    • (A) comparative study on carriage of goods by sea between Vietnam law and Korean law

      Maritime transport services constitute a leading sector that supports the expansion of world trade in light of the fact that world seaborne trade has continued to increase steadily over the last decades despite the intervening economic fluctuations. Especially, the carriage of goods by sea plays important roles in international trade because goods are to be transported from a seller in one place to a buyer in another place. Both of Vietnam and Korea are also developing maritime sector in respect of carriage of goods by sea in recent years. In this paper, I had comparative research on the contract for carriage of goods by sea under Maritime Law of Vietnam and Korea. My method of study is that provisions of Vietnam law on contract for carriage of goods by sea on content are shown first in each and then Korean law on carriage of goods by sea are explained. Chapter One is the part of introduction. The author firstly points out the necessity and significance of selecting the issue of carriage of goods by sea as the topic for the study, and introduces the research background, content and method. Chapter Two is overview of Vietnam Maritime Code and Korean Maritime Law. It is introduced by all of chapters in Vietnam Maritime Code and Korean Maritime Law. Chapter Three is main sources and scope of application of Vietnam Maritime Code and Korean Maritime Law. The legal aspects of sources of law and scope of application is also important since it will provide a background to the main problem. Chapter Four is a comparison between Vietnam law and Korean law on carriage of goods by sea which have been seen as distinctive and fairly diverse. This is a main part of this paper. A result of comparison will give a broader perspective to the problem, but it will serve as a guideline when analysing and discussing Maritime law of both countries. Chapter Five addresses court system and arbitration on maritime dispute resolution. In this section, the author shows two main ways to resolute dispute of maritime, which are court and arbitration system of Vietnam and Korea. Chapter Six is the part of conclusion in which the author summaries on the whole of this paper and shows some suggestions for improvement for Vietnam law and Korean law and some important points necessary for thinking in the future.

    • A Study on Legal Issues Concerning the Autonomous Ship under Maritime Legal Regimes

      In the era of the 4th Industrial Revolution, technology change and innovation are required throughout the new economy and society. In the shipping industry, the development of autonomous ship technology has attracted worldwide attention, and interest is growing in academia, industry, and maritime authorities. Technological changes in the aviation, automobile, and information and communication sectors have caused a wave of technological innovation in the shipping and shipbuilding sectors. Voices have recently been growing over the need to introduce autonomous ships linked to automation, eco-friendliness, digitalization, and artificial intelligence. Increasing trust and social acceptance of emerging new technologies help manufacturers become more efficient. Artificial intelligence contributes to solving challenges in many aspects, including securing maritime safety, reducing crew costs, promoting eco-friendliness, and streamlining logistics based on convergence with 4th Industrial Revolution technologies. Autonomous ships can contribute to reducing ship operational costs by replacing traditional crews with artificial intelligence to prevent marine accidents caused by human factors and operate ships reliably and efficiently. The use of autonomous ships in maritime transport seems inevitable; however, if autonomous ships are commercialized, sophisticated issues will arise. The impact of new technologies and the challenges that come along with them on maritime operation should be assessed from both technical and regulatory perspectives. In addition to the technical requirements for autonomous operation on ships, a new generation of naval architects, technicians, and engineers are equally needed at the shore-side. Training and education for new roles in operation and management are quickly required simultaneously. The challenges are not merely technical; accommodating the existing legal regime to new developments is another essential consideration. Automation technologies may give rise to significant terminological confusion, and there are important challenges and legal issues that must be analyzed with great caution. Many of the rules are defined and operated under the assumption that human elements are involved on board, with the master and crew in charge of the ship. However, the automation of ships allows for the eventual absence of human elements on board, which incurs significant consequences that require a thoughtful response from maritime law. It is necessary to explore the extent to which existing legal regimes from both public and private maritime laws may require a new legal framework or a modified amendment. Indeed, the International Maritime Organization (IMO) agreed to conduct a regulatory scoping exercise relating to MASS at the 105th LEG meeting and the 99th MSC meeting in 2018. It processed a regulatory scoping exercise on autonomous ships to identify which existing instruments need to be developed and which legal instruments need to be amended. The list of instruments to be covered includes, among others, those covering safety (The International Convention for the Safety of Life at Sea, SOLAS); collision regulations (The International Regulations for Preventing Collisions at Sea 1972, COLREG); training of seafarers (The International Convention on Standards of Training, Certification and Watchkeeping for Seafarers, STCW); search and rescue (SAR); The International Convention for the Prevention of Pollution from Ships (MARPOL); Convention for the Suppression of Unlawful Acts against the Safety of Maritime Navigation (SUA), and The International Convention on (SALVAGE). However, there is still a long way to go, and it is not easy to determine the degree of reform that should be carried out. Against this background, this study aims to contribute to laying the foundation for the establishment of new regimes through the IMO by addressing maritime law and maritime legal issues related to autonomous ships. The main objective of this research is to critically evaluate the legal framework closely linked with the use of autonomous ships. This research covers several selected topics associated with autonomous ships, spanning public and private legal issues arising from the operation of autonomous ships. This paper consists of a total of five chapters, with the introduction explaining the purpose of the study, methodology, and literature review. Chapter 2 is dedicated to assessing the development of autonomous technologies and the contributions of artificial intelligence in making the shipping industry more efficient. Central to this discussion are the basic terminology and legal definition associated with the use of autonomous ship, as well as the advantages of autonomous technology in enhancing the safety and environmental sustainability of the shipping industry. Special attention is given to common causes of legal issues related to autonomous ships and the concerns that arise with their development. Chapter 3 examines key maritime terms and seeks to find corresponding interpretations under public maritime law. This section also addresses the rights and obligations of states imposed by the 1982 UN Convention on the Law of the Sea, with issues such as flag state jurisdiction and the rights of navigation for autonomous ships discussed. The corresponding legal implications in South Korea and China are also assessed. Chapter 4 covers a selected collection of private law issues associated with the use of autonomous ships in the maritime industry, which are affected by emerging technologies and, in turn, influence the development of autonomous ships. This section delves into topics such as seaworthiness of autonomous ships, cyber risks posed in the new era, and potential liability regimes for intelligence systems and autonomous ships. In the final part of this chapter, the challenges of marine insurance for the use of autonomous ships are reviewed, as well as the assured's duty of fair presentation and the insurer's knowledge of the assured risk. By focusing on the conceptual implications of autonomous ships, this research identifies several essential legal issues connected to the development of autonomous technologies that have not yet been fully addressed. The requirements provided under existing IMO Conventions need reconsideration and amendment for the use of autonomous ships. Although amending the existing regimes may be challenging, treaty interpretation could provide an effective way to resolve issues related to the use of autonomous ships. Regardless, it is clear that necessary changes to existing legal regimes will take time and face scrutiny and opposition from various government authorities and maritime industries.

    • 義務保險을 통한 船舶運航 被害者 保護에 關한 硏究

      2014년 조사 문헌에 따르면, 국내 약 60여개 법률이 의무보험을 채택하고 있었다. 2006년 조사 때 30여개인 점을 고려하면 의무보험이 꾸준히 증가하였다. 해양수산부에서 소관 하는 97개 법률과 선박운항과 관련한 타 부처의 소관법률을 확인한 바, 10여개 법률에 의무보험이 적용 중에 있다. 의무보험은 피해자의 보호와 구제, 가해자의 배상자력확보 그리고 대안적 행정규제로서의 역할을 한다. 하지만, 이는 의무보험이 정상적으로 작동함을 전제로 하는데, 전반적으로 해사법령상 의무보험제도에 문제점들이 발견되었다. 지금까지 많은 의무보험의 입법되었음에도 불구하고, 불행이도 국내 참고할 문헌이 많지 않았다. 특히 선박운항이라는 특수성과 선박의 사고로 인한 피해자보호의 측면에서 의무보험에 대한 입법 방향을 제시한 자료는 거의 찾아보기 힘들었다. 지금까지의 문헌들을 보면, 주로 개별 법령 또는 관련 국제해사협약을 연구해 오고 있었다. 의무보험이 주요 주제가 아니다 보니 의무보험만을 논의할 기회가 많지 않았던 것으로 보인다. 한편으론 의무보험을 규정하고 있는 개별 법령마다 소관행정부처가 다르고, 법령마다 제정 및 개정의 배경과 취지 및 이해관계자들이 다르기 때문에 공동주제로서 함께 논의할 기회도 없었던 것으로 보인다. 본 논문은 현 해사법령상 의무보험제도를 보다 전문화하고 체계화하여, 의무보험의 실효성을 유지시켜서 선박운항 중에 발생할 수 있는 피해자를 보호하고자 한다. 이에 우선 선박운항과 관련하여 이미 의무보험을 적용하고 있는 7개 국제해사협약들의 의무보험 내용을 살펴보고자 한다. 아울러 국내에서 의무보험을 적용하고 있는 10개 해사법령상 의무보험 내용을 제/ 개정의 배경, 보험가입주체, 보험종류, 보상위험, 보험가입금액, 보험관리 등을 보험의 주요 조건을 중심으로 현황과 문제점을 살펴보며, 해사법령에 적합한 보험의 종류도 제시한다. 그리고 상기 연구를 토대로 의무보험제도의 실효성을 위해서 보험가입주체, 보험의 종류, 보상위험, 보험가입금액, 보험관리, 보험자 관리 측면에서 개선안을 제시한다. 더불어 상법상 고려할 부분으로서 직접청구권, 국제사법, 무과실책임, 선박우선특권, 선박소유자의 책임제한제도 그리고 보험자의 면책사유 등 개별 주제들을 고찰하며, 의무보험을 통한 피해자 보호 측면에서 의견 또는 개선안을 제시한다. 마지막으로 선박운항에 있어 의무보험을 추가적으로 도입해야 할 부분에 대해서 필자의 의견을 제시한다. According to the research literature in 2014, about 60 domestic laws have adopted a compulsory insurance. Considering it was only about 30 laws at the time of the 2006 survey, the compulsory insurance has steadily increased. When we confirmed the 97 laws under the 'Ministry of Oceans and Fisheries' and laws under other ministries concerning ship operation, the compulsory insurance has been applied to about 10 laws. The compulsory insurance plays a role as protection and relief of victims, securing the compensation amount for the victims and alternative administrative regulations. It is under the condition that the compulsory insurance is being operated normally, however, overall problems were found in the compulsory insurance system under the maritime laws. Although the compulsory insurance had been applied to many laws, not many domestic references had been available unfortunately. In particular, it is so hard to find much information on the legislative direction of the compulsory insurance in terms of the protection of victims due to an accident of a ship and ship operation. Looking at literatures so far, laws or other relevant international maritime conventions have been studied mostly. It seems that there was not much opportunity for the compulsory insurance to be discussed because it was not a main subject. Meanwhile, it seems that there was no opportunity to discuss together as a common agenda because not only the background and purpose of the enactment and its amendment in laws but also interested parties were different from a law. In this paper, the compulsory insurance system under the current maritime laws shall be specialized and systemized to keep the effectiveness of the compulsory insurance in order to fulfill its final purpose to protect victims that could be occurred during ship operations. Thus, first of all, the 7 international maritime conventions which already accepted the compulsory insurance in connection with ship operation will be studied. In addition, it will be reviewed on current status and problems through the background of the laws, entities to be entered into the insurance, types of the insurance, risks covered, insurance amount and insurance management based on the main contents of the compulsory insurance under 10 maritime laws. Then the type of suitable insurance for maritime laws will be presented. Based on the above research, improvement proposals will also be presented in terms of person to be entered into the insurance, types of insurance, Risks covered, insurance amount, Management of insurance and insurers for the effectiveness of the compulsory insurance system. Furthermore, as part to be considered in the Commercial Law, opinions and improvement proposals for victim protection through the compulsory insurance will be presented in consideration of Direct Action, Private International Law, Strict liability, Maritime liens, Ship-owner's Limitation of Liability and Risks excluded by insurers. Lastly, opinions from the author of this thesis as to where the compulsory insurance system need to be applied to the shipping operation will be presented.

      최근 몇 십년 간 세계화의 중심이 경제영역이며 이로부터 특히 국제해상무역 분야는 그 영향력이 날로 확장되고있다. 저마다 각구의 해운사는 자국의 해상법을 따르고 있지만, 세계가 서로 접촉하고 료류하는 세계해운시장은 국제성을 갖고있다. 특히 싱가폴은 ‘경제적 왕관을 장식하는 빛나는 보석’ 으로 자유무역항이며, 아시아 유럽 미주를 연결하는 중심항로에 최적 위치하여 국제간 무역의 중간지점으로서 세계에서 가장 분주하고 물동량이 많은 항구중하나이다. 본 논고에서는 싱가폴 및 한국 해상법 상에서의 해상화물운송계약에 관한 비교법적 검토를 실사하였다. 해상화물운송계약에 관한 싱가폴법 상의 조항들을 각각 목차로 구성하여 이하에 소개되는 한국법에 대입하는 방법으로 연구하였다. 목차는 다음과 같이 구성되어있다.

    • 선박화재와 관련한 해상법상 문제에 대한 연구

      During the past five years form 2016 to 2020, 588 marine accidents were caused by ship fires or explosions that is about 4.3% of total marine accidents of same period. But ship fires at home and abroad have been steadily increasing recently. During the past five years from 2016 to 2020, total 13,687 marine accidents have occurred and 588 accidents were caused by ship fires or explosions. They consist only about 4.3% of total marine accidents, but mega ship fires within territorial and international waters have been steadily increasing in recent years. Well known ship fire cases in Korea include the car carrier “Auto Banner” fire accident at Incheon Port in 2018, car carrier “Platinum Ray” fire accident at Ulsan Port in 2019, the chemical carrier “Stolt Groenland” fire/explosion accident at Ulsan Port in 2019, and the cable layer “Responder” fire/sinking accident in 2020. A fire on a ship causes a large amount of damage to hull and all cargoes on board, and the fire extinguishing work must depend solely on crews without external help, and it is very difficult to prove negligence of relevant parties. In particular, due to the recent increase of large-scale ships, damage to life and property has also been increased in the event of a ship fire accident. In fact, various legal issues arise when such a ship fire accident occurs, and legal relationship between relevant parties is also complicated. However, previous dissertations and studies on ship fires were limited to the scope and requirements of the carrier's fire defense and analysis on some precedent cases or narrowly focus only some issues of ship fires. This dissertation went one step further from previous studies to deal with all issues caused by ship fires to the extent possible, including legal issues relating to commercial code and civil code, marine safety tribunal, firefighting costs, and administrative litigation in respect of clean-up cost, so that it can provide practical guideline regarding ship fire accident. To this end, this dissertation firstly analyzed the characteristics of ship fires that vary according to various types of ships and cargoes, and examined the practical status through specific accident cases. In particular, it was pointed out that recent fires in a car carrier should be examined very carefully as they cause combination of issues arising out of characteristics of cargo such as vehicle and the structure of a car carrier. In order to examine contractual legal issues related to ship fire, it is necessary to examine the complex contractual relationship between various forms of maritime transport. In the past, it was common for shipowners to carry the cargo as a carrier and deliver the cargo received from the shipper to the consignee, so legal issues between contracting parties were simple. However, various forms of maritime transport are being arranged in these days, such as carriage by NVOCC who does not operate the ship directly and carriage by a charterer who charters a vessel from the shipowner or bare boat charterer. Despite various legal relationships, the liable parties for ship fires depend on who operate and manage the ship. In many cases, a shipowner or bare boat charterer is responsible for managing the ship, and in other cases, a time charterer has the responsibility due to their involvement in the operation of the ship, such as a right to give instruction to a captain under Article 8 of NYPE. In addition, terminal operator, multimodal carriers, shipbuilders, crews, and mortgagees are closely related to maritime transport as contracting parties, so the scope of relevant parties may expand depending on the type of ship fires. On the other hand, ship fires cause various external liability rd in addition to contractual liabilities and criminal punishment and administrative legal sanctions for those who are at fault. Various protection systems and marine insurance systems are well established because damages caused by maritime accidents such as ship fires can exceed the freight earned and it is difficult to prove the cause of the accident. Ship fires are one of typical maritime accidents which special protection systems under the Maritime Law to protect relevant parties and legal issues related to marine insurance may arise. Therefore, General Average, limitation of liability, maritime lien, and provisional attachment, or requirements and effects under the marine insurance system were also reviewed in this paper. In this dissertation, all legal issues that may arise in relation to ship fires were derived, and the legal relationship related to ship fires centering on Korean commercial code is examined. Also it present how individual regulations are to be interpreted based on how they each regulation is related. After the reviews on the above, several improvement measures were proposed. First, a prerequisite related to fire immunity of the carrier and a gradual abolition plan were proposed. Among the responsibilities of sea carriers, the most distinctive one is the fire immunity of the carrier, which is not recognized for the carriage by land or air. The fire immunity of the carrier is widely recognized today, which started from disclaimers in bills of lading regarding the responsibility of Leceptung under ancient Roman law or the responsibility of public carriers under British common law. However, Hamburg rule and German law have actually abolished fire immunity, and voices of abolition have recently been rising due to technological advancement. However, it is considered unreasonable to radically remove fire immunity as it will result in transfering the serious risk of fire on a ship to a carrier (or carrier's insurer), and to have the carrier bear all damages incurred in the sea transport process. As maritime accidents during carriage of cargo in these days are actually handled by cargo insurance, owner’s protection and indemnity insurance, and Korea Shipping Association, discussions on insurance terms and conditions and rates should precede prior to the abolition of the fire exemption of the carrier In addition, even if the fire immunity of the carrier is abolished, it is reasonable to gradually abolish it. It would be appropriate to gradually reduce the range of application, such as to fire caused by external source at berth -> fire onboard while at berth -> fire during the voyage. Second, an improvement plan related to crews’ duty for firefighting was proposed. There are no international convention or Korean domestic laws regarding crews’ duty to extinguish a fire, and based on this, criminal investigation has been carried out by Marine Police and punitive decision have been made by Marine Safety Tribunal. Since the Severe Disaster Punishment Act will take effect on January 27, 2022, this will become more serious problems. Therefore, I think it is necessary to clarify specific standards for crews’ firefighting obligations in addition to the current mandatory regulations on fire extinguishing drill on board under international convention or domestic law. I don't think it is reasonable to punish crews on their obligation to extinguish a fire without explicit punishment provisions under the principle of criminal law. I hope that subject review and interpretation of the legal relationship related to ship fires will help in handling accidents, assist research related to ship fires, result in development of technology and countermeasures to prevent ship fires and lead to legislation and interpretation of law reflecting the positions of relevant parties. 2016년부터 2020년까지 5년간 우리나라에서 발생한 전체 해양사고 13,687건 중 선박화재 또는 폭발로 인한 사고는 약 4.3%에 해당하는 588건에 불과하지만, 최근 국내·외에서 대형 선박화재 사고가 꾸준히 증가하고 있다. 대표적인 한국에서의 선박화재 사고는 2018년 자동차 운반선 오토배너호 인천항 화재사고, 2019년 자동차 운반선 플레티넘레이호 울산항 화재사고, 2019년 화학제품운반선 스톨트 그로이란드호 울산항 화재/폭발사고, 2020년 광케이블 부설선 리스폰더호 화재/침몰사고 등이 있다. 선박에서의 화재는 한번의 사고로 선박과 선박에 적재된 화물 전부에 대해 거액의 손해를 발생시키며, 소화작업이 외부의 도움 없이 선원들에게 의존해야되며, 과실의 입증이 매우 어렵다는 특징을 가지고 있다. 특히, 최근 선박의 대형화 추세에 따라서 실제 화재사고 발생 시 인명과 재산에 대한 피해도 점점 더 커지고 있다. 실제 위와 같은 선박화재사고가 발생하는 경우 매우 다양한 법률문제를 발생시키고, 이와 관련된 이해당사자의 법률관계 또한 복잡하다. 하지만 기존의 선박화재에 대한 논문이나 연구는 운송인의 화재면책의 범위, 요건 등에만 한정하여 일부 판례를 분석하거나 선박화재의 일부 쟁점만 좁게 연구를 한 경우가 많았다. 이에 본 논문에서는 기존 선행연구에서 한발 더 나아가 선박화재로 발생할 수 있는 상법, 민법상의 법적 쟁점과 해양안전심판, 소방비용 및 오염방제비용이나 이로 인한 행정소송까지 가능한 범위에서 선박화재로 인한 모든 쟁점을 일괄하여 다루고 이에 대하여 구체적인 검토를 통하여 선박화재 관련 실무상의 업무처리에 도움이 되는 교보재로서의 역할을 하고자 하였다. 이를 위해 먼저 다양한 선박의 종류와 화물의 종류에 따라 천양지차로 달라지는 선박화재의 특성에 대하여 분석하였고, 이를 구체적인 사고사례를 통해서 실무적인 현황을 먼저 살펴보았다. 특히, 최근 자동차운반선에서의 화재는 자동차라는 화물의 특성에서 기인해 발생하는 문제와 자동차운반선의 구조의 특성에 기인해 발생하는 문제가 복합적으로 발생하기 때문에 매우 주의 깊게 살펴보아야 한다는 점을 지적하였다. 선박화재와 관련된 계약상 법률문제들을 살펴보기 위해서는 다양한 형태의 해상운송과 관련된 복잡한 계약관계를 살펴보아야 한다. 과거에는 선박소유자가 직접 운송인이 되어 송하인(화주)으로부터 위탁받은 화물을 수하인에게 인도하는 것이 일반적이었기 때문에 계약당사자들 간의 법률문제가 단순하였다. 하지만 최근에는 선박소유자로부터 선체용선해서 선박을 운항하는 경우, 선박소유자 또는 선체용선자로부터 선박을 정기용선 또는 항해용선하여 선박을 운항하는 경우, 선박을 직접 운항하지 않고 운송인이 되는 무선박운송인(NVOCC) 등 다양한 형태의 해상운송이 이뤄지고 있다. 여러 가지 다양한 법률관계에도 불구하고, 선박화재에 대한 책임을 누가 지는지는 선박을 누가 운항·관리하는지가 가장 중요하다. 주로 선박소유자 또는 선체용선자가 선박에 대한 관리를 하기 때문에 책임지는 경우가 많을 것이고, 정기용선자도 NYPE 1946 제8조 등 선장지휘권 등 선박의 운항에 직접 관여하는 경우 책임지는 경우도 있을 것이다. 또한, 항만물류업자, 복합운송업자, 조선소, 선원, 저당권자 등도 계약당사자로서 해상운송에 밀접하게 관련되어 있기 때문에 선박화재의 발생 양태에 따라서 관련 이해당사자들의 범위가 확장될 수 있다. 한편, 선박화재는 계약상 책임 외에도 여러 가지 대외적인 책임의 문제들을 발생시킨다. 또한, 심지어 과실이 있는 자에 대한 형사처벌, 행정법적 제재를 발생시키기도 한다. 해상운송 중 발생하는 선박화재 등 해상사고는 운임에 비해 피해 규모가 크고, 사고원인에 대한 입증이 어렵기 때문에 여러 가지 보호제도와 해상보험제도가 잘 마련되어 있다. 선박화재도 전형적인 해상사고로서 다양한 이해관계자들을 보호하기 위한 해상법의 특수한 보호제도 및 해상보험과 관련된 법률문제들이 발생할 수 있다. 따라서 이 논문에서는 선박화재가 발생하는 경우 공동해손, 책임제한, 선박우선특권 및 가압류 또는 해상보험제도와 관련되어 발생하는 적용요건, 효과 등에 대해서도 검토하였다. 이렇듯 이 논문에서는 선박화재와 관련되어 발생될 수 있는 모든 법률쟁점들을 도출하였고, 선박화재 관련 법률관계가 어떠한 법률체계 하에서 규정하고 있는지를 한국 상법을 중심으로 살펴보고, 개별 규정들을 어떻게 해석하는지, 그리고 각 규정들과의 관계는 어떠한지 종합적으로 고찰하여 선박화재에 관한 법률관계를 총망라하고, 그에 대한 올바른 해석론을 제시하였다. 이러한 검토를 거쳐 몇 가지 개선방안을 제안하였다. 먼저, 화재면책제도와 관련된 선결과제와 점진적인 폐지방안에 대해 제안하였다. 해상운송인의 책임 중에서 가장 특징적인 것은 화재면책제도를 두고 있는 것인데, 육상, 항공운송인에게는 인정되지 않는 것이다. 화재면책제도는 절대적인 책임을 부담하던 고대 로마법상 수탁책임 또는 영국 보통법상 공중운송인의 책임 등에 대응해 선하증권에 면책약관을 넣는 것에서 시작되어 오늘날 널리 인정되고 있다. 하지만 함부르크규칙 및 독일법에서는 화재면책을 실제로 폐지한 바 있고, 최근 기술 발전 등을 이유로 폐지의 목소리도 높아지고 있다. 하지만 화재면책을 급진적으로 갑자기 폐지하는 것은 선박에서의 화재라는 중대한 위험을 해상운송인(혹은 운송인의 보험자)에게 전가하는 것이고, 해상운송과정에서 발생하는 모든 손해를 해상운송인에게 부담하도록 하는 것으로 불합리하다고 생각된다. 따라서 화재면책제도의 폐지에 앞서 현대에서의 화물에 관한 해상사고는 실제적으로 적하보험과 선주상호보험, 한국해운조합공제 등의 보험으로 처리되므로 보험법에서의 논의 및 보험약관이나 요율의 변경이나 수정에 대한 논의가 선행되어야 할 것이다. 또한, 화재면책을 폐지하더라도 점진적으로 폐지하는 것이 타당한데, 예컨대 외부에서 발생한 정박 중 화재 –> 선박 내부에서 발생한 정박 중 화재 –> 항해중 화재 등으로 장소적 범위를 단계적으로 축소해나가는 방향이 타당할 것이다. 두번째로는, 선원의 소화의무와 관련된 개선방안을 제안하였다. 선원의 소화의무에 관해서 국제협약 또는 국내법령이 없는데, 이를 근거로 선원에 대한 수사 또는 해양안전심판원의 징계가 진행되는 경우가 있다. 2022년 1월 27일부터는 중대재해처벌법이 시행되기 때문에 이러한 문제는 더욱 심각해질 것이다. 따라서 현재의 선원의 선상에서의 소화훈련에 관한 의무 규정에 더하여 소화의무에 대한 구체적인 기준에 대하여 국제협약 또는 국내법에서 명확히 할 필요가 있다고 생각한다. 또한, 그 이전에는 죄형법정주의 원칙상 명시적 처벌규정 없이 소화의무를 근거로 선원을 처벌 또는 징계하는 것은 타당하지 않다고 생각한다. 이 논문에서 언급한 선박화재 관련 법률관계에 대한 검토 및 해석이 선박화재 관련 사고처리 실무 및 연구에 도움이 되길 바라며, 실무적으로는 선박화재를 예방할 수 있는 기술 및 대응방안이 적절히 마련되고, 법률적으로는 선박화재 관련 이해당사자들의 입장이 고루 반영되는 입법 및 해석이 이어지길 기대한다.

    • 컨테이너 장기체화의 법적 문제에 관한 연구 : 체화료 및 반납지체료를 중심으로

      컨테이너는 오늘날 국제 해상운송의 근간을 이루는 운송용구로서, 규격화된 적재단위를 통하여 화물의 운송·하역·보관을 일관되게 연결함으로써 물류의 효율을 획기적으로 제고하였다. 그런데 컨테이너는 운송인이 운송의 편의를 위하여 제공하는 설비인 동시에 화주가 운송물을 적입하여 반출·사용한 후 다시 반납하여야 하는 대상이 되기도 하므로, 그 사용기간이 약정된 무료사용기간(free time)을 초과하는 경우에는 그 초과사용을 이유로 부과되는 체화료(demurrage)와 반납지체료(detention)의 부담을 둘러싸고 운송인과 화주 사이에 분쟁이 빈번하게 발생한다. 특히 코로나19 이후의 물류대란을 계기로 그 규모가 급증하면서 관련 법적 쟁점이 국내외에서 첨예하게 다투어지고 있음에도, 지금까지의 국내 논의는 대체로 개별 판례에 대한 평석이나 단편적 쟁점의 소개에 그치고 있다. 이에 본 논문은 컨테이너 체화료 및 반납지체료의 법률관계를 해석론·비교법·입법론의 차원에서 체계적으로 규명하는 것을 목적으로 한다. 먼저 논의의 전제로서 컨테이너의 법적 지위와 컨테이너 운송의 법적 체계를 검토하였다. 컨테이너는 운송인이 제공하는 경우에는 운송물의 적부를 위한 적하설비 내지 선박의 일부로서의 성격을 가지는 반면, 송하인이 제공하는 경우에는 그 자체가 운송물의 일부를 구성한다. 이러한 이원적 지위를 전제로, 컨테이너 초과사용의 대가는 그 발생 단계에 따라 명확히 구별되어야 한다. 즉 컨테이너가 터미널 등 운송인의 지배영역에서 반출되기 전 단계에서 발생하는 비용은 체화료에 해당하고, 반출된 이후 화주가 이를 점유·사용하는 단계에서 발생하는 비용은 반납지체료에 해당한다. 양자는 발생하는 단계와 그 대상이 되는 이익이 서로 다르므로 이를 일원적으로 파악할 것이 아니라 단계적으로 구별하여 접근하여야 하며, 이러한 구별이 이후 모든 논의의 전제가 된다. 이러한 전제 위에서 개별 쟁점을 현행법의 해석론적 관점에서 검토하되, 두 비용의 발생근거는 그 발생 단계의 구별에 상응하여 나누어 규명하였다. 먼저 체화료의 발생근거와 관련하여, 체화료가 발생하는 상황은 수하인의 수령지체, 곧 채권자지체에 대응하나, 통설과 판례가 취하는 법정책임설에 의하면 채권자지체의 성립만으로는 수령을 지체한 채권자인 수하인에게 손해배상으로서의 체화료를 청구할 권원이 도출되지 않는다. 이에 본 논문은 상법 제140조(제815조)에 따라 운송물에 관한 권리를 취득한 수하인이 그 인도를 청구하는 등 권리를 행사함으로써 구체화되는 운송물 수령의무(상법 제802조)의 위반, 곧 채무불이행에서 체화료의 청구근거를 찾았다. 수령의무의 존부와 관련하여서는 이를 수하인 일반에 대하여 넓게 인정할 경우 부당한 결과를 초래할 수 있으므로, 인도의 청구를 비롯한 권리의 행사 또는 수령의 의사표시가 인정되는 경우에 한하여 수령의무를 긍정하는 이른바 제한적 긍정설의 입장을 취하였고, 그 귀결로서 책임의 주체 또한 권리를 행사하여 객관적으로 운송물의 수령지위에 놓인 자에 한정되므로 담보 목적으로 선하증권을 소지하는 데 그치는 은행 등은 이에서 배제된다. 이때 운송계약의 당사자인 송하인의 책임은 그대로 존속하여 수하인의 책임과 부진정연대의 관계에 서므로, 수하인이 권리를 행사하지 않는 때에는 그 책임이 계약의 당사자인 송하인에게 귀속된다. 다음으로 반납지체료의 발생근거가 되는 컨테이너 반납의무는 선하증권 이면약관 등 약정에 기초하는데, 약관은 이에 동의한 당사자 사이에서만 효력을 가지므로 약관에 동의하지 않은 자에 대한 반납의무의 발생근거가 법률에 마련되어 있지 않다는 규율의 공백을 확인하였다. 한편 두 비용에 공통되는 법적 성질에 관하여는 이를 임대차의 차임이나 법정 특별보수가 아니라 채무불이행에 기한 손해배상액의 예정으로 파악함이 타당하다고 보았고, 그에 따라 예정액이 부당히 과다한 경우에는 민법 제398조 제2항에 의한 감액이 가능하며, 채권자인 운송인에게는 손해경감의무가 인정되고, 컨테이너의 반납이 사실상 불가능하게 된 이후의 반납지체료 누적은 컨테이너의 대체가액을 상한으로 제한된다는 해석론을 제시하였다. 또한 두 비용의 채권에는 상법 제814조 제1항이 정한 1년의 제척기간이 적용되되, 계속적으로 발생하는 채권의 특성을 고려하여 일자별로 발생하는 각 채권의 발생일을 그 기산일로 파악하는 판례의 법리가 타당함을 논증하였다. 나아가 이러한 쟁점이 국제적으로 공통되는 문제임을 확인하고 우리 법이 취할 방향을 모색하기 위하여 주요국의 입법례와 판례를 비교법적으로 검토하였다. 영국은 체화료 및 반납지체료를 약정손해배상(liquidated damages)으로 파악하면서 위약벌 법리의 재구성과 상업적 목적달성불능의 법리라는 판례 법리로 그 무한정한 누적을 통제하는 유형에, 미국은 연방해사위원회(FMC)의 인센티브 원칙과 2022년 해운개혁법(OSRA 2022)의 증명책임 전환 및 청구서 투명성 요건이라는 행정규제로 그 부과를 통제하는 유형에, 중국은 위약금 구성과 실제 손해의 130%·대체가액 1배라는 정량적 기준 및 2025년 개정 해상법을 결합한 유형에, 독일은 수령인의 권리와 그 행사에 연동된 의무를 운송법으로 정밀하게 규율하는 유형에 각각 해당한다. 여기에 로테르담 규칙 제43조와 일본 상법 등 그 밖의 외국법과 국제규범을 아울러 검토한 결과, 각국은 규율의 방식을 달리하면서도 과도한 부담의 통제와 책임주체의 합리적 한정이라는 공통된 방향을 보이고 있음을 확인하였고, 우리 법은 어느 단일 입법례를 그대로 도입할 것이 아니라 각 유형의 장점을 선별적으로 수용하는 규율방식을 채택함이 타당하다는 결론에 이르렀다. 마지막으로 이상의 해석론과 비교법적 검토를 토대로 개선방안을 해석론·약관·입법론, 세 영역으로 나누어 제시하였다. 해석론에서는 손해배상액의 예정이라는 성질결정을 출발점으로 민법 제398조 제2항의 감액과 손해경감의무를 작동시키되, 미국의 인센티브 원칙과 중국의 정량적 기준을 그 감액 판단의 실질적 척도로 활용할 것을 제안하였다. 약관의 차원에서는 약관규제법상 편입통제와 내용통제를 구분하여 요율·산정방식·무료사용기간의 투명성을 확보하고, 청구서 기재사항을 표준약관의 형식으로 표준화할 것을 제안하였다. 입법론에서는 수하인이 권리를 행사한 것을 전제로 의무와 책임을 인정하는 규율방식에 따라 상법 제802조의 개정을 제안하였다. 곧 화물의 도착 사실을 알지 못한 채 비용이 누적되는 실무를 바로잡도록 운송인의 도착통지의무를 명문화하고, 수령의무의 기준은 해석상 다툼의 여지가 없도록 '운송물의 인도를 청구한 자'로 명확히 정하며, 그 위반에 따른 체화료 청구의 근거를 마련하는 것이다. 다만 운임 등의 지급의무를 정하는 제807조 제1항은 그것이 지급의무를 현실의 수령에 연동시켜 육상운송편 제141조와 문언을 같이하고 그 해석이 판례로 확립되어 있으므로, 입법을 불가결한 사항에 한정하는 취지에서 개정 대상에서 제외하였다. 나아가 반납지체료에 관하여는 그 요율과 산정을 약관과 민법 제398조 제2항의 통제에 맡기는 것이 비교법적으로도 타당하지만, 약관은 이에 동의한 당사자 사이에서만 효력을 가지고 소유물반환의 일반 법리는 반납의 시기·장소와 지체의 기준을 정하여 주지 못하므로, 반납의무 그 자체의 발생근거는 법률에 두어야 한다고 보았다. 이에 운송인이 운송을 위하여 제공한 컨테이너를 수령한 자는 당사자 사이의 합의에 의한 때와 곳에서, 합의가 없으면 운송인이 지정하는 상당한 때와 곳에서 지체 없이 이를 반납하여야 한다는 근거규정(가칭 제807조의2)을 개품운송편에 신설하여, 약관에 동의하지 않은 선하증권 제3취득자에 대하여도 반납의무의 법적 기초가 미치도록 할 것을 제안하였다. 이로써 체화료와 반납지체료 모두에 관하여 의무의 발생근거는 법률이 정하고 비용의 액수는 약관과 법원의 통제가 담당하도록 나누는 구분이 일관되게 관철된다. 본 논문이 제시한 해석론과 개선방안이 컨테이너 체화료 및 반납지체료를 둘러싼 실무의 혼란을 줄이고 운송인과 화주 사이의 이익을 합리적으로 조정하며, 향후 상법 해상편의 정비에 작은 보탬이 되기를 기대한다. The container is the transport unit that underpins international carriage of goods by sea today; by linking the carriage, handling, and storage of cargo through a standardized loading unit, it has dramatically enhanced the efficiency of logistics. Yet the container is at once a facility that the carrier provides for the convenience of carriage and an object that the cargo interest must return after stuffing the goods into it, taking it out of the terminal, and using it. Accordingly, where the period of its use exceeds the agreed free time, disputes frequently arise between carriers and cargo interests over the burden of demurrage and detention charges imposed for such excess use. In particular, as the scale of these charges surged in the wake of the post-COVID-19 logistics crisis, the related legal issues have been sharply contested both in Korea and abroad; nevertheless, domestic scholarship to date has largely been confined to case commentaries or fragmentary introductions of individual issues. Against this background, this thesis aims to systematically elucidate the legal relations surrounding container demurrage and detention at the levels of statutory interpretation, comparative law, and legislative reform. As a premise for the discussion, the thesis first examines the legal status of the container and the legal framework of container transport. Where the container is supplied by the carrier, it bears the character of loading equipment for the stowage of the goods or of a part of the vessel, whereas where it is supplied by the shipper, it constitutes part of the goods themselves. On the premise of this dual status, the consideration for excess use of a container must be clearly distinguished according to the stage at which it arises: costs arising before the container leaves the carrier's sphere of control, such as the terminal, constitute demurrage, while costs arising after it has been taken out, during the stage in which the cargo interest possesses and uses it, constitute detention. Since the two charges arise at different stages and relate to different interests, they must be approached not as a single, undifferentiated concept but in a staged and differentiated manner; this distinction serves as the premise for all subsequent analysis. On this premise, the thesis examines the individual issues from the interpretive standpoint of the current law, identifying the legal basis of each charge separately in accordance with the distinction between the stages at which they arise. First, as to the basis of demurrage: the situation in which demurrage accrues corresponds to the consignee's delay in taking delivery, that is, creditor's delay (mora creditoris); however, under the statutory-liability theory adopted by the prevailing view and the case law, the mere establishment of creditor's delay does not confer on the carrier a right to claim demurrage as damages against the consignee who has delayed acceptance. This thesis therefore locates the basis of the demurrage claim in the breach of the consignee's duty to take delivery of the goods (Article 802 of the Commercial Act) — a duty that becomes concrete when the consignee, having acquired rights over the goods under Article 140 (Article 815) of the Commercial Act, exercises those rights, for instance by demanding delivery — in other words, in non-performance of an obligation. As to the existence of the duty to take delivery, recognizing it broadly against consignees in general could lead to unjust results; the thesis therefore adopts the so-called limited-affirmative view, which affirms the duty only where an exercise of rights, including a demand for delivery, or a declaration of intent to take delivery is established. As a corollary, the persons liable are confined to those who, by exercising their rights, have objectively come to stand in the position of receiving the goods, so that a bank that merely holds the bill of lading for security purposes is excluded. The liability of the shipper, as a party to the contract of carriage, subsists alongside and stands in a relationship of quasi-joint and several (untrue joint) liability with that of the consignee, so that where the consignee does not exercise its rights, liability rests with the shipper as the contracting party. Next, as to the basis of detention: the duty to return the container rests on agreement, such as the clauses on the reverse of the bill of lading; but since standard terms bind only the parties who have assented to them, the thesis identifies a regulatory gap in that no statutory basis exists for a return duty owed by persons who have not assented to such terms. As to the legal nature common to both charges, the thesis concludes that they are properly characterized not as rent under a lease or as statutory special remuneration, but as liquidated damages for non-performance. It follows that where the stipulated amount is unduly excessive, it may be reduced under Article 398(2) of the Civil Code; that the carrier, as creditor, owes a duty to mitigate its loss; and that the accrual of detention after the return of the container has become practically impossible is capped at the container's replacement value. Furthermore, both claims are subject to the one-year exclusion period under Article 814(1) of the Commercial Act, and the thesis demonstrates, in view of the continuously accruing character of these claims, the soundness of the case-law rule that the period runs from the date on which each daily claim arises. To confirm that these issues are common internationally and to seek the direction Korean law should take, the thesis then undertakes a comparative review of the legislation and case law of major jurisdictions. England represents the model that characterizes demurrage and detention as liquidated damages and controls their unlimited accrual through case-law doctrines — the reformulated penalty rule and the doctrine of frustration of the commercial purpose. The United States represents the model of administrative regulation, controlling the imposition of such charges through the Federal Maritime Commission's incentive principle and the burden-shifting and invoice-transparency requirements of the Ocean Shipping Reform Act of 2022 (OSRA 2022). China represents a model combining a liquidated-damages construction with quantitative benchmarks — 130% of actual loss and one times the replacement value — together with the 2025 revised Maritime Law. Germany represents the model that precisely regulates, through its transport law, the consignee's rights and the duties linked to their exercise. Considering, in addition, Article 43 of the Rotterdam Rules, the Japanese Commercial Code, and other foreign laws and international instruments, the review confirms that, despite their differing regulatory techniques, these jurisdictions share a common direction: controlling excessive burdens and reasonably limiting the persons liable. The thesis concludes that Korean law should not transplant any single foreign model wholesale, but should adopt a regulatory approach that selectively incorporates the strengths of each. Finally, building on the foregoing interpretive and comparative analysis, the thesis presents proposals for improvement in three areas: interpretation, standard terms, and legislation. At the level of interpretation, taking the characterization as liquidated damages as its starting point, the thesis proposes activating the reduction under Article 398(2) of the Civil Code and the duty to mitigate, while employing the U.S. incentive principle and the Chinese quantitative benchmarks as substantive yardsticks for the reduction analysis. At the level of standard terms, it proposes distinguishing between incorporation control and content control under the Act on the Regulation of Terms and Conditions, securing transparency as to rates, calculation methods, and free time, and standardizing the particulars to be stated in invoices in the form of standard terms. At the level of legislation, it proposes amending Article 802 of the Commercial Act in line with the regulatory approach that recognizes duties and liability on the premise of the consignee's exercise of rights: codifying the carrier's duty to give notice of the cargo's arrival, so as to correct the practice whereby charges accumulate while the consignee remains unaware of the arrival; defining the standard for the duty to take delivery unambiguously as "the person who has demanded delivery of the goods," leaving no room for interpretive dispute; and providing a statutory basis for demurrage claims arising from its breach. Article 807(1), which governs the duty to pay freight and other charges, is excluded from the scope of amendment — in keeping with the principle of confining legislation to what is indispensable — because it ties the payment duty to actual receipt of the goods, shares its wording with Article 141 of the land-carriage provisions, and its interpretation is settled by case law. As for detention, while it is comparatively sound to leave its rates and calculation to standard terms and to the control of Article 398(2) of the Civil Code, standard terms bind only assenting parties, and the general law of vindication of ownership does not supply the time and place of return or the standard of delay; the basis of the return duty itself must therefore be laid down by statute. The thesis accordingly proposes inserting into the chapter on carriage of general cargo a new foundational provision (tentatively Article 807-2), under which a person who has received a container provided by the carrier for the carriage must return it without delay at the time and place agreed between the parties or, absent such agreement, at a reasonable time and place designated by the carrier — thereby extending the legal foundation of the return duty even to third-party acquirers of the bill of lading who have not assented to the standard terms. In this way, the division of labor — the statute grounding the existence of the duty, while standard terms and judicial control govern the amount of the charges — is carried through consistently for both demurrage and detention. It is hoped that the interpretations and proposals presented in this thesis will reduce the confusion in practice surrounding container demurrage and detention, reasonably adjust the interests of carriers and cargo interests, and make a modest contribution to the future revision of the maritime provisions of the Commercial Act.

      In August 2016, Korean press media released the news highlighting the discharge of hazardous chemicals from power plant into surfaces waters of the sea in Ulsan area. The power plant used antifoaming agent which contains hazardous substance(dimethylpolysiloxane) to reduce the formation of foam for cooling system. Ministry of Maritime Affaires and Fisheries in Korea announced that the plant violate the law(Marine Environment Management) because Dimethylpolysiloxane(PDMS) is a prohibited substance to discharge into the sea as a Noxious Liquid Substances by MARPOL 73/78. However, there is no standard to apply as a noxious liquid substance and no one knows the power plant is in the scope of Marine facilities of that law. ME(Ministry of Environment) and MOTIE(Ministry of Trade, Industry and Energy) argued it is uncertain how to discharge and there is no standards to apply. In this reason, MOTIE & KITECH started feasibility study research of the regulations. This follow up study investigated how treat and discharge wastewater containing hazardous chemicals from a facility, especially, power plants and companies in shore line. The primary objective is to find a reasonable method to make standards related in discharging industrial wastewater.

      최근 기후평가는 최선의 상황이 되더라도 금세기 말이면 해수면이 1m 이상 높아질 것으로 예측하고 있다. 주로 남태평양에 위치하는 다수 도서국가들은 해발이 2-3m에 불과, 완전히 잠기지 않더라도 부분적으로 즉각 잠길 치명적인 위험에 처하게 된다. 휘지, 키리바티, 투발루, 렉쉐드위프, 마샬군도, 몰디브제도, 모리셔스, 나우루, 쉐이셀은 머지 않아 바다 밑으로 침몰할 소도서국가들 가운데 일부에 불과하다. 과거 어떤 국가도 자연영토를 잃은 적이 없다고 하는 것은 한편으로 그러한 피해를 입는 국가들을 대한 국제법에 있어서의 맹점이라고 하겠다. 본 연구는 그와 같은 피해를 입는 국가들의 해양법에 관해 세가지 문제를 분석하였다. 첫째, 기후 변화와 해당국가가 속한 여러 해양지역 해수면상승의 효과. 둘째, 해당국가들의 급속히 축소되는 육지와 관련한 주변해양에 대한 관할권 행사여부 문제. 셋째, 해수면 상승이 해당국가를 포함 해양분쟁에 미치는 영향에 대한 문제이다. 끝으로 본 연구는 소멸국가들의 해양공간 보호, 결정을 위해 이용이 가능한 방법을 분석하려고 노력하였다. Modern day climate assessments, even the most moderate, forecast sea levels rising by more than one-meter by the end of this century. Many low-lying island states, mostly situated in the South Pacific Sea, lie at an average of two to three meters above sea level, putting these nations at an immediate and fatal risk of being partially if not completely submerged. Fiji, Kiribati, Tuvalu, Lakshadweep, the Marshall Islands, the Maldives, Mauritius, Nauru and Seychelles are only some of the small island countries that may very soon disappear under the sea. No country has ever lost its physical territory before, which may also explain the lacuna in international for the provision of such affected nations. This study engages in an examination of three distinct queries regarding the maritime jurisdictions of these affected nations. Firstly, the effect of climate change and rising sea levels on the different maritime zones of these nations. Secondly, the issue of whether these nations should remain entitled to their surrounding maritime jurisdictions in light of their quickly diminishing terra firma. Thirdly, the question of what effects rising sea levels may have on the maritime disputes involving affected nations. Finally, this study seeks to analyze the methods available to ‘sinking’ nations to assert and determine their maritime spaces.
