국가를 위한 배상명령에 관한 소고

본 연구는 범죄로 인한 국고손실에 대해서는 범죄자를 상대로 별도의 국가소송을 제기하는 것보다 󰡔소송촉진 등에 관한 특례법󰡕에서 정한 배상명령절차를 이용하면 더 신속하고 효율적으로 국고를 환수할 수 있을 것이라는 생각에서 출발하였다. 그동안 배상명령에 대한 논의와 연구는 주로 배상명령이 제도적인 면이나 운용의 면에 있어서 제한적이라는 인식 아래 그 문제점과 원인을 분석하고 이를 개선하는 데 초점이 맞추어진 것으로 보인다. 배상명령은 대상범죄의 피해자(상속인 포함)의 신청 또는 법원의 직권으로 배상을 명할 수 있도록 규정되어 있고 달리 범죄피해자를 자연인으로 한정하고 있지 않다. 따라서 국가가 사기죄, 횡령죄 등의 피해자인 경우 국가도 범죄피해자로서 신청 또는 직권에 따른 배상명령을 받을 수 있다고 판단된다. 국가가 국고손실을 환수하는데 배상명령을 활용할 수 있다면 별도의 민사소송을 제기하여야 하는 데서 발생하는 소송지연과 여러 가지 부담을 줄일 수 있다. 국가의 적극적인 기능 강화로 인한 국가재정의 증가와 함께 국가를 상대로 하는 범죄로 인한 국고손실도 늘어나고 있는 현실에서 배상명령을 활용할 필요성이 있다. 그럼에도 불구하고 이에 대한 논의나 연구는 찾아보기 어렵다. 소송수행자들이 개별적으로 국가를 위한 배상명령을 신청한 사례가 8건, 그중 인용된 사례는 1건만 확인될 뿐이다. 󰡔소송촉진 등에 관한 특례법󰡕은 배상명령신청에 대한 각하에 대하여 불복을 허용하지 않는다. 이는 범죄피해자의 권리를 침해하는 것으로서 이에 대한 개정이 필요하다. 국가를 위한 배상명령절차는 국가소송에 해당한다. 따라서 󰡔국가를 당사자로 하는 소송에 관한 법률󰡕에 따라 검사가 소송지휘를 하게 되므로 효율적인 소송수행이 가능하다고 할 것이다. 이 연구를 계기로 국가를 위한 배상명령에 대한 많은 논의가 있기를 기대한다. This study suggests that the government treasury can be recovered more quickly and efficiently by using the compensation order procedure stipulated in the ｢Act on Special Cases concerning Expedition, etc. of Legal Proceedings｣, rather than filing a separate state litigation against criminals for the loss of the national treasury due to crime. started with thinking. In the meantime, it seems that the discussion and research on the compensation order has been mainly focused on analyzing the problems and causes and improving them under the recognition that the compensation order is limited in terms of system and operation. The compensation order is stipulated to be ordered by the victim (including heirs) of the targeted crime or by the court ex officio. Therefore, if the state is a victim of fraud or embezzlement, it is judged that the state can also receive a compensation order as a victim of a crime or ex officio. If the state can use the compensation order to recover the national treasury loss, the delay in litigation and various burdens caused by having to file a separate civil lawsuit can be reduced. With the increase in national finances due to the active strengthening of the state’s functions, it is necessary to utilize the compensation order in the reality that the loss of the state treasury due to crimes against the state is also increasing. Nevertheless, it is difficult to find discussions or studies on this. There were eight cases in which the litigants individually applied for a compensation order for the state, and only one case was cited. The ｢ Act on Special Cases concerning Expedition, etc. of Legal Proceedings｣ does not allow an appeal against the rejection of an application for a compensation order. This infringes on the rights of crime victims and requires revision. The procedure for ordering compensation for the state is the state litigation. Therefore, according to the ｢Act on Litigation to which The State is a Party｣, the prosecution will lead the litigation, so it will be possible to conduct litigation efficiently. With this study as an opportunity, it is expected that there will be many discussions about the compensation order for the state.

교회경영의 세속주의에 관한 고찰

본 연구는 교회의 세속주의 현상을 고찰하고 이를 극복하기 위한 방안을 도출해 낼 목적으로 수행되었다. 이를 위해 이론적 배경에서는 세속화와 세속주의의 개념을 고찰하고, 본론 부문에서는 교회의 세속주의 현상 분석과 극복방안을 제시하였다. 세속화는 종교적 가치와 제도가 매우 동일시되던 사회가 비종교적 가치와 세속적 제도로 변화하는 과정을 일컫는 말이다. 이에 반해 세속주의는 하나의 이데올로기, 새로운 종교와 똑같은 역할을 하는 새로운 폐쇄적 세계관을 의미한다. 교회의 세속주의에 대해 야고보서와 요한계시록을 통해 정리해 보았다. 교회의 세속주의 물결로 성장주의, 시모니즘과 맘모니즘, 절대 권력화 현상, 프로그램 중심목회, 은사의 계급화 등을 제시하였다. 세속주의를 극복할 수 있는 방안으로는 지속적인 교회의 개혁 추진, 시장지향적인 조직, 권한의 분권화를 제시하였다. This paper studies the phenomenon of church secularism and it also finds proper ways to overcome this secularization in church. This paper further investigates the concept of secularization and secularism in the theoretical background, and then analyses the secular phenomenon of church to suggest the solutions on it. Secularization is the process of social change from the society in which people regard the religious value and social system as identical to the society in which nonreligious value and secular system are prevalent. On the other hand, secularism is an ideology which represents a new and closed view of the world that plays a role as a new religion. This paper analyzes the secularism of church through the Book of James and Revelation. The study proposes growth orientation, simmonism, mammonism, pursuing absolute power, program centered ministry, and the stratification of spiritual gift to the wave of secularism of church. The study then suggests continuous reformation of church, market oriented church organization, and decentralization of church authority to overcome secularism.

특수체육지도자의 보완대체의사소통 현장적용 방안에 관한 연구

본 연구의 목적은 특수체육현장에서 의사소통 장애인들을 위한 보완대체의사소통(AAC) 지원 필요성 및 보완대체의사소통 현장적용에 방안을 알아보기 위함이다. 연구를 위하여 10명의 현직 특수체육지도자를 대상으로 개방형 질문에 의한 인터뷰가 이루어졌다. 연구방법은 질적연구방법으로 Nvivo10 분석방법이 적용되었고, 7개의 주제영역과 21개의 하위영역으로 구성하여 분석하였다. 연구결과는 다음과 같다. 첫째, 의사소통장애인들에 대한 효과적인 지원을 위해 특수체육지도자들은 AAC에 대한 지식과 기술이 필요하며, 다양한 AAC 운용 능력이 필요하다. 둘째, 특수체육학 교과과정에 AAC 교과 포함 및 이수과정이 필요하며, 특히 실습 중심(AAC 기술적용 및 AAC 기기사용법)의 교과과정 실행이 중요하다. 셋째, 현장에서의 특수체육 활성화를 위해서는 AAC 에 대한 현장활용 능력을 갖춘 특수체육 지도자 양성이 필요하다. 이를 위해 사례발표, 중재 기술과 평가, AAC에 관한 학문간 통합 세미나 등의 다양한 프로그램이 요구된다. 결과, 특수체육이 AAC의 적절한 사용을 통해 의사소통장애인 체육교육의 효율성을 증대시킬 수 있으며, 이를 위해 특수체육지도자 중심의 AAC 전문가 양성이 중요함을 보여주고 있다. 또한 본 연구는 특수체육 현장에서 AAC 도구 및 기기의 적절한 사용은 의사소통장애인들을 위한 교육 및 활동 서비스 질 향상에 기여할 것이고, 나아가 현장 중심의 다양한 AAC 도구 및 개발에도 일조할 수 있음을 시사하고 있다. The study describes the necessity of augmentative and alternative communication(AAC) for those who have communication disabilities in the filed of adapted physical activity. The study also reports that adapted physical education needs to provide college students with AAC in the curriculum and its continual education and training programs even after graduation for the purpose of rearing experts who are proficient in AAC. For the study, 10 adapted physical education teachers were selected for interview and questioned with three open-ended questions. As a qualitative research method, Nvivo10 was employed for analysis. Findings are as follows. Two themes and six codes are categorized under the question of the necessity of AAC in the field. Interviewees all described that they need to acquire AAC knowledge and skills and should be competent in using various AAC devices. As to the second question, which is about the inclusion of AAC in curriculum, two themes and five codes are gathered through interview. Interviewees all requested that practice-centered AAC class as a subject and its completion should be satisfied for graduation requirements. In particular, interviewees expressed their desire to learn communication skills and the uses of AAC devices in the class. Regarding the final question of rearing experts in AAC, three themes and nine codes are categorized. Most of interviewees showed positive respond and requested various programs such as case presentation, intervention skills and its practice along with evaluation, interdisciplinary integrated seminar on AAC. It is imperative for adapted physical education to develop AAC devices and provide college students with its uses for those who have communication disabilities. With an appropriate use of AAC devices, it is also highly expected to improve service quality for people with communication disabilities in the filed of adapted physical activity.
