특허 침해소송은 다른 소송들과는 다르게 그 특허기술의 실체파악 없이는 사안의 파악이 매우 힘든 소송이다. 변리사법은 제8조에서 변리사의 특허침해소송에 대한 소송대리권을 인정하고 있는 듯 보이지만 전통적으로 헌법재판소와 법원은 특허 등 침해소송에 대하여 변리사의 소송대리권을 인정하지 않는 입장이다. 이에 대해서 변리사와 변호사간에 끊임없는 논쟁이 이루어지고 있다. 본 연구에서는 특허침해소송에서 소송대리의 효율성 및 전문성을 높이는 방안을 탐색한다. 이를 위해 주요국의 특허침해소송에서 변리사의 역할을 분석하여 합리적 대안을 도출한다. 그 결과 변호사의 변리사 자격자동취득을 제한하거나 변리사의 소송대리권과 관련하여 변리사법을 개정하는 방안은 적절하지 못한 것으로 나타났다. 소송당사자의 입장에서 근본적인 문제 해결을 위해 수정된 특허전문변호사 제도를 도입하고 소송당사자들이 합리적으로 소송대리인을 선택하게 하는 것이 바람직한 대안인 것으로 분석되었다. Unlike other lawsuits, patent infringement litigation is a very difficult case to grasp without expert knowledge of the patented technology. The Patent Agent Act seems to recognize the legal representation of patent agent in Article 8, but the Constitutional Court and the Court have refused to recognize patent agent s legal representation right in the patent infringement suit. In this regard, constant controversy is taking place among patent agents and lawyers. This study examines the measures to enhance the effectiveness and professionalism of patent litigation in patent infringement litigation. This study analyzes the role of patent attorneys in patent infringement lawsuits in major countries and derive rational alternatives. As a result, it is inappropriate to restrict the attorneys automatic acquisition of patent attorneys qualifications or revise the patent attorneys law in relation to the patent attorney s right of proxy. In the case of litigation parties, it is a desirable alternative to introduce a revised patent attorney system for the fundamental problem solving and to allow the litigants to reasonably choose the litigation agent.

중소기업의 기술 보호 방안 연구 : 기술유출 사례 분석을 중심으로

나날이 증대되어 가는 산업기술의 중요성과 가치에 비해 중소기업의 기술보호 수준은 기술탈취의 위협으로부터 보호하기에 역부족이다. 중소기업의 기술보호를 위하여 「중소기업기술 보호 지원에 관한 법률」, 「산업기술의 유출 방지 및 보호에 관한 법률」, 기술보호 통합 상담·신고센터, 기술자료 임치제도 등의 법·제도가 마련되어 있으나 원활히 활용되고 있지는 못한 상황이다. 이에 본 논문에서는 중소기업의 기술 보호를 위한 제도의 활성화 방안에 대해 논의한다. 중소기업의 기술유출 실제 사례들을 유형별로 분석한 뒤 중소기업 기술보호를 위한 제도의 적용가능성을 검토하였다. 분석 결과에 따르면 중소기업의 기술보호를 위한 다양한 제도의 적용을 통하여 기술 보호가 가능함을 확인하였다. 그러나 제도에 대한 인식, 중소기업의 열악한 재정 문제, 정부의 인력 부족 등의 문제점들에 대한 개선이 필요하였다. 본 연구는 중소기업의 기술보호 제도의 실질적인 적용 가능성을 파악하고 문제점을 제시함으로써 향후 실효성 있는 중소기업 기술보호 제도를 제시하는 데에 기여할 것이다. Compared to the increasing importance and value of industrial technology, the level of technology protection of SMEs is not enough against the threat of technology deception. To protect the technology of SMEs, there are various laws and polices such as 「Act On Support For Protection Of Technologies Of Small And Medium Enterprises」, 「Act On Prevention Of Divulgence And Protection Of Industrial Technology」, Center for Technical protection integrated consultation, Technical Documents Escrow, but they are not well utilized. In this study, we discuss how to activate the regulations for technology protection of SMEs. This study analyzes the actual cases of technology leakage of SMEs by type, and examined the possibility of applying the regulations for the protection of SMEs technology. According to the analysis results, it is confirmed possibility by applying existing regulations for technology protection of SMEs. However, it was necessary to improve the awareness of the regulations, the financial problems of SMEs, and the Lack of government manpower. This study will contribute to the proposal of effective technical protection regulations for SMEs by identifying the practical applicability of technical protection system of SMEs and presenting problems.
