되었다. 1980년 헌법개정 시 지방자치제의 순차적 실시원칙을 규정하였고 1988년 3월 28일 지방자치 법안이 국회를 통과하여 같은 해 4월 6일 지방자치법 개정에 따른 법률공포를 거쳐 5월 1일부터 지방자치법이 시행되었다. 1990년 12월 31일 지방자치법 중 개정법률 및 지방자치단체장 선거법이 공포됨으로서 지방자치제의 전국 실시를 맞이하게 되었다. 1991년 3월 26일 실시된 지방의회 구의원 선거결과 성동구는 4월 15일 개원식을 갖고 제1대 성동구의회출범 이래 성동구ㆍ광진구 분구를 거쳐 2018년 7월 9일 제8대 성동구의회 시대를 맞이하고 있다.
그러나 당초 풀뿌리민주주의의 기대를 한 몸에 안고 출발한 지방자치는 정치권과 지방의회 구성원인 의원들의 일탈된 행동으로 국민의 기대를 저버리는 결과를 초래함으로써 심각한 위기의 상황에 봉착해 있다. 각종 사건사고 유형을 살펴보면 뇌물수수, 폭행, 음주운전, 성추행, 관광성 외유, 제 식구 감싸기 등으로 정치권과 지방의회 의원들의 부끄러운 민낯을 드러내고 있어 지방의회 존폐 논란이 거론되는 지경에 이르고 있다. 경북 예천군의회 의원들의 해외연수과정에서 발생한 가이드 폭행사건을 계기로 불신의 골은 더욱 깊어졌으나 오히려 이 사건을 지방의회가 새롭게 거듭 태어날 수 있는 기회로 삼아 전화위복의 계기로 삼아야 할 것이다.
지방의회 기능과 지방의원의 역할 강화방안에 대하여 성동구의회 의정활동을 중심으로 자료를 수집하고 비교분석을 통하여 지방의회의 발전 방안을 살펴보고자 한다. 이론적 논의로는 지방의회 의정활동과 관련하여 참고 의존도가 높은 지방자치 및 지방의회 운영 관련 유명 저서들의 본문내용을 상당 부분 발췌ㆍ인용하였으며 지방자치법과 동법시행령, 서울특별시 성동구의회 관계 법규집 등에서 이론과 연관되는 관련법 규정에 대한 근거를 찾아 기술하였다.
지방의원의 역할강화 필요성을 분석하기 위해 성동구의회 의원들의 실질적 의정활동 자료를「성동구의회 의정백서」을 통해 수집하였으며, 지방의회 존치 필요성에 대하여는 20대에서 60대에 이르기까지의 다양한 연령층을 무작위로 선정하여 설문조사를 실시하고 그 결과를 토대로 분석하였다. 지방의회에 대한 주민평가와 의정활동은 성동구의회와 인근 구의회 의정활동 내용을 자료를 통하여 비교 분석해 보았다. 마지막으로 지방의회의 기능과 지방의원의 역할강화 방안은 1) 조례제정 및 행정감시 실효성 강화 2) 예산편성 전문성 강화 3) 의회 전문위원 기능 강화 4) 의회 사무조직 독립성 추진 5) 의정활동 전문성 강화 6) 지방의원의 공인의식 개선으로 요약하였다. 지방의회의 기능과 지방의원의 역할 강화방안에 관하여는 각종 연구자료 및 논문 등을 통해 확인해 볼 수 있었다. 각종 자료를 토대로 논문 작성 결과를 도출해 보면 지방의회 기능강화를 위한 제도적 정비와 구성원인 지방의원의 전문성 및 공인의식 개선이 중요하다는 결론에 이르게 되었다.
무엇보다 중요한 것은 지방의회의원들의 공인의식 함양이라 할 것이다. 지방의회 의원들의 각종 일탈 사례가 보도를 통해 알려지고 국민들의 불편한 감정과 시선을 알지 못할리 없건만 끊임없이 반복되고 있다는 것은 변명의 여지가 없는 지방의원으로서의 자질이 부족함에 있는 것이다. 지방의원에 대한 정당공천제가 현행 제도임을 감안한다면 지방의원 공천 시 엄격한 검증과 확고한 공천기준이 마련되어야 할 것이며 의원 스스로 각고의 반성과 노력이 요구된다 할 것이다.

다국어 초록 (Multilingual Abstract)

Introduced by the Constitution on July 17, 1948, the local autonomy system was implemented and promulgated under the Local Autonomy Act with local councils operating in Provinces, Eups and Myeons for nine years from 1952 to 1961. However, those local councils were dissolved as a military coup broke out on May 16, 1961. When the Constitution was amended in 1980, the local Autonomy system was set to be re-implemented in due order. And on March 28, 1988, the Local Autonomy Act passed the National Assembly, promulgated on April 6 of the same year and was enacted on May 1. On December 31, 1990, the revision version of the Local Autonomy Act and the Local Government Chief Election Act were promulgated, which resulted in a nationwide implementation of the local autonomy system. Day July 9, 2018 marks the era of the 8th Sungdong-gu District Council after a division of election district in the local council election held on March 26, 1991.
However, local autonomy, which originally started off with the expectation of realizing grassroots democracy, is currently facing a serious crisis as it failed short of the public expectation with deviant actions of lawmakers who are members of political circles and local councils. Types of issues that the political circle and local council members have been showing include bribery, assault, drunk driving, sexual harassment, overseas travel under the name of government affairs, and the protection of inner circle members, which even lead to the heated debate over the abolition of local councils. Although distrust deepened due to the incident of the use of violence on a guide by members of the Yechon-gun County Council in Gyeongsangbuk-do Province, it should be used as an opportunity for local councils to be newly reborn.
To set the plan to strengthen the function of local councils and the role of local council members, we intend to collect data focusing on the activities of the Seongdong-gu district council and examine the development plans of local councils through comparative analysis. For theoretical discussions, we include excerpts from the text of well-known books on local government and local council operations, which are highly regarded as a reference for local council activities, and found and described the basis from the relevant laws related to the theory, such as the Local Autonomy Act, the Enforcement Decree of the same Act, and other collections of laws related to Seongdong-gu Councils.

In order to analyze the need to strengthen the role of local council members, data on the actual legislative activities of Seongdong-gu council members were collected through the “Seongdong-gu District Council’s White Paper” and the survey was conducted randomly amongst people of various ages, ranging from 20s to 60s, and the analysis was made based on the results of their answers. The residents' assessment and parliamentary activities of local councils were done by comparing the data of the neighboring local councils' activities. Finally, the measures to enhance the function of local councils and the role of localcouncilors were summarized as follows: (1) Strengthen the effectiveness of ordinances and administrative monitoring; (2) Strengthen the specialty in budgeting; (3) Strengthen the function of Expert Committeeman; (4) Promote independence of council office organizations; (5) Strengthen the specialty in legislative activity. (6) Enhance the sense of councilmembers as a public figure.
The functions of local councils and measures to strengthen the role of local councilors were checked through various research materials and papers. Drawing up the results of the thesis based on various datail led to the conclusion that institutional arrangements and the improvement of professionalism and awareness of local council members as a public figure were important to strengthen the function of local councils.
Most important of all, fostering a sense of awareness for local councilors as a public figure would be the number one priority. The fact that various aberrations of local council members have been made public through media and it is hard for them to be unaware of the publics’ uncomfortable feelings. However, never-ending issues showcase their inexcusable lack of qualifications as local lawmakers. Considering that the party nomination system for local councilors is the current system, strict verification and solid nomination standards will have to be prepared when selecting local councilors, and the lawmakers themselves will need to reflect on themselves and make every effort to break the current situation.
