장기미제사건 수사의 개선방안에 관한 연구

국문 초록 (Abstract)

우리는 매일 뉴스 등 다양한 매체 및 SNS를 통하여 강력범죄 소식을 접하게 된다. 최근 강력범죄의 특징은 점점 광역화 되고 있으며, 첨단화 되고 있는 실정이다. 이에 경찰 등 여러 수사기관은 선진화된 수사시스템과 전문성을 갖추고 범죄해결에 총력을 기울이고 있다. 하지만 강력사건 중 10년 이상 된 장기미제사건의 경우 증거서류 및 증거물 보존에 있어 한계가 있으며, 과거 공소시효로 인하여 더 이상 수사를 할 수 없는 대표적 사건이 다시 최근 이슈화 되면서 2015년 일명 ‘태완이법’을 통하여 살인죄의 공소시효를 폐지하는 내용의 형사소송법이 개정되었다.
특히 경찰은 각 지방청에 장기미제사건을 담당할 부서를 만들고, 사건해결을 위하여 과학수사 기법을 적극 도입하여 미제사건 해결을 위한 지속적인 수사의지를 나타내고 있다. 이에 최근 제주 보육교사 살인사건 및 가평 육군 상사 살인 사건이 그 대표적 예라고 할 수 있을 것이며, 장기미제 사건에 대한 체계적 수사 및 공조를 통한 좋은 결과라고 볼 수 있다. 그러나 장기미제사건을 해결하기 위해서는 장기미제사건의 분명한 정의를 통하여 각 미제사건의 특징을 바탕으로 하는 분류기준이 먼저 마련되어야 하지만, 아직까지 각 지방청의 장기미제사건에 있어 분류기준은 명확하지 않아, 주로 사회적 이목을 끄는 사건에 한정되고 있다는 아쉬움이 있다. 뿐만 아니라 현 장기미제사건에 있어 수사절차는 전담팀 체계를 갖추고 있으나 비상설부서의 특징을 갖고 있어 사회적 여론에 흔들려 운영될 우려가 있어 안정적인 수사체계를 갖추기에 많은 어려움이 있다.
이미 잊혀져가고 있는 미해결된 강력사건들을 다시 떠올리고 수사하는 것이 피해자 및 피해자 가족들에게 쉽지 않은 일이다. 하지만 장기미제 사건이 해결되지 않는 다는 것은 사회적 의미를 따져보면 국민적 불안과 수사기관 및 형사사법기관에 대한 불신을 초래할 수 있다. 이에 장기미제사건의 수사에 있어 현 문제점은 다음과 같다.
우리나라 강력사건이 발생 한 경우 사건 초기는 집중적인 주목을 받아 경찰서에 대대적인 수사본부를 설치하고 수사를 진행하였으나 일정시간 지나면 국민적 관심이 떨어지고 사건의 집중력이 떨어져 수사를 계속 이어나가기에 어려움이 있었다. 또한 수사본부 중심의 수사를 통하여 다른 기관과의 공조수사가 미흡해지고 정보공유의 어려움으로 인한 수사 조직상의 문제점이 나타났다. 또한 장기미제사건에 대한 정확한 관련법규 체계가 미흡하고 모호한 장기미제사건의 분류기준과 절차 등의 법규상의 문제점이 나타나게 됐다. 뿐만 아니라 주고 이목이 집중된 사건에 수사인력을 집중 투입하면서 보여주기식 수사라는 비난 및 기존 사건 담당자의 인사이동 등으로 인한 미제사건의 형식적 관리와 한정된 수사자원으로 인한 전문성 미흡 등 시스템 상의 문제점이 있었다.
이에 미국, 영국, 일본 등 주요 국가에서는 장기미제사건에 대한 전문담당 수사관 도입 및 사건의 경중을 객관적 기준을 통하여 구분한 장기미제사건 프로젝트 등의 운영을 통해 장기미제사건을 해결하고 있다는 것 좋은 예를 통해 우리나라에 맞는 장기미제사건 수사의 시스템을 구축할 필요가 있을 것이다.
결국 장기미제사건 수사의 개선방안으로는 상설기구로의 전담수사팀을 설치하여 전담수사관의 자격요건을 구축하고 현재 경찰청에서 운영하고 있는 전문수사관 인증 제도를 통하여 전문화되고 안정화된 전담수사팀을 운영할 필요가 있다. 또한 장기미제사건 수사 및 관리를 위한 관련법령 마련 및 장기미제심사관 제도 및 선정위원회를 구성하고 미제사건 관리를 위한 데이터베이스를 구축하는 등의 제도적 개선이 마련될 필요가 있다. 이를 위해서 광역수사체제의 구축을 통한 수사전문성 확보 및 수사기록 및 증거물 등의 장기보관 방법에 대한 시스템을 마련·활용하고 DNA 등록대상을 확대하고 관리를 일원화하여 과거에 과학기술 미비로 인하여 미해결된 사건들을 현재 발달된 과학수사 기법을 이용하여 해결할 수 있도록 제도적 마련을 할 필요가 있다. 마지막으로 공조수사 확대 및 범죄분석 시스템을 효율적으로 운용하여 장기미제사건에 있어 다 같이 협력하는 자세로 사건을 해결할 의지를 마련할 필요가 있을 것이다.
이에 본 논문을 통해 우리사회에서 발생하는 모든 장기미제 사건을 다 해결하자는 취지보다는 중요 강력범죄 사건을 대상을 객관적으로 선정하여 사건이 해결될 때까지 사건초기와 같은 고도의 수사력을 집중할 수 있도록 효율적인 수사방안 체제를 정비 및 수사방안 수립하는데 그 목적을 두고 있다.

다국어 초록 (Multilingual Abstract)

Every day we obtain news about violent crimes through diverse media such as news and social network services. The characteristics of recent violent crimes are that they occurring in a wider area using all the more cutting-edge methods. Accordingly, different investigative agencies are making all their efforts to solve crimes using an advanced investigative system and expertise. Nonetheless, in the case of cold cases over 10 years old among violent crimes, preservation of supporting documents and evidence has limitation. As a representative case that cannot be investigated any longer due to its past statute of limitations has recently become an issue again, revision of the Criminal Procedure Law was made involving repealing the statute of limitations of murders through the so-called "The Taewan Law".
In particular, the police has established a department in charge of cold cases at each provincial police agency, actively introduced scientific techniques in order to solve such cases, and is showing an active will of investigation aimed at solving cold cases. A recent case of a nursing teacher murder in Jeju-do and a case of a master sergeant murder in Gapyeong are such representative cases and may be said to have produced good outcomes through systematic and collaborative investigation on cold cases. Nonetheless, in order to resolve cold cases, they should be clearly defined and classification standards based on the characteristics of each cold case should be devised first. It is regrettable that thus far, such classification standards for cold cases by each provincial police agency have not been clear and were mainly restricted to cases that drew social attention. Besides, the investigative procedure for current cold cases is equipped with a dedicated team system but is in the form of a non-permanent department. Therefore, it may be swayed by the social public opinion and has much difficulty with having a stable investigative system.
To recollect and investigate unresolved violent cases that have been already forgotten is not easy to the victims and their family. However, the social meaning of cold cases remaining unsolved is that it may trigger distrust toward public unrest and mistrust toward investigative agencies and criminal justice agencies. The current issues in the investigation on cold cases are as follows:
When a violent case occurs, during an early period of its occurrence, it draws intensive attention and the police establishes massive headquarters at police stations and proceeds with investigations, but after a certain time passes, public attention wanes with decreased concentration on the investigation, which makes it difficult to continue the investigation. In addition, a headquarter-centered investigation leads to insufficient collaborative investigation with other agencies and difficulty with information sharing, triggering a problem with the investigative organization. Further, the relevant law and regulation system for cold cases is insufficient and imprecise and legal problems involving their classification standards and procedures appear. Besides, as the investigation personnel is intensively input into cases that draw attention, problems are triggered such as criticism that the investigation is just for showing off, managing of unsolved cases as a mere formality due to transfer for job by the person in charge of the existing case, and insufficient expertise caused by restricted investigation resources.
Major countries such as the United States, Britain, and Japan are solving cold cases by introducing specialized investigators in charge of cold cases and by operating cold case projects that differentiate the degree of their importance. We also need to establish a cold case investigation system suitable for our country.
In the end, for better investigation on cold cases, a dedicated investigation team as a permanent organization needs to be established to provide an environment where dedicated investigators can be equipped with their qualifications and a specialized and stable dedicated investigation team needs to be operated through the professional investigator certification system. In addition, institutional improvement should be made, for example, by devising relevant laws for investigation on and management of cold cases, forming a cold case reviewer system and a committee for selection of those reviewers, and establishing database for the management of cold cases. To this end, a system for obtaining investigation expertise through a wide-area investigation system and for long-term storage of investigation records and evidence should be established and utilized. The subjects of DNA registration should be expanded and their management should be unified, thereby creating an institution with which to resolve unresolved cases with currently developed scientific investigation techniques. Lastly, collaborative investigation should be expanded and the crime analysis system needs to be efficiently operated with a will to solve cold cases through collaborative attitudes by all.
Accordingly, this paper aims to establish and organize an efficient investigation system so that the same high-level of investigative power can be exerted as during an early period of an investigation until resolution of the cases after objective selection of major violent crimes.
