지적불부합지정리를 위한 법률의 제정에 관한 연구 = A Study on the Enactment of the Legislation for Cadastral Non-corresponding Parcels Arrangement

This study aimed at the preparation of the system of the legislation and the general direction for the solution of cadastral non-corresponding parcels in Korea through the reflection of the changed external environment and the solution of fundamental cadastral problems. In order to achieve the research objective, the preceding researches of the relevant laws, that is, cadastral resurvey project bill(1996), special cadastral resurvey project bill(2005) and the special land survey bill(2006) were investigated and for the contents which is necessary to build up the bill, foreign relevant laws of cadastral resurvey project from Japan, Taiwan, France and Germany were investigated. The research method reflected the reports which were related to cadastral resurvey project or cadastral non-corresponding parcels, the literature investigation of casebook and data from a public hearing. Lastly field trip and opinion listening from Digital cadastre establishment example areas and consultation of experts were collected. The general direction of legislation set as the establishment of legal basis of cadastral non corresponding parcels arrangement simultaneously, the preparation of the conversion into the future cadastral system and legal rationalization of cadastral system on a large scale. In order to propel the cadastral non-correspondence arrangement project efficiently Ministry of Land, Transport and Maritime Affairs and municipalities establish a commission and the plan regarding the propulsion
of this project was established through the discussion. When cadastral authorities designated an project district the executive plan should be established. Commission guides the boundary and liquidation of property.
The boundary of cadastral non-correspondence parcels should be determined by application or its force of cadastral authority. On the basis of the cadastral books the change of the boundary or the increase of the area would be minimized. In this case the national funds would be used for it. Cadastral survey would be performed by World geodetic system for cadastral non-correspondence parcels and after this project the existed cadastral books would be closed. When new cadastral book would be written out, the location of the building would be marked in cadastral book.
And matters about drawing up & management of cadastral book regulated in current ‘Law on the Geodetic, and the hydrographical survey & cadastre’ would be coordinated. Finally the law on the cadastral system would be unified.

국문 초록 (Abstract)

본 연구는 지적의 근본 문제 해결과 변화된 외부환경의 반영을 통하여 지적불부합지 해소를 위한 입법의 기본방향과 법안의 체계를 마련하는 것을 목적으로 하였다. 이러한 연구목적을 달성하기 위하여 지적재조사법안(1996), 지적재조사특별법안(2005), 토지조사특별법안(2006) 등 선행연구 결과를 검토하고, 일본/대만/프랑스/독일 등 외국의 지적재조사 관련법을 조사하고, 지적재조사 및 지적불부합지와 관련한 연구보고서/사례집/공청회 자료 등의 문헌을 조사하고, 디지털지적구축 시범사업의 현장을 답사하고, 그 밖에 전문가들의 자문을 받았다.
입법의 기본방향은 크게 지적불부합지 일제정리의 법적 근거 마련, 미래지적제도의 전환에 대비한 지적제도의 법체계 합리화로 설정하였다. 지적불부합지 정리사업을 효율적으로 추진하기 위하여 국토해양부, 시/도와 시/군/구에 위원회를 설치하고, 이들 위원회의 심의를 거쳐 사업의 추진에 관한 계획을 수립하도록 하였다.
지적소관청이 사업지구를 지정할 때에는 그 사업지구에 관한 실시계획을 수립하도록 하고, 각 사업지구마다 위원회를 설치하여 경계설정과 청산금산정에 관한 사항을 관장하게 하였다. 지적불부합지의 경계는 지적소관청이 직권 또는 신청에 의하여 결정하되, 기존 지적공부의 내용을 기반으로 경계의 변경이나 면적의 증감을 최소화하도록 하였다. 면적의 증감이 발생한 경우에는 국가가 설치한 기금으로 청산하도록 하였다. 지적불부합지 정리를 위한 지적측량은 세계측지계에 의하도록 하고, 사업완료 후 기존의 지적공부를 폐쇄하고 새로운 지적공부를 작성할 때에는 건축물의 위치도 지적공부에 기재하도록 하였다. 그리고 현재 「측량/수로조사 및 지적에 관한 법률」에 규정되어 있는 지적공부의 작성 및 관리에 관한 사항을 이 법률에 통합하여 지적제도에 관한 법률을 일원화하였다.
