        近十年來台灣民事程序法之新開展 -以證據法為中心

        For over a decade of years, the most significant issues regarding the Code of Civil Procedure in Taiwan , no matter legislatively, theoretically or practically, include: legal theory debates on burden of proof, the integrated legislation of procedure law for family cases, the new formulation of revocation action by a third party, the protection of right to hearing, the emphasis on litigation efficiency as well as one-offs dispute resolution, the enhancement of the concentrated trial system and the revolutions towards both second instance and third instance, etc. There is also material controversy between such mentioned revolutions and the general principles of the Code of Civil Procedure, especially in terms of adversarial principle and doctrine of disposition, when applying different system arrangements to various types of case. Besides, the Family Matters Law of R.O.C, released on January 11, 2012, has already been enforced on June 1of the same year. It combines contentious cases and non-contentious cases into one single law, which were previously regulated in the Code of Civil Procedure and the Non-litigious Matters Law. In the academic community, there are still some arguments remained highly divergent, among others, as to the segment of case types, the combination of procedures and the procedural switch mechanism. Due to limitations on space, this article is started with Taiwan's recent developments in evidence law and aimed to briefly introduce important topics for reference, which have drawn attention most recently from Taiwan academic community in the Code of Civil Procedure. For example, fishing expedition, the obligation of truth and completeness, etc. 近十餘年來,台灣民事程序法在立法及學說、實務上的重大議題包括:舉證責任法理爭議、家事事件程序的獨立立法、第三人撤銷之訴的增訂、合法聽審權的保障、訴訟經濟及紛爭解決一次性的強調、集中審理制度的強化及第二審與第三審的制度變革等。而此等變革與民事訴訟法的基本審理原則,尤其係處分權主義與辯論主義,究竟在不同事件類型應有如何不同制度之設計,在學理上存在重大爭議。 另台灣於2012年1月11日公布家事事件法,於同年6月1日施行。此部法律係將原規定在民事訴訟法中人事編之人事訴訟規定及非訟事件法中家事非訟事件加以整併,而成獨立之法。其中,關於事件類型區分、合併程序及程序換軌機制等,在學界有重大爭議。 基於篇幅有限,本文擬自證據法在台灣的新近發展出發,約略說明台灣民事程序法學界的最近關心的重點所在,例如具體化義務、摸索證明、真實義務及完全義務、事案解明義務、證據契約等問題,用供參考。

        Allogeneic Serum Eye Drops for the Treatment of Severe Dry Eye in Patients With Chronic Graft-Versus-Host Disease

        PURPOSE:: To describe the use of allogeneic serum eye drops to treat 2 patients with chronic graft-versus-host disease (GVHD)-induced severe ocular surface disease. METHODS:: Small case series. RESULTS:: Conventional therapy failed to control the ocular symptoms of 2 patients with GVHD who presented with severe dry eye syndrome. Because autologous serum was unavailable in these cases, we used allogeneic serum eye drops as an alternate option for treating their ocular surface disease. Both donors had serologic tests performed before donation. Use of the allogeneic serum eye drops had a beneficial clinical effect, with marked attenuation of the patients’ symptoms. This therapy proved to be safe during 10 months of treatment. CONCLUSIONS:: Allogeneic serum eye drops may be a good alternative treatment for patients with severe dry eyes caused by GVHD.

      • The Ca <sub>V</sub> 3.2 T-Type Ca <sup>2+</sup> Channel Is Required for Pressure Overload-Induced Cardiac Hypertrophy in Mice

        <P>Voltage-gated T-type Ca(2+) channels (T-channels) are normally expressed during embryonic development in ventricular myocytes but are undetectable in adult ventricular myocytes. Interestingly, T-channels are reexpressed in hypertrophied or failing hearts. It is unclear whether T-channels play a role in the pathogenesis of cardiomyopathy and what the mechanism might be. Here we show that the alpha(1H) voltage-gated T-type Ca(2+) channel (Ca(v)3.2) is involved in the pathogenesis of cardiac hypertrophy via the activation of calcineurin/nuclear factor of activated T cells (NFAT) pathway. Specifically, pressure overload-induced hypertrophy was severely suppressed in mice deficient for Ca(v)3.2 (Ca(v)3.2(-/-)) but not in mice deficient for Ca(v)3.1 (Ca(v)3.1(-/-)). Angiotensin II-induced cardiac hypertrophy was also suppressed in Ca(v)3.2(-/-) mice. Consistent with these findings, cultured neonatal myocytes isolated from Ca(v)3.2(-/-) mice fail to respond hypertrophic stimulation by treatment with angiotensin II. Together, these results demonstrate the importance of Ca(v)3.2 in the development of cardiac hypertrophy both in vitro and in vivo. To test whether Ca(v)3.2 mediates the hypertrophic response through the calcineurin/NFAT pathway, we generated Ca(v)3.2(-/-), NFAT-luciferase reporter mice and showed that NFAT-luciferase reporter activity failed to increase after pressure overload in the Ca(v)3.2(-/-)/NFAT-Luc mice. Our results provide strong genetic evidence that Ca(v)3.2 indeed plays a pivotal role in the induction of calcineurin/NFAT hypertrophic signaling and is crucial for the activation of pathological cardiac hypertrophy.</P>

        Non-fillable invariant contact structures on principal circle bundles and left-handed twists

        <P>We define symplectic fractional twists, which subsume Dehn twists and fibered twists and use these in open books to investigate contact structures. The resulting contact structures are invariant under a circle action, and share several similarities with the invariant contact structures that were studied by Lutz and Giroux. We show that left-handed fractional twists often give rise to 'algebraically overtwisted' contact manifolds, a certain class of non-fillable contact manifolds.</P>

      • An Observer-based Fuzzy Neural Network Adaptive ILC for Nonlinear Systems

        To deal with the iterative learning control problem for more general class of uncertain nonlinear systems using only output measurement, an observer based adaptive iterative learning control strategy using filtered fuzzy neural network was proposed in this paper. A model reference control technique is firstly presented to derive a state error observer for state estimation. A mixed time-domain and ..-domain representation is then used to develop an error model as a relative degree one stable system with some uncertain nonlinearities and filtered signals as the inputs. An averaging filter is also proposed to further transform the error model so that the AILC can be implemented without using differentiators. The main learning component of the controller is constructed by an filtered fuzzy neural network with the estimated state variables as network input. This main component performs as an approximator to compensate for the unknown system nonlinearities. Furthermore, a normalization signal is applied as a bounding function for designing a robust learning component in order to overcome the lumped uncertainties from function approximation error and state estimation error. Finally, a stabilization learning component is used to guarantee the boundedness of internal signals. Adaptive algorithms are derived to search for suitable parameters during each iteration since the optimal parameters for a good function approximation are in general unavailable. Based on a Lyapunov like analysis, we show that the output tracking error can converge, with all the internal signals bounded, to a small residual set whose level of magnitude depends on a design parameter. Simulation results also show the nice tracking performance with application to some practical nonlinear systems.

        The Effects of Virtual Upper Extremity Training Using the RAPAEL Smart Glove on Physical and Cognitive Function in Stroke Survivors - A Single Group Study -

        Purpose: The purpose of this study was to evaluate the effects of a virtual upper extremity training program using the RAPAEL Smart Glove on upper extremity function in stroke survivors with chronic hemiparesis and to focus the training program development using the Smart Glove as a feasibility study. Methods: This study was conducted using a single group and pre-post test research design in the outpatient departments of local rehabilitation units. Ten chronic hemiparetic stroke survivors with a diagnosis of first stroke received therapeutic rehabilitation at the rehabilitation units. All the participants used a virtual reality program with the RAPAEL Smart Glove for 30 minutes per session 3 days a week over 8 weeks. They also received conventional occupational therapy with functional electrical stimulation for 40 minutes per session 3 days a week for 8 weeks as an additional therapy. To analyze the effects of this therapeutic intervention, four clinical measures, including the box-block test (BBT), the Wolf motor function test (WMFT), the trail-making score, the Jebsen Taylor hand function test (JTHFT), and grip strength, were used. Results: Upon completion of the intervention in week 8, all the participants demonstrated significant WMFT, JTT, BBT, grip strength, and trail-making score gains compared to the respective baselines at week 0. Conclusion: This study suggests that virtual upper extremity training using the RAPAEL Smart Glove has a reasonable and beneficial effects on upper extremity function in chronic hemiparetic stroke survivors.
