그간 근로시간 유연화에 대한 다양한 논의에도 불구하고 시대적 변화에 따른 다양한 개선과제를 안고 있는 것이다.
본 고에서는 우선 이와 같은 인식을 바탕으로 현행 근로시간 개념과 판단기준 및 현행법 상 근로시간 유연화 제도를 살펴본 후, 노동환경 변화에 맞는 근로시간 법 제도의 개선방안을 검토하고자 하였다.
특히 최근 발생한 코로나19 사태와 관련하여 특정 업종의 일시적인 업무량 증가, 급격한 경기침체로 인한 실업 사태, 개학연기 등으로 자녀 돌봄에 어려움을 겪는 근로자와 같이 특수한 상황에 적용 가능한 현행 근로시간 법 제도 및 개선방안을 함께 검토하였다.
비단 코로나19 사태뿐만이 아니라 급변하는 시대적 변화에 대응하기 위해서는 임금 계산의 기초이자 근로자 보호의 목적을 둔 근로시간제도 본질을 훼손하지 않는 범위내에서 엄격하면서도 유연한 방식으로 근로시간 법 제도의 개선이 요구된다.

Article 50 (Work Hours) Paragraphs 1 and 2 of the Labor Standards Act stipulate that work hours shall not exceed 40 hours a week and eight hours a day, excluding hours of recess.
And Paragraphs 3 stipulates that upon calculating the work hours, any waiting time, etc. spent by employees under the direction and supervision of their employers that is necessary for the relevant work shall be deemed work hours.
In other words, the Labor Standards Act states that the range of work hours includes waiting time, and that the concept of work hours and hours of recess are distinct, but it does not specifically specify the concept of work hours and waiting time.
As such, the concept of work hours is a dichotomous judgment structure divided into working hours or hours of recess, but it is not easy to uniformly distinguish them in complex and diverse labor relations.
Under the current Labor Standards Act, the concept of work hours does not function properly because it is a tool for calculating wages and a standard for guaranteeing workers' right to health, and although it should be set in detail and in advance, there are still unclear areas.
Not only that, but the concept of overly rigid work hours is also pointed out as a reason for not functioning properly.
In other words, the concept of work hours does not keep up with the rapid changes in the industrial environment, called the Fourth Industrial Revolution, resulting in changes in the working environment, and still uses the early industrial revolution large factory system as a model.
Despite various discussions on flexible working hours, there are various improvement tasks according to the changing times.
Based on this perception, this paper first looked at the concept of work hours and judgment criteria and the flexible working hours system under the current law, and then tried to review the improvement plan of the working hours legal system in line with the changes in the working environment.
Especially in connection with the recent COVID-19 pandemic, this paper reviewed the current legal system of work hours and its improvement plan that can be applied to special situations such as workers who have difficulty taking care of children during the school lockdown or are suffering from temporary increase in workload in certain industries, unemployment caused by a sharp economic recession.
In order to cope with the rapidly changing times as well as the COVID-19 pandemic, the improvement of the working hours law system is required in a strict yet flexible way within the scope of not undermining the nature of the working hours system, which is the basis for calculating wages and the purpose of protecting workers.
