한일 양국 상가임대차권리금의 역사적 배경 및 법적ㆍ사회적 인식의 차이

한국의 권리금 연구에서는 일본의 권리금 관련 판례나 학설 등을 무비판적으로 참조하고 인용해온 경향이 있었으나 두 권리금의 동일성을 검증하는 연구는 충분히 이루어지지 않았다. 따라서 이 논문은 한일 양국의 권리금을 역사적 배경, 법적ㆍ사회적 인식 차원에서 비교ㆍ검토함으로써 두 권리금이 본질과 특성에 있어 분명한 차이가 있음을 규명했다. 기존의 학설과 달리, 역사적 배경에서 양국의 권리금은 광복 전까지 거의 공통된 성질을 가지고 있었다. 그러나 광복을 계기로 서로 다른 성질을 지니게 되었다. 법적 인식 차원에서 한국의 권리금은 시설ㆍ비품 등의 유형물과 고객이나 신용, 노하우 등 영업상의 이익, 상가 위치에 따른 장소적 이익 등 유형ㆍ무형의 재산적 가치의 대가로 신구 임차인 사이에 수수되는데, 일본의 권리금은 판례상 대체적으로 장소적 이익의 대가로서 임차인이 임대인에게 지급하는 것으로 인식되고 있다. 사회적 인식에 나타난 한국의 권리금은 법적 인식에 나타난 경우와 마찬가지로 유ㆍ무형의 재산적 가치의 대가로 주로 신구 임차인 사이에서 수수된다. 한편 일본의 경우 권리금은 임차료의 일부로 인식되고 있다. In some researches on premium of Korea, there are many cases that referred to Japanese precedent or academic theory without criticism. Without comparing premium of Korea and Japan in detail, however, might lead to possible academic errors. Thus this study investigates real nature and special characteristics by comparing historical background, legal recognition and social recognition between Korean and Japanese premium. The results of this study are summarized as follows. First, triggered by Korea's independence, premium in Korea that had the same nature as Japan until the end of the Second World War has obtained different characteristics. After the Korea's independence, premium in Korea had been paid continuously as the same nature of previous one. However, nature of premium in Japan was changed just to the advantageous location of the building and a reward by notification under the name of the Price Board of Japan. Second, premium of Korea and Japan, which appeared in the legal recognition, have different nature from each other. According to the legal recognition, the premium in Korea used to be the price for goodwill, not just limited to the price for advantageous location of the building. On the other hand, premium in Japan has been mostly recognized as the cost of the place's profit which has to be paid to the landlord. Third, premium of Korea and Japan, which appeared in the social recognition, have different nature from each other. According to the social recognition, the premium in Korea is used to be the price for goodwill, not just limited to a price for advantageous location of the building. On the other hand, based on social recognition in Japan, premium has been recognized as part of the rent.

We present a method for interpreting seismic records with arrivals and waveforms having characteristics which could be generated by extremely inhomogeneous velocity structures, such as non-typical oceanic crust, decollement at subduction zones, and seamounts in oceanic regions, by comparing them with synthetic waveforms. Recent extensive refraction and wide-angle reflection surveys in oceanic regions have provided us with a huge number of high-resolution and high-quality seismic records containing characteristic arrivals and waveforms, besides first arrivals and major reflected phases such as PmP. Some characteristic waveforms, with significant later reflected phases or anomalous amplitude decay with offset distance, are difficult to interpret using only a conventional interpretation method such as the traveltime tomographic inversion method. We find the best process for investigating such characteristic phases is to use an interactive interpretation method to compare observed data with synthetic waveforms, and calculate raypaths and traveltimes. This approach enables us to construct a reasonable structural model that includes all of the major characteristics of the observed waveforms. We present results here with some actual observed examples that might be of great help in the interpretation of such problematic phases. Our approach to the analysis of waveform characteristics is endorsed as an innovative method for constructing high-resolution and high-quality crustal structure models, not only in oceanic regions, but also in the continental regions.
