산업재해보상보험법은 산업재해 발생에 따른 산재근로자의 소득상실보전과 적정한 요양·재활서비스를 제공함으로써 산재근로자의 건강, 직업 및 사회복귀 활동을 촉진하려는 사회안전망 체계의 특성이 내재되어 있다. 즉 산업재해보상보험법의 근본적인 취지는 산재관련 보상과 관련한 사업자의 경제적 부담을 경감하는 것과 함께 근로자의 보호에 있다. 따라서 근로자를 둔 사용자는 이러한 위험으로부터 근로자를 보호해야 하며, 나아가 이러한 위험이 발현되지 않도록 산업재해의 예방에 만전을 기해야 할 것이다. 그러나 사용자로서는 이를 방지하는데 한계가 있고 사업장에는 항시 산업재해의 위험이 도사리고 있으므로 산업재해 발생 후의 구제조치로서 근로자에 대한 적절한 보상이 필요하게 된다. 또한, 헌법재판소 결정들에서 논의되는 기본권은 ‘사회보험수급권’인 바 이 기본권의 본질이 무엇인지에서부터 여러 가지 논의가 있다. 사회적 기본권으로 보면서도 재산권적 성격을 겸한다고 보는 헌법재판소의 결정과 관련하여 기본권의 성질상 재산권의 위헌심사기준을 따를 것인지의 문제, 사회적 기본권으로서 위헌심사를 한다면 어떠한 심사기준을 적용할 것인지의 문제, 사회적 기본권의 위헌심사 대신 평등원칙 위반 심사로 우회적으로 하는 것이 타당한지의 문제, 평등원칙 위반 심사를 하는 경우에도 사회보험수급권의 성격이 비추어 어떤 심사기준을 적용할 것인지의 문제 등이 제기된다. 따라서 본 논문은 산업재해보상법의 제도를 개괄적으로 먼저 살펴보고, 위에 언급한 판례들을 비교적으로 분석한 다음, 관련 판례의 법리 중에서 논리상 어떤 문제점이 있는지를 논하였다. Industrial Accident Compensation Insurance Act inheres the social safety net system characteristics, which facilitate injured workers" health, jobs, and their rehabilitation to the society by providing preservation on losing income and proper convalescence· rehabilitation service for workers injured by industrial accidents. In other words, fundamental purpose of Industrial Accident Compensation Insurance Act is relieving the financial burdens for business owners on the industrial accident compensation and protecting workers. Thus, employers who have employees should protect their workers from these dangers and pay full attention to prevent industrial accidents from the risks. However, there are limitations for the users to prevent this and dangers of industrial accidents are always lurking in the workplace. Therefore, a proper compensation for workers as a remedial measure after the occurrence of industrial accidents is necessary. In addition, as Basic Right discussed at the Constitutional Court decisions are ‘Social Insurance Entitlement,’ there have been several discussions about the essence of Basic Right. Relating to Constitutional Court"s decision which regards it as Social Right and having the nature of property rights, following problems arose: whether they will follow the Scrutiny Standards in Property Right due the nature of Basic Right; which examination criteria should be applied if they do the constitutional review as Social Right; whether it is appropriate to detour to the review of violation on equality principle from the constitutional review of Social Right; and which examination criteria should be applied for the review of violation on equality principle due to the characteristics of Social Insurance Entitlement. For these reasons, from the following, we will check Industrial Accident Compensation Act generally first, and analysis the precedents mentioned above comparatively. Lastly, finds out if there is any logical problems on legal principles among precedents.

Degree of gelatinization during cooking of Akibare(Janponica) and Milyang 23 (Indica) rice was determined by X-ray diffractometry using a buit-in internal standard approach. The method had a total coefficient of variation of 99.9%. Milyang 23 showed slightly higher degree of gelatinization than Akibare during cooking at 100℃. Both rice was completely gelatinized after 20 minute cooking.
