최근 폰트 저작권들이 웹이나 오프라인에서 무단으로 이용되는 폰트를 문제 삼아 형사합의금이나 고가의 패키지를 구매할 것을 요구하는 일이 증가하고 있다. 폰트가 `프로그램`으로서 저작권을 보호받는다는 것이 한국의 판례이자 국제적인 추세이지만, 폰트가 예술적인 특성보다는 실용적이고 기능적인 특성을 가진 저작물임을 고려할 때 저작권자의 권리가 남용되어서는 안 될 것이다. 그럼에도 불구하고 약관에 명확하게 나와 있지 않은 폰트의 사용범위를 문제 삼아 형사합의금을 요구한다거나, 하나의 낱개 폰트의 저작권을 침해하였을 뿐인 이용자에게 고가의 폰트 패키지 구매를 강요하는 등의 일이 계속하여 발생하고 있다. 심지어는 저작권을 침해한 사례가 아닌 경우에까지도 고소 할 것임을 언명하여 합의금을 요구하는 사례 또한 발생하고 있다. 본고에서는 이와 같은 폰트 저작권자의 대응방식을 분석해보고 그에 따른 법적 문제점을 고찰해보고자 하였다. 특히 약관에 해당하는 저작권 사용계약서에 대한 명시·설명의무가 제대로 이행되지 않았으면 저작권자는 해당 내용을 약관의 내용으로 주장하지 못한다. 또한 약관이 유효하게 체결되었다고 하더라도 저작권의 `본래적 이용`에 해당하지 않는 경우는 단순한 계약위반에 불과하며 저작권법으로 의율되지는 않을 것이다. 합의를 종용하는 과정에서는 공정거래법상 불공정거래행위의 한 유형인 거래강제 중 끼워팔기에 해당한다고 볼 여지가 있으며, 형사적으로 공갈죄 및 사기죄에 해당될 수 있다. 만약 폰트이용자가 저작권을 침해하지 않았음에도 불구하고 이에 대하여 저작권 침해를 주장하여 합의금을 수령한 경우 폰트 저작권자에게 부당이득 반환의 의무가 인정될 것이다. 폰트를 제작하는 데에는 많은 노력이 필요하며 이러한 노력을 저작권법상으로 보호하는 것은 당연하다. 그러나 저작권법은 저작권자의 권리를 보호하고자 하는 것만은 아니고 저작물의 공정한 이용을 도모함으로써 문화산업을 발전시키는 것에도 그 목적이 있다. 또한 폰트저작권이 실용적이고 기능적인 특성을 강하게 가진 저작물임을 고려 할 때 현재와 같은 폰트 저작권자의 권리 남용은 지양되어야 할 것이다. Recently, It has been increased that the owner of the font copyrights require the assumed-pirate pay criminal settlement and purchase a expensive total font package. Although It has been generally accepted that the font program could be protected under the copyright law, the misuse of copyrights` rights should not be permitted when considering the features of the font which consists of pragmatic and functional features rather than artistic features. Regardless of these characteristics, more and more owner of the copyrights demand the assumed-pirate pay criminal settlements and purchase total expensive font package based on vague terms. Even more, the owners sometimes threatening to sue the assumed-pirate even when assumed-pirate did not infringe the copyright. In this themes, we tried to analyze the ways of reaction by the owner of the font copyrights and consider the legal issues regarding this phenomenon. Especially, when the crucial elements of the copyright contracts (which is `terms`) were not clearly stated and explained, the owner of the copyrights could not argue these parts as the contents of the contracts (that means that parts of the terms will be considered invalid). In addition, even the terms were valid, when the assumed-infringement is not related with the `fundamental usage of the copyrights`, the copyrights act could not be applied in that case. During the process of reaching the compromise, the acts of the copyrights and agent law-firms who requires the assumed-pirate purchase total package might also be considered unfair-trade (specifically, tying) according to the fair-trade act. In the criminal law system, this could be considered blackmail, and fraud. If the assumed-pirate had not violated the copyright and the owner of the copyright received the criminal settlements by threatening to sue him/her, the criminal settlements should be returned because it is a unjust enrichment. It is without doubt that creating the font takes lots of time and energy, and this effort should be protected under the copyright law. However, the copyrights acts not only aims to protect the owner of the copyrights` rights but also to ensure the fair-usage of the copyright works, all of which ultimately aims to develop the cultural industries. Not only that, when considering the font copyright has pragmatic and functional features, the font copyrights` misuse of their rights should be restricted.
