세월호 사건의 재난관리 분석: Petak과 Rosenbloom의 개념틀을 중심으로

본 연구는 세월호 사건의 재난관리 실패사례를 분석하였다. 구체적으로, 세월호 사건을 Petak의 재난관리 4단계에 입각하여 실패 사례를 선정하고 Rosenbloom의 행정의 세 가지 관점에서 분석하였다. 첫째, 예방단계는 해상·업무활동의 법적근거가 존재하나, 관리적 차원의 관리·감독이 부재했다. 기저에는 이해집단간 이해관계를 기반으로 하는 유착관계가 영향을 미쳤음을 시사한다. 둘째, 대비단계는 해상사고에 대비한 교육·훈련의 법적 근거가 존재하나, 역시 관리적 차원의 관리·감독이 부실했다. 셋째, 대응단계는 해상사고 신고와 중앙재난안전대책본부 설치 근거가 존재하나, 관리적 차원에서 조직간 의사소통의 혼선과 구조활동간 조정이 미흡하였다. 기저에는 해양경찰과 특정 구조업체간 관계가 효과적 대응 활동에 한계로 작용하였다. 넷째, 복구단계는 법적 차원에서 해양관련법률이 개정되었고, 관리적 차원의 조직개편이 단행되었다. 그러나 퇴직관료들의 전관예우와 이를 기반으로 해양업계의 관계망이 구조적 제약으로 남아있다. 이를 바탕으로 세월호 사건의 법적·관리적·정치적 관점에서 재난관리체계의 문제점을 도출하고 정책적 시사점을 고찰한다. This study aims to analyze disaster management of Sewolho from Rosenbloom’s perspectives of management, politics, and law in mitigation, preparedness, response, and recovery stages of Petak. Nine critical events which seems to contribute the event of Sewolho disaster are derived from the report of the Board of Audit and Inspection of Korea. First, in the stage of mitigation, there were relevant law and regulation, but they were not implemented appropriately that imply for the stakeholder interests. Second, in the preparedness stage, there exist training and legal guidelines, which also were not effectively administered. The network analysis shows cozy and close relationship among stakeholders in the public, private, and non-profit organizations in the ecosystem. Third, in the response state, there were critical mistakes to delay the rescue of students in the Sewolho from the communication error among risk management government agencies, close relationship between main ministry and rescues firm at the critical moments. Fourth, in the recovery state, even though formal and legal amendments were done to respond the disaster, actual implementation has been sabotaged from the interest power structure of the ecosystem of shipping industry in Korea.
