캐나다 비자의치료제도의 현황과 한국적 함의 : 온타리오주를 중심으로

본 연구는 캐나다 온타리오주의 비자의입원 및 지역사회치료명령 제도를 검토함으로써 정신장애인에 대한 비자의치료제도 개선에 함의를 도출하는 데 목적이 있다. 온타리오주는 2011년 정신건강·중독 전략 ‘Open Minds, Healthy Minds’를 발표하며 포괄적 정신건강정책을 지향하고 있다. 정신장애의 개념을 광범위하게 정의함으로써 정신장애인에 대한 낙인을 줄이고 서비스 접근성 향상을 위한전략을 추진하고 있다. 온타리오주의 비자의입원, 지역사회치료명령제도는 개인의 자유와 권리 보장의 측면에서 다른 주에 비교해 상대적으로 전향적이다. 그럼에도 불구하고 비자의치료는 개인의 자유를 상당 부분 침해한다고 지적되고 있으며, 이를 보완하기 위해 다양한 대안이 시도되고 있다. 연구를통해 국내 정신질환자에 대한 낙인 감소를 위한 포괄적 전략, 동료지원가 중심의 절차보조서비스 제도화, 시설과 지역사회의 연계, 공공후견·신탁사무소 설치, 권익옹호를 위한 세부 법률 제정의 함의를 제시하였다. The purpose of this study is to suggest implications for the improvement of the involuntary treatment system for people with mental illness in Korea by reviewing the mental health system (involuntary treatment and CTO) in Ontario, Canada. The Government of Ontario announced its mental health and addiction strategy Open Minds, Healthy Minds in 2011, aiming for comprehensive mental health policy. By broadly defining the concept of mental disability, the government is pushing for strategies to reduce the stigmas for the mentally disabled and improve service accessibility. Ontario’s involuntary admission and CTO are relatively forward-looking compared to other states in terms of individual freedom and rights. Nevertheless, it is pointed out that involuntary treatment violates individual freedom, therefore various alternatives are being tried. The results of this study suggest the following implications in Korea: need for a comprehensive strategy to reduce stigma, legislation of peer-led procedure support service, connection between facilities and communities, establishment the Office of the Public Guardian and Trustee, and enactment of specific laws to protect human rights.

정신건강 서비스 환경변화에 따른 정신재활시설의 기능 전환

국내외적 정신건강 서비스 환경은 회복, 인권, 복지, 그리고 당사자 중심으로 빠르게 변화해가고 있다. 하지만 지역사회 정신건강체계로서 주요한 역할을 담당하고 있는 정신재활시설의 기능은 이를 충분히 반영하지 못한다는 비판을 받고 있다. 이에 본 연구에서는 정신재활시설의 서비스 현황 및 문제점에 대한 이해관계자의 인식을 파악하고, 변화방향에 대한 함의를 도출하고자 하였다. 이를 위해 정신장애인 당사자 단체에서 9명, 시설 이용자 7명, 가족 9명, 시설 종사자 9명, 정책관계자 9명 등 총 5개 집단의 43명을 대상으로 초점집단 인터뷰를 실시하였다. 인터뷰 참여자들은 향후 정신재활시설의 변화에 대해 ‘개인의 자유와 선택권의 보장’, ‘개별화된 욕구를 반영한 맞춤형 지원’, ‘주체적인 활동을 통한 성장’, ‘자립을 위한 실제적인 지원’, ‘동료지원가의 배치’, ‘지역사회 참여기회 확대’를 제안하였다. 이를 토대로 정신재활시설의 기능 전환을 연결, 희망, 정체성, 삶의 의미, 역량강화의 회복지향 서비스로 제안하였으며, 이를 위한 제도적 개선방안에 대해 제언하였다. Both domestic and international mental health service environments are rapidly changing focusing on the issues of recovery, human rights, social service, and peer support. However, it is criticized that the functions of community psychiatric rehabilitation centers, which play critical roles in the community mental health system, have not been able to keep up with the paradigm shift. In order to derive practical implications for future directions of psychiatric rehabilitation services, this study aimed to identify the current status and problems of psychiatric rehabilitation centers. For this purpose, we ran 5 focus group interviews(FGI) involving a total of 43 stakeholders, including 9 individuals from a self-help agency, 7 service users, 9 family members, 9 mental health professionals, and 9 public servants. FGI participants proposed recovery-oriented directions for future changes, such as ‘guarantee of individual freedom and choice’, ‘customized support responding to individual needs’, ‘growth through self-reliant autonomous activities’, ‘practical support for independence’, ‘placement of peer practitioners’ and ‘expanding opportunities for community participation’. Based on these results, we discussed future directions of psychiatric rehabilitation centers to recovery-oriented services encompassing connection, hope, identity, meaning of life, and empowerment.
