중요무형문화재 보호제도의 문제점과 개선방안 : 무용부문을 중심으로 = The problems of Important Intangible Cultural Property Protection System and Improvement Plans : Focusing on Dancing

국문 초록 (Abstract)

문화는 시대의 변화에 따라 가장 많은 영향을 받는 사회의 생활양식이며 행동양식이고, 그 시대와 민족의 정체성을 가장 많이 내포하고 또 표상할 수 있는 중요한 요소이다. 그중에서 한 나라의 전통문화는 오랜 역사속에서 그 민족이 공감대를 형성하고 민족의 정서와 삶이 고스란히 깃들어 있는 매우 가치성이 높은 문화라 할 수 있다.
그러나 우리나라의 전통문화 중 무형문화재는 형체가 있어 보존이 가능한 유형문화재와 달리 형체가 없어 영속성을 지니지 않고 항상 가변적인 요소를 지니고 있으며, 문서화 되어 있는 않은 경우가 대부분이기 때문에 근대를 거쳐 현재에 이르기까지 본연의 기능을 잃었거나 변화되거나 소멸위기에 있는 등 복합적인 문제를 내포하고 있다. 따라서 이를 보호하지 않으면 영원히 사라지거나 변질되어서 커다란 문화적 손실과 더불어 우리 민족 고유의 정서와 역사, 삶의 손실을 가져올 수 있다. 이러한 문제점을 인식하고 실감한 정부에서는 1962년 문화재보호법을 제정하여 법적으로 중요무형문화재를 지정하고 보호·지원하고 있으나, 제도적 정책적 장치에서 여러 가지 실절적인 문제점이 드러나고 있다. 그러므로 이러한 문제점을 개선하고 효율적인 보존 전승방안을 위해서는 현재 우리나라에서 시행되고 있는 중요무형문화재 보호제도의 현황과 문제점에 대해서 끊임없이 연구하고 분석하는 것이 필요하다.
본 연구에서는 중요무형문화재 보호제도의 문제점에 대해서 알아보고, 외국의 무형문화재 보호제도 사례를 살펴보고, 현재 우리나라의 중요무형문화재 보호제도의 연차보고서와 앞서 이루어진 연구 및 문헌자료를 통해 실태를 분석하여 중요무형문화재 보호제도의 현황 및 문제점을 파악하고 개선방안을 제시하고자 한다.
우리나라의 중요무형문화재 보호제도의 문제점으로는 크게 중요무형문화재 종목 지정의 문제, 보유자인정 및 전승자 선정의 문제, 전수교육의 문제, 전승지원금 지급의 문제가 있다.
이와 같은 문제점을 개선하기 위해서 첫째, 종목 지정 기준을 명확하고 구체적으로 제시하고, 무용분야 위원과 전문위원의 인원을 확충해야한다. 둘째, 보유자 인정과 관련된 단어의 의미와 기준을 명확히 하고, 이수자 평가 · 심사 시 국가의 개입을 통해 객관성과 투명성을 높여야 한다. 셋째, 이수자 평가 · 심사의 객관적이고 체계적 · 구체적인 평가지표, 세부지표와 같은 심사 기준을 명확히 정립하고, 이수자의 활동에 대한 관리 · 감독이 의무화되어야 한다. 넷째, 전승지원금 지급에 있어서 구체적이고 명확한 차등지급 기준이 마련되어야 한다.
이와 같이 중요무형문화재에 대한 지속적인 관심과 합리적인 제도 운영을 통해 중요무형문화재의 바람직한 보호와 전승이 이루어질 수 있도록 해야 한다.

다국어 초록 (Multilingual Abstract)

Culture is the social behavior and lifestyle which are the most affected by the change of the era, and the factors which contain the most national identities and symbolize the identities. Among them, a country's traditional culture is the culture with high value in which the people of that country can establish a consensus, and people's sentiments and life are buried intact.
However, the intangible cultural properties, among the traditional culture of Korea, do not have permanence, but have the variable factors, unlike the tangible cultural property which can be preserved because of their shapes; and in most case, they are not documented. Thus, their innate functions might have been lost at present times, via modern times or have the complex problem of changing or extinction. Thus, if they were not protected, they will likely disappear forever or deteriorated, resulting in the loss in the unique emotion, history and the life of our people, as well as the huge cultural loss. Our government, having recognized and realized these problems, enacted the Cultural Properties Protection Law in 1962; and appointed, reserved, and supported the important intangible cultural properties by law, but the effective problems take place in institution and policies. Thus, for the improvement for these problems and the effective preservation and transmission, the continued studies and analysis of the state and the problems of the important intangible cultural properties protection system in our country are required.
Thus, this study will investigate the problems of the important intangible cultural properties protection system and the foreign cases of the problems of the important intangible cultural properties protection system; analyze the current state, through the annual report on the important intangible cultural properties protection system in Korea, the studies as above, and the literatures; and suggest the improvement plans.
With respect to the problems of our country's important intangible cultural properties protection system; largely, there are the problems of : designation of the items, acknowledgment of possessor and the designation of successor, the education of transmission, and the payment of subsidies for transmission.
To solve these problems, first, the criteria for the designation of the items should be definitely and specifically suggested and the committee member in the field of dancing and the professional committee members should be supplemented. Second, the significance and the criteria for the words relating to the acknowledgment of the possessor should be specified, and the government should be involved in evaluation and screening, for the objectivity and transparency. Third, screening criteria, such as objective, systematic and specific evaluation indicators, and detailed indicators for screening and evaluating those who completed should be clearly established; the management and the supervision over the activities of those who completed should be made as mandatory duties. Forth, with respect to the payment of the subsidies for transmission, the detailed and specific grades for payment should be prepared. Like this, the desirable preservation and transmission of the important intangible cultural properties should be realized, through continued attention and rational operation of system, regarding the important intangible cultural properties.
