        북한주민 재산관리 제도의 개선방안

        When a North Korean acquires the right to property in South Korea for reasons stipulated in the Act on Special Cases for Inter-Korean Families, such as inheritance and bequest, a property manager is appointed to manage the inherited and bequeathed property of the North Koreans. At the time of legislation, the North Korean property management system used the absentee property management system as the main framework, but there is a significant difference from the absentee property management system in terms of purpose and content. To this end, I offer the following opinion. ① Regarding the interpretation of “confirmation of acquisition of rights” as the time and reason for appointing a property manager, in case of inheritance and bequest, the time of death of the deceased (the testator) shall be the standard, but if there was inheritance under false pretenses, North Korean residents exercise their rights and make a judgment It should be based on the time when the provisional execution was confirmed, and if the right was actually acquired through provisional execution, it should be based on the time of provisional execution. ② Regarding the appointment process of North Korean residents, the law should be amended to allow the court to ex officio appoint a property manager. ③ Regarding the management of financial assets, the current Act on Special Cases for Inter-Korean Families is used and managed in combination with the property of a property manager, so there is a concern that the property of North Korean residents will not be protected against compulsory execution. Therefore, the law needs to be amended to recognize North Korean residents' names and North Korean resident registration numbers as “real names” under Act On Real Name Financial Transactions And Confidentiality. ④ Regarding the issue of proving the blood relationship between the heir, a North Korean citizen, and the ancestor, the genetic test system of the Missing Children Act should be introduced and genetic information should be managed. ⑤ Reasons for terminating North Korean property management must be specifically determined separately from the absentee property management system. When North Korean residents are able to manage their property on their own, they must be allowed to transfer the property from the property manager to the North Korean residents with the permission of the Minister of Justice. The law should be amended so that the court can cancel the property management at the request of North Korean residents, property managers, interested parties, or prosecutors when the property transfer process is completed. Considering that the North Korean property management system has a legitimate legislative purpose to prevent the possibility of South Korean property being diverted to the North Korean authorities, an anti-state organization under the National Security Law, and at the same time significantly restricts the property rights of North Korean heirs, It is necessary to make efforts to achieve the legislative purpose by reorganizing the regulations in more detail, and to prepare for unexpected disputes. 북한주민이 상속⋅유증 등 남북가족특례법에 규정된 사유로 남한 내 재산에 관한권리를 취득한 경우에는 북한주민의 상속⋅유증재산 등을 관리할 재산관리인이 선임된다. 북한주민 재산관리 제도는 입법 당시 부재자 재산관리 제도를 주된 틀로 삼았으나, 목적이나 내용에서 부재자 재산관리제도와 상당한 차이가 있기에 이로 인하여 발생이 예상되는 문제점이 있으며, 이를 개선할 방안을 마련해야 한다. 이에 필자는, ① 재산관리인의 선임시기 및 사유로서 “권리의 취득의 확정”의 해석에 관하여 상속 및 유증의 경우 피상속인(유언자)의 사망시기를 기준으로 하되, 참칭상속 등이 있었다면 북한주민이 권리행사를 하여 판결 등이 확정된 시점을 기준으로 해야 하고, 만약 가집행 등을 통하여 실질적으로 권리를 취득했다면 가집행 선고를 받은시점을 기준으로 삼아야 한다는 의견, ② 북한주민의 선임절차와 관련하여 법원이 직권으로 재산관리인을 선임케 할 수 있도록 하는 법률 개정이 필요하다는 의견, ③ 금융재산관리와 관련하여 현재 남북가족특례법으로는 재산관리인의 재산과 혼용되어 관리되기때문에 강제집행 등에 있어 북한주민의 재산이 보호받지 못할 우려가 있으므로 북한주민 명의와 북한주민등록번호를 금융실명거래 및 비밀보장에 관한 법률상 “실지명의” 로 인정하는 법령의 개정을 고려해야 한다는 의견, ④ 상속인인 북한주민과 피상속인과의 혈연관계 입증과 관련하여는 실종아동법의 유전자 검사 제도를 도입하고, 유전정보를관리하도록 하는 방안을 검토할 필요가 있다는 의견, ⑤ 북한주민 재산관리 종료사유를 부재자 재산관리제도와 별도로 구체적으로 정하고, 북한주민이 스스로 재산을 관리할수 있게 된 경우 직접 사용⋅관리와 관련한 법률의 개정, 혹은 별도의 규정으로 법무부장관의 허가를 받아 재산관리인으로부터 북한주민으로 재산을 이전할 수 있도록 한뒤, 재산이전절차가 종료되면 북한주민, 재산관리인, 이해관계인, 검사 등의 청구에 따라 법원이 재산관리를 취소할 수 있게 하는 등의 법률 개정이 이루어지는 등의 개선방안이 마련되어야 한다는 의견을 각 제시하였다. 북한주민 재산관리제도는 남한의 재산이 국가보안법상 반국가단체인 북한당국에전용될 가능성을 막기 위한 정당한 입법목적이 있는 동시에, 북한주민 상속인의 재산권을 상당히 제한하는 점을 고려할 때 우리는 기존의 규정을 더 섬세히 정비하여 입법목적의 달성을 위해 노력하고, 예상치 못한 분쟁을 대비해야 한다

        험프리매트릭스 주파수배가시야검사법과 표준 자동시야검사법의 검사 지표에 대한 비교 분석

        Purpose: To evaluate and compare the diagnostic performance of Humphrey Matrix frequency doubling technology perimetry (Matrix) global indices with standard automated perimetry (SAP) for glaucoma discrimination. Methods: Forty-seven healthy and 63 glaucomatous subjects were included in this study. Glaucoma was defined as having glaucomatous optic disc and glaucomatous visual field defect. Correlations of mean deviation (MD) and pattern standard deviation (PSD) between Matrix and SAP were evaluated. Areas under receiver operating characteristic curves (AUCs) for discriminating healthy from glaucoma, sensitivity, and cut-off value at fixed specificity of MD and PSD were determined in Matrix and SAP. Results: MD and PSD from Matrix were highly correlated with SAP data in glaucomatous eyes (r =0.80, 0.69 p<0.001, <0.001). The AUCs of MD and PSD from Matrix (0.941, 0.921) were of comparable diagnostic capability to SAP data (0.876, 0.923, p=0.068, 0.927). The sensitivity at 90% specificity of MD was 67.9% in SAP, 76.4% in Matrix, with the cut off value of MD at 90% specificity at -3.10dB in SAP and -3.72dB in Matrix. Conclusions: MD and PSD data from Matrix and SAP significantly correlated in glaucomatous eyes and showed similar diagnostic performance for discriminating healthy from glaucoma however, both MD and PSD are scaled differently on SAP and Matrix, which suggests that application of these parameters in a manner similar to that used in SAP should be employed with caution. 목적: 매트릭스시야검사법과 표준 자동시야검사법의 global index를 비교하였다. 대상과 방법: 정상안 47, 녹내장안 63에 대해 mean deviation (MD)과 pattern standard deviation (PSD)의 상관관계, 녹내장과 정상안 을 감별하는 Areas under receiver operating characteristic curves (AUCs)값, 일정한 특이도에서 민감도 및 cut off값을 분석하였다. 결과: 녹내장안에서 두 시야검사의 MD와 PSD는 상관관계를 보였다(r=0.80, r=0.69). 매트릭스시야검사법의 MD, PSD의 AUC는(0.941, 0.921) 표준 자동 시야검사법과 (0.876, 0.923) 차이를 보이지 않았다(p=0.068, 0.927). 90%의 특이도에서 표준 자동시야검사와 매트 릭스시야검사의 MD의 민감도는 67.9%, 76.4%, cut off값은 -3.10dB과 -3.72dB였다. 결론: 두 시야 검사의 MD와 PSD는 상관관계를 보였고, 녹내장 진단력은 차이를 보이지 않았다. 그러나 유사한 특이도에서 cut off값은 차이를 보이므로 실제 임상에서 주의가 필요할 것이다.

        녹내장 시야 지표의 임상적 유용성

        Purpose: To determine the associations of visual field index (VFI) with advanced glaucoma intervention study (AGIS) score, mean deviation (MD), pattern standard deviation (PSD), and average retinal nerve fiber layer (RNFL) thickness as measured by optical coherence tomography (OCT) and to evaluate the diagnostic abilities of these parameters. Methods: One hundred fifteen glaucomatous eyes and 78 healthy eyes were enrolled in this cross-sectional study. Each participant had a Humphrey visual field analyzer test and OCT done. The diagnostic abilities of these parameters were analyzed using the receiver operating characteristic (ROC) curve, and we sought to determine the association of these parameters with VFI by Pearson correlation analysis. Results: The associations between analyzed parameters and VFI were statistically significant (all, p<0.001). The area under the ROC curve (AUROC) value of VFI was greater than that of the MD and AGIS score (all, p<0.001) but was not different from the PSD and RNFL average thickness measured by OCT (p=0.756, p=0.638). Conclusions: The VFI showed significant associations with AGIS score, MD, PSD, and average RNFL thickness as measured by OCT and revealed similar diagnostic abilities as these parameters.         녹내장안에서 망막신경섬유층두께와 중심각막두께의 상관관계 분석

        Purpose: To evaluate the correlation between central corneal thickness (CCT) and retinal nerve fiber layer thickness (RNFLT) as determined by optical coherence tomography (OCT) in glaucomatous subjects. Methods: One hundred eyes diagnosed with glaucoma and 99 glaucoma suspect (GS) eyes were tested by visual field (VF), OCT, and ultrasonic pachymetry. The relationship between CCT and RNFLT measurements was assessed by Pearson correlation analysis. A mixed effect model was employed to determine the relationship between CCT and RNFLT in glaucoma and GS groups. We divided the patients into two groups depending on the thickness of their corneas: Thin (< 553.6 μm) and thick (≥ 553.6 μm), and compared three parameters: VF mean deviation (MD), pattern standard deviation (PSD), and RNFLT between the two groups. Results: There were no significant correlations between CCT and RNFLT in any participant (R2=0.00, p=0.88). There was no significant relationship between CCT and RNFLT in glaucoma and GS groups (p=0.11, p=0.46). There were no statistically significant differences in MD, PSD, or RNFLT between the thin and thick cornea groups (p=0.38, 0.32, 0.44). Conclusions: CCT is not significantly associated with RNFLT in glaucoma and GS subjects.
