공동주택 하자기획 소송에 대한 건설사 사전예방 모델 개발 연구

도시인구의 급격한 증가와 경제 성장으로 주택보급 문제를 원활히 해결하기 위한 정부의 주택보급정책으로 공동주택의 비중이 지속적으로 증가하였다. 이러한 보급률 제고와 함께 공동주택의 품질에 대한 관심이 높아짐에 따라 건설업체들은 소비자의 삶의 질 향상이나 타 업체의 치열한 경쟁에 맞추어 소비자의 만족도를 향상시키기 위한 노력을 지속적으로 수행하였다. 그러나 이러한 노력에도 불구하고 수요자의 기대수준과 공급된 공동주택의 품질의 차이로 인한 갈등이 심화되고 있으며 건설사들의 하자에 대한 소극적인 대처와 사전대응 전략의 미흡으로 하자관련 분쟁과 소송이 증가하고 있다. 이러한 건설사의 고객만족 팀과 법무팀의 사후 대처적, 소극적 대응은 이러한 건설관련 소송의 증가를 부추기고 있다. 따라서 본 연구에서는 실제 하자소송 판례를 중심으로 하자목록의 유형분석과 금액분석을 통하여 관리 우선순위를 도출하여 하자발생 이전에 대응 전략 수립이 가능한 하자기획소송 사전 대응모델을 개발하였다. 본 연구에서 개발된 대응 모델은 하자소송이 발생 한 이후의 대응이 아닌 프로젝트 초기단계부터의 대응 모델로서 하자소송의 위험성을 사전에 인지하고 이에 대한 관리전략의 수립에 기여할 것으로 기대된다. The proportion of apartment housing has been increased to solve the housing problems resulted from rapid growth in urban population and urban economy. With the increase in apartment’s proportions and the concern about quality of housing, the contractors have made efforts to satisfy the customers in improving the quality of housing. Despite these efforts, the conflicts between the contractor and the customers are getting serious. Also the disputes and the litigation of defect are increasing because of the contractor’s negative treatment and inadequate countermeasure. In this study the defect lawsuits which bring actions against the contractors are collected and analyzed. And then the strategic countermeasures are proposed according to the classifying the type of defect and size. The suggested countermeasure model before the defects are resulted is expected to contribute in developing the contractors strategies to reduce the conflicts against customers.
