동물권의 관점에서 살펴본 동물의 법적 지위 및 동물보호법의 개선점 ― “동물복지론”과 “동물권리론”을 중심으로 ―

현대사회에는 반려인구의 증가에 따라 더 이상 동물을 이용의 대상이 아닌 보호의 대상으로 보는 인식이 점차 확대되었다. 이러한 인식의 변화에 따라 실질적으로 동물보호 및 동물복지를 도모할 수 있는 법적인 수단의 입법을 요구하는 여론이 형성되었고, 1991년에는 동물보호를 목적으로 하는 법률인 동물보호법이 제정되었다. 초기 동물보호법은 선언적이고 추상적인 규정에 불과했으나, 점차 개정을 거쳐 구체적이고 실효성 있는 규정으로 발전하였다. 하지만 아직 동물보호법은 개선의 여지가 적지 않다. 따라서 본 논문에서는 먼저 동물복지론과 동물보호론으로 대표되는 동물권 이론을 소개하고, 보호되어야 하는 동물의 범위 및 현행법상 동물의 법적 지위에 대하여 논의하였다. 그리고 앞선 논의를 중심으로 2022. 4. 26 전면개정안을 포함한 동물보호법의 개선점을 검토하였다. 본 논문에서 지적한 동물보호법의 문제점으로는 보호대상에서 식용 어류를 배제하고 있다는 점, 동물학대규정이 세밀하지 못한 점, 반려동물의 보호에만 치중한 나머지 실험동물, 농장동물의 보호에는 소홀한 점 그리고 앞선 문제점들로 인해 동물보호를 위한 기본법의 역할을 기대하기 어렵다는 점 등을 들 수 있다. 이러한 문제점은 동물을 인간의 필요에 따라 분류하여 차별하는 태도나 동물을 물건으로 보는 시각이 동물보호법에 반영된 결과로 보인다. 따라서 동물보호법이 진정한 동물보호 및 동물복지를 실현할 수 있으려면, 모든 동물을 동등하게 하나의 생명체로 바라보는 태도가 전제되어야 할 것이다. In modern society, with the increase in the number of the “pet-raising populations”, the perception that admit animals as ‘objects of protection’ - not as objects of use - has gradually expanded. With this change in perception, public opinion demanding proper legislation which can actually promote animal protection and animal welfare has been formed. Also, the Animal Protection Act, a law aimed at animal protection, was enacted in 1991. Although the Animal Protection Act was only a declarative and abstract regulation in early days, it gradually developed into a specific and effective regulation through revision. However, there is still a lot of room for improvement in the Animal Protection Act. Therefore, in this paper, the theory of animal rights represented by animal welfare theory and animal protection theory was introduced first. Secondly, the scope of animals to be protected and the legal status of animals under the current law were discussed. Furthemore, focusing on the previous discussions, the improvements in the Animal Protection Act, including the full amendment on April 26, 2022, were reviewed. This paper deals with 4 big problems of the Animal Protection Act - the exclusion of edible fish from the protection list, the lack of detailed animal abuse regulations, negligence in protecting laboratory animals and farm animals, and previous problems. These 4 problems seems to be the result of reflecting the attitude of ‘classifying animals according to human needs’ and ‘seeing animals as objects’. Therefore, in order for the Animal Protection Act to be able to actualize true animal protection and animal welfare, an attitude of viewing all animals equally as one living thing must be premised.
