애완동물 관련 손해배상 문제의 한·일 판례 동향 : 서울중앙지방법원 2010가단414531 판결을 중심으로

애완동물 사육인구가 늘어나면서 애완동물과 관련한 사건 ,사고도 늘어나며 이에 대한 손해배상 문제도 증가할 것으로 예상된다. 그러나 애완동물 관련 손해배상 문제에 대한 우리나라의 판례는 집적되어 있지 않으며 동물의 법적 지위에 대한 논의마저 확립되어 있지 않은 실정이다. 사람이 피해를 입은 경우에는 그동안 축적된 판례를 통하여 배상액 산정을 쉽게 할 수 있었으나 동물이 피해를 입은 경우에는 아직 손해배상액 결정에 관한 일관된 기준이나 판단방법이 존재하지 않는다. 학계에서 동물 관련 손해배상방법에 대한 논의가 있기 전에 평석대상판결이 먼저 나오게 되었는데 애완동물과 관련된 분쟁에 대한 판례가 희소한 때에 본 평석대상판결은 애완동물 손해배상 문제에 관한 하나의 가이드라인을 제시하는 판례로서, 그 의의가 있다. 법적으로는 물건으로 취급되는 애완동물에 대하여 기존의 법논리를 유지하면서도 시가보다 고액의 치료비를 인정하는 법논리를 개발해 내었고 동물을 단순한 물건이 아닌 생명으로 보고 존중하였으며 추후 증가할 것으로 생각되는 애완동물 분쟁 문제에 있어서도 평석대상판결의 논리가 가이드라인이 될 수 있을 것이다. 그러나 아직 대법원의 확고한 입장이 표명되지 않은 실정이므로 추후 동물 손해 문제 및 손해배상액에 책정에 대한 연구가 더 필요할 것으로 생각된다. It can be easily prospected that the compensation problems related to animals will be grown due to the rapid growth of pet feeders. However, there are not enough accumulated law cases about compensation for damages of animals and there was no discussion about it in academic circles. When people are harmed by the pet animals, the damages for compensation are easily quantified by reference to the leading cases though there are not exact method to assess the compensation when animals are harmed by other person. Before the discussion in academic world, the court set a new precedence about the compensation for the damage of pet. It is significantly meaningful leading case because it shows the guideline for the Liability problem related to animals. The court not only developed new legal principals to admit large amount of compensation for damage of pets in existing legal system but also show their respect for life. This case can be a guideline to solve the growing legal dispute about liability problem related to pets. Nevertheless, it is not the final decision of korean supreme court, it can be changed in near future. Academic studies and discussions are needed in this field.

최근 우리나라 법률시장에서는 변호과오소송이 증가하고 있으며 그 배상액도 고액화되어 가고 있다. 이는 사회가 복잡다단해지면서 전문가라 할지라도 필요한 전문지식을 완벽하게 갖출 수는 없는 반면 의뢰인은 전문가에게 점점 더 높은 수준의 전문지식과 주의의무를 요구하는 것에 기인하는 현상이다. 또한 법학전문대학원의 도입에 따른 변호사 수의 증가로 변호사간의 연대의식이 약화되면서 변호과오소송은 가파르게 증가할 것으로 예상된다. 반면 변호사 수의 증가로 인한 소득구조의 양극화로 과거와 달리 변호사의 경제적 자력도 예전에 비하여 취약해질 것으로 생각된다. 이때 보험이 적용되지 않는 변호사는 개인이 손해배상책임을 지게 되어 그 재산을 위험에 노출시키게 되고 변호사의 재산만으로는 배상금을 지급할 수 없는 경우에 의뢰인이 고스란히 손해를 입게 된다. 법률시장에서 이와 같은 잠재적 위험은 점점 증가하고 있는데도 불구하고 우리나라에서의 변호사 배상책임보험에 대한 인지도는 매우 낮으며 그 필요성도 부각되지 않고 있고 우리나라 실정에 적합한 보험상품은 미개발된 상태이다. 본고에서는 전문가 위험의 개념과 변호사가 범할 수 있는 전문가 위험인 일반적인 변호과오의 유형 및 변호과오소송에 대하여 살펴보고 제외국의 변호사 배상책임보험의 운영사례를 검토한 뒤 우리나라의 변호사 배상책임보험의 구체적인 내용과 잠재적인 문제점, 개선점 등에 대하여 분석하여 추후 우리 실정에 맞는 전문가 보험상품 개발과 정책수립에 조금이나마 이바지하고자 한다. Recently, the number of legal malpractice lawsuit is increased in Korea, and the compensation for legal malpractice also become a large amount of money. This situation is caused by the complicated society which is difficult to understand even by the profession and the client who demand more high-qualified profession and higher duty to take care to the lawyer. Moreover the number of legal malpractice lawsuit will be increased rapidly because of the growth of the lawyer due to the law school and the weakening of conscience solidaire between lawyers. Contrarily, the rapid growth of the lawyer will cause the income polarization between lawyers and the financial of lawyers will be weakened. The lawyer without professional liability insurance will pay the expenses by his own property therefore he will take high risks, and if he can’t compensate whole damages, the risk will be delegated to clients. The potential risk of legal market grows every year however the awareness for lawyers’ liability insurance and its necessity is extremely low in Korea. Furthermore, there are no appropriate insurance for Korean lawyers without the insurance which provided by foreign insurance company. There has been no discussion for the lawyers’ liability insurance before, I will review the general concept of legal malpractice and the legal malpractice lawsuit. After that I will discuss about the foreign lawyers’ liability insurance and the specific Korean lawyers’ liability insurance and its points of disputes. I hope this article will be contributed to the development of Korean lawyers" liability insurance and policy making for it.

This study is a study on the production of nail design works using Pixar animation characters and aims to provide help in the development of design that can incorporate popular materials into nail art. Considering the characteristics of the character, the work selected polycy and various art techniques and produced a total of five nail design works using various member materials that can be expressed in nail art tips. Through this study, we could see that Pixar animation characters could provide various motifs for the idea of nail design, and that the possibility of creating popular materials with nail art designs could be confirmed. In addition, we could see that Pixar animation characters are sufficiently valuable as a formative art by converging with nail art and can be combined with nail art. The materials and techniques of nail art used in the work presented various directions in color, texture, and form in expressing Pixar animation characters, and we hope that the advanced research of nail art will proceed by providing an opportunity to expand the area of nail design and applying it as a new nail art design based on various characters.
