Vol.5 No.2

Internet Webcasting is now growing as a new media which can replace TV. In Korea, leading Internet Webcasting service IS AfreecaTV, and a majority of channels in AfreecaTV is Game Webcasting. However, the Copyright Law of Korea doesn``t regulate clearly about Internet Webcasting, and it``s difficult to legally define the parties involved in this service. Furthermore, a problem of copyright possession and infringement is happening. First, copyright of game is admitted by precedents. Game is a combined work of image, music, program, material, and etc. Also, it is cooperated work by producer, designer, programmer, and etc. A gamer or commentator should be recognized as a performer in Game Broadcasting. Secondly, Internet Webcasting is divided into a Streaming type and a Demanding type. The streaming type we should focus on has both simultaneity-which IS a feature of ``broadcasting``- and interactivity-which is a feature of ``transmission``. The current Copyright Law of Korea doesn``t have suitable definition and regulation for Internet Webcasting. Thirdly, based on the current Copyright Law of Korea, a BJ-Broadcasting Jacky- of Internet Webcasting IS an owner of copyright basically, but BJ is also a performer and broadcasting station, A platform like AfreecaTV is sharing some role of broadcasting station with BJ, and a viewer can also be performer or an owner of copyright. It means that a legal position of the parties involved in this service is difficult to define by the current Copyright Law of Korea. Fourthly, Internet Game Web casting is usually provided in two formats, namely, the format of webcasting the others`` competition and the format of webcasting the game play of BJ himself. In Korea, some famous BJs are earning more than 100 million won a year. In United States of America, Twitch TV-a game only Internet Web casting service IS becoming huge enough to surpass a traditional TV cable channel. Fifthly, the use of game in Internet Game Webcasting is mostly unauthorized use. This means that BJ is infringing a copyright of the game company. A platform like AfreecaTV is also violating Copyright Law of Korea by ignoring the copyright infringement. The platforms must deal with this problem at the front line, and all the other parties such as BJ, association of e-sports, game companies, and etc. should also try hard to solve the problem. As a conclusion, Copyright Law of Korea must be amended to settle the unstable legal character of Internet Web casting and the parties involved. Also, the copyright infringement should be dealt by the parties involved while not neglecting an effort for industrial advance at the same time.

Review and Proposal Regarding Tattooing Procedures

        Sanghyuk Moon,Sungwoo Sim J-INSTITUTE 2023 Regulations Vol.8 No.-

Purpose: The societal perception of tattoos has evolved, and tattooing procedures have become more prevalent. However, tattooing constitutes a medical procedure involving invasive actions on the skin, thereby falling within the scope of medical practices. Unless performed by qualified medical professionals possessing medical expertise, there is a constant risk of jeopardizing the life, physical well-being, or public health of tattoo recipients. Consequently, this paper seeks to investigate the current state of tattooing practices in South Korea, examining the legal issues at hand, and proposing measures to mitigate potential harm to consumers. Method: Through a comprehensive review of prior research and analysis of relevant literature, including an examination of judicial precedents, this study aims to examine the stance of the Constitutional Court and the Supreme Court regarding tattooing. Additionally, it seeks to review the legislative systems pertaining to tattooing in foreign countries such as the United States and Japan in order to propose improvements to the current tattooing system and suggest measures for consumer protection. Results: Through a review of legal precedents in our country, we have identified the evolving perception regarding the practice of tattooing. Additionally, by conducting research on foreign laws and systems, we have gained new insights into the legalization of tattooing and the considerations for potential solutions. By engaging in comprehensive discussions encompassing the protection of citizens' right to life and health, public health concerns, as well as the artistic nature, freedom of expression, and freedom of occupational choice associated with tattoos, we have sought to explore measures for improvement in the field of tattooing. Conclusion: Through this study, it was possible to ascertain the changing public perception of tattooing. Additionally, by conducting an analysis of foreign legal systems that reflect the evolving perception of tattoos, avenues for the legalization of tattooing could be explored. Protecting the right to life and promoting health, which are the objectives of medical law, naturally entail reserving medical procedures for qualified healthcare professionals. However, given the difficulty of reversing the widespread acceptance of tattooing brought about by societal changes, it is now necessary to consider the legalization of tattooing through legal and regulatory frameworks. This should be accompanied by consistent governmental oversight and supervision by the Ministry of Health and Welfare to safeguard the health rights of the population.
