국제 무역 관계에 있어 지구촌이 하나된 지 오래인 지금, 어느 재화의 브랜드(상표)가 지니는 가치는 천문학적인 액수를 상회한다. 왜냐하면 국가 간 재화의 이동이 엄청난 규모로 매우 잦게 일어나고 있으므로, 일국에서 형성된 어느 상품의 브랜드 가치가 다른 국가에서도 원산지국에서 형성된 브랜드 가치만큼 쉽게 받아 들여지고 있기 때문이다. 그리고 때때로 이러한 현상이 시너지를 일으켜 해당 브랜드는 소위 국제적인 ‘명품’이 되고 그 가치는 기하급수적으로 상승한다.
브랜드와 같은 지적재산권의 가치가 인정된다는 것은, 그것이 하나의 권리로서 보호되는 것을 전제로 한다. 누구나 해당 브랜드를 아무 상품에나 갖다 붙일 수 있다면 그 브랜드에 가치가 주어질 리 만무하다. 국제 무역 관계에서 이러한 권리 보호의 문제를 거시적으로 생각해보면, 국가 간 지적재산권의 보호 정도가 극심하게 상이해서는 안 된다는 결론에 이르게 된다. 왜냐하면 원산지국에서 보호되는 어느 재화의 지적재산권이 수입국에서는 전혀 보호되지 않는다면, 해당 국가 간에는 무역과 관련된 긴장 관계가 형성될 것이며 이러한 현상은 종국적으로 국제 무역에 왜곡을 초래할 것이기 때문이다. 즉, 지적재산권 보호와 관련된 나름의 국제적인 ‘통일 기준’에 맞추어 각국의 법률이 어느 정도 비슷해져야 할 필요가 있는 것이다.
이러한 나름의 국제적인 기준이 WTO협정 부속서1C에 규정된 ‘무역관련 지적재산권에 관한 협정(TRIPs)’이다. 우리나라 상표법도 TRIPs협정의 내용에 부합하기 위한 노력으로 여러 차례 개정을 반복해 오고 있다. 2007년 개정 상표법에서 등록 가능한 상표의 종류로서 홀로그램 및 동작상표가 추가된 것도 이러한 현상의 한 예이며, 이러한 현상은 비단 우리나라만의 사정이 아니다. 이 시점에서 TRIPs협정의 규정 내용을 정확히 분석하여, 국제 무역 사회에서 우리나라의 개인 ∙ 기업이 보유한 지적재산권의 보호 방안을 강구할 필요가 있다. 우리나라에 국제적인 유명 브랜드가 없던 과거에는 그럴 필요가 덜 했으나, 각 유명 브랜드를 창출해가고 있는 무역 강대국인 지금은 그렇지 않다. 본 논문에서는 국내법에 규정된 상표 ∙ 지리적 표시의 내용, 상표와 관련된 TRIPs협정 이외의 국제 규범, 그리고 TRIPs협정문 중 상표와 지리적 표시에 대해 규정한 제15조부터 제24조까지의 내용을 관련 케이스와 더불어 중심적으로 살펴보았다.
상표 ∙ 지리적 표시의 보호와 관련하여서는 우리나라 관련법도 타국의 지적재산권에 대해 국제적인 수준의 보호를 부여하고 있음을 알 수 있다. 그리고 이러한 발걸음은 WTO 가입국인 153개 국가에서 계속될 것이다. 우리나라 개인 및 기업은TRIPs협정의 이해와 더불어, 지적재산권을 보호 받고자 하는 해당 국가의 국내법도 면밀히 검토하여 막대한 가치를 지니는 지적재산권의 보호를 적극적으로 꾀하여야 할 것이다.

According to a recent survey released on Sep. 18, 2008, jointly researched and compiled by Interbrand, a global corporate image consultant, and U.S. magazine BusinessWeek, Coca-Cola confirmed its world’s No. 1 brand power. The company’s brand value amounted to $66.7 billion, which was well ahead of IBM’s $59.03 billion and Microsoft’s $59 billion. As the world becomes one global economy, it becomes more and more obvious that intellectual property rights(IPRs) are generating astronomical amounts of interest and one of the most valuable resources for corporates and nations.
But what if the level of protection for IPRs was different in other nations? If a brand was well protected in the laws of country A but not in country B, so causing damage to the value of the brand, it would mean possibilities opening to disputes between A and B, and distortion in international trade in the long run. In today’s global village, business decisions are no longer local and even the smallest company may engage in transactions that have international legal implications. Therefore the laws for protection of IPRs in each nation need to be unified to a certain extent.
The Agreement on Trade-Related Aspects of Intellectual Property Rights(TRIPs) in the Agreement on Establishing The World Trade Organization provides both a certain criteria and reasonable discussions among WTO members for the protection of IPRs. TRIPs is an expression of the on-going process of the formation of a global law for international protection of IPRs. For all these reasons, TRIPs deserves special attention. One such example is our Trademark Act which has been amended several times recently to meet the requirements of TRIPs. What is important at this juncture is a thorough analysis and understanding of TRIPs to make an effective strategy in developing and protecting our valuable brand names and other IPRs. This thesis provides extensive and in-depth coverage of our Trademark Act and TRIPs from Article 15(Protectable Subject Matter) to Article 24(International Negotiations; Exceptions) along with two relevant cases settled in the Dispute Settlement Body to help better understand TRIPs and establish viable strategies for the protection of important brand names.
