As ICT has dramatically developed, personal information implies its new meanings in both positive and negative perspectives at the same time. In addition, the importance of personal information and its protection have been increasingly critical.
According to these changes, the Republic of Korea enacted and enforced the Personal Information Protection Law as a basic law for protecting personal information. This act has settled as an integrated one to solve the previous order to protect personal information in certain limited areas.
In the Civil Law of the Republic of Korea which was revised in March 7th, 2011 and enforced since July 1st, 2013, system on person with limited legal ability is supporting property management and protecting personal affairs of minors, adults with intellectual or mental disability, or the elderly with dementia due to diseases, disabilities, or aging. This supplements problems of the previous system of person with no legal ability and respects rights of self decision-making for person with limited legal ability. Therefore, it can be evaluated positively for its advancement.
However, in spite of positive evaluation on the current Personal Information Protection Law and the Civil Law, there is no consideration for possibilities of personal information protection for person with limited legal ability or its intervention by person with parental rights or guardian. There is no studies about it, as well.
Therefore, this article reviews general information about the system of person with limited legal ability and the Personal Information Protection Law and focuses on possibilities of procuration of person with parental rights and guardian for agreement on personal information of person with limited legal ability, and deals with the related issues, problems, and solutions.
For this, comprehensive legal principles in Civil Law on personal information should be premised. That is, by analogy of the provisions of the current Civil Law on determining personal affairs, personal information should be included in the scope of personal protection, and if a person with limited legal ability lack his or her ability for decision-making as an information subject, person with parental rights or guardian should subrogate for their right of agreement. Personal information should be dealt with in personal area as well as laws about properties, contracts, and torts. The reason is that personal information is personally exclusive as personal information but now it has the actual proprietary values and new forms of contracts appear in the reality.
Based on these basic studies, individual kind of person with limited legal ability is classified with suggestion for problems and discussions on interpreting and legislating solutions.
First, in case of conflicts between the right of self-determining on personal information of person with limited legal ability(information subject) and authority of person with parental rights or guardian, the solution for it should be made with determination of priority. That is, whether to respect the remaining ability of person with limited legal ability and to consider his or her ability of self decision-making or to consider authority of person with parental rights or guardian as protector is not easy one. Therefore, proper solutions for it are discussed with interpretations by reviewing whether person with parental rights or guardian as protector subrogate his or her right of agreement on personal information.
Second, in the Personal Information Protection Law, a person who treats personal information can treat an information subject's(including person with limited legal ability) personal information without advanced consent. However, person with parental rights or guardian of person with limited legal ability has no such authority. This provision limits authority of person with parental rights or guardian as his or her protector and makes considerable unbalance. So solutions for this unbalance are approached with interpretations.
Third, in the current Personal Information Protection Law, there is no consideration for person with limited legal ability. Therefore, legislative solution for it should be made, and this study suggests a new provision to guarantee parental right. In addition, by making a suggestion of a new provision about 'Usage of Personal Information for protecting children under age less than 14-years-old and enabling to protect minors under age less than 14, and adults who need whole or partial guardianship, the study tries to solve legal unbalance due to lack of legal provisions. However, in case of adult who needs partial guardianship, if he or she are treated like adult who needs whole guardianship, it may limit his or her right too excessively and may ignore the intention of the current law. So the it is supplemented with conditions.
Finally, for others, adult who needs specific or optional guardianship, and advanced notice and consent are reviewed with interpreting approaches for areas to be studied. In case of adult who needs specific guardianship, in spite of no provision about determining personal affairs, whether to protect personal information in it should be issued. In case of adult who optional guardianship, whether to conduct the right of self-determining on personal information may be assigned by a contract and if it is applicable to the principle of freedom of contracts should be addressed. So the study attempts to intrepret whether to solve those issues.
It is not easy to solve the problems of personal information protection for person with limited legal ability in the current legal principles, and there are limitations in regulating personal information in private sector only. Accordingly, it is necessary to change the paradigm for special personal rights such as personal information in the Civil Law as well as the current the Personal Information Protection Law. That is, by recognizing personal information as a sort of proprietary right, it is required to minimize blanks in protection of personal information. Then, it is also necessary to prepare the criteria to evaluate accurately the ability of decision making of person with limited legal ability in order to guarantee harmoniously the right of self-determining on personal information of person with limited legal ability as an information subject and authority of person with parental rights or guardian as much as possible. Furthermore, as personal information has increased and combination between information has become to be easy, currently unidentifiable personal information may have identifiability. Therefore, for unidentifiable personal information of person with limited legal ability, authority of person with parental rights or guardian should be recognized.
