저작권법 영문번역의 개선을 위한 몇 가지 제안 : 번역문에 사용되는 법개념을 중심으로

우리 지식재산권법제에 대한 전 세계의 관심은 날로 높아지고 있다. 그 결과 지식재산권 관련 법률을 알고자 하는 수요 역시 커졌는데, 우리말을 이해하지 못하는 외국의 학자와 실무자에게 번역된 법률은 곧 연구의 전제가 된다. 우리 저작권법은 한국법제연구원 산하의 법령번역센터에 의해 영어로 번역되어 제공되고 있고, 저작권법 시행령까지도 번역･제공된다. 저작권법이 상당히 방대하고 전문화되어 있음에도 불구하고, 저작권법 번역의 질은 상당히 높다. 그러나 번역에는 여러 가지 측면에서 개선되어야 할 부분들도 발견된다. 이 논문에서는 현재 제공되는 저작권법 영문 번역본에서 발견되는 여러 문제를 짚어보고, 이들을 어떻게 개선할 것인지에 대해 몇 가지를 제안하고자 한다. 무엇보다 번역문에서 사용되는 법개념이 국제적으로 통용되는 저작권 용어와 일치하지 않는 문제를 지적하고, 이를 수정･보완하는 방안을 제시해 보고자 한다. 그 외에도 번역이 완전하지 못하거나, 저작권법 내에서 또는 법률 상호 간 다른 개념과 표현을 사용하여 혼란을 야기하는 경우 등을 지적해 본다. 좋은 법률번역을 위해서는, 번역이란 전문 번역가에 맡겨 납품받는 것이라는 생각에서 벗어나야 한다. 때때로 저작권법상 특정 법개념을 외국어로 옮기는 것은 연구와 토론의 대상이 될 수 있고, 또 되어야 한다. 무엇보다 저작권법의 바람직한 번역에 대한 관심과 노력이 필요하다. Korean IP law has been globalized in the sense that scholars and practitioners worldwide are considering the relevant legislations more important and tracing the development of this area of law. As a consequence, the demand to learn and research Korean IP-related laws has also increased, and many part of the legislations have been translated into foreign languages. It is indispensable for international scholars and non-Korean-speaking practitioners to access text through translation, and the text in English, a quasi-global language, is the basis for the further study undertaken by international lawyers. The translated version of the Korean Copyright Act is provided in English by the Korea Law Translation Center under the Korea Legislation Research Institute. The translation covers the main revisions to the Copyright Act, even their Enforcement Decrees. As for the rendering of Copyright Act, its quality is quite high despite long, complicated and highly specialized texts. However, there also exist some points that need to be improved to better suit for the global standard. This paper aims to examine the various issues which can be found in the English translation of the Korean Copyright Act made currently available, and to suggest several points concerning ways to improve them. Above all, it will point out the issue that the legal concepts defined and used in the translation are hard to understand on the grounds that they are unfamiliar to foreign scholars/practitioners. Thus, it is necessary to use internationally and widely used terms, which should be carefully chosen and evaluated. In the paper, it is also pointed out a series of errors: some parts of the English rendering are missing, or different terms and expressions are used for the same legal terms within the Copyright Act as well as between Copyright Act and other Acts, which causes inevitable confusion. For good legal translation, the translation should not be treated as a s ervice p rovided by a p rofessional translator. In m any occasions, translating specialized legal concepts to foreign languages can be the subject of research and discussion among scholars/practitioners in the field. Further attention and efforts are required to make a better understandable translation of the Korean Copyright Act.

Machine translation powered by artificial intelligence is now being widely used for such areas as legal translation, which require high-level professional knowledge and skills and thus were used to be considered exclusively for human translators. The Korea Legislation Research Institute, which has translated the statutes of the Republic of Korea for 30 years, has begun to use machine translation. Yet there are issues to be addressed, including legal problems associated with using machine translation. If we could come up with a proper solution to these issues based on in-depth research, machine translation would better assist human translators. (Korea Legislation Research Institute, Korea)

Starting from the differences between general translation and statutory translation, this paper examines the factors that must be considered in order to change the paradigm of statutory translation and the translation approaches based on such factors, and explores several cases that were actually reviewed in the statutory translation process. The field of statutory translation must identify a translation method that aptly highlights these differences in consideration of the legal system and the legal hierarchy. In addition, it is also necessary to actively consider whether the translator and the translated text carry legal effect and the authority to provide authoritative interpretations. The modification and application of the basic principles applied to general statutory translation and review of domestic and foreign legislative enactment guidelines will allow for a more objective and accurate translation.
