      • 國際人權 基準 慨念 構成에 관한 硏究

        Human rights are those liberties, immunities, and benefits which, by accepted contemporary values, all human beings should be able to claim "as of right" of the society in which they live. Since World War II, human rights have achieved universal recognition and have become a major concern of international relations and a growing domain of international law. In national constitutions, and by international instruments of varying political and legal significance, virtually all States have embraced the idea of human rights and have indicated general agreement as to their content. By international agreement and partly by customary international law, a growing international law of human rights creates obligations upon States to recognize, respect and ensure designated rights of persons subject to their jurisdiction and provides international remedies for failure by a State to meet these obligations. This dissertation is to research about concept composition of international standard of human right. Namely, it intends to examine the property and function of international standard of human right by historically searching the concept of international standard of human right from the basic course of World Human Right Declaration to define and classify on the basis of actual example. Examining these issues in the text, the following conclusion was drawn. 1. Meaning the common standard that should be attained as specified in the preamble of World Human Right Declaration, 'international standard of human right] is the acknowledged standard without legal binding force in its form. Thus, it may include declaration, recommendation or right of human right treaty as the resolution of general meeting of UN. 2. The characteristics of international standard of human right are mutual dependence, inseparability and universality, which mean that all standards of human right have mutually important meaning and universal quality. 3. The function of international standard of human right varies, depending on 1) general or special human right declaration (to be executed as treaty) 2) Model Law 3) Collective right 4) general and comprehensive document such as world declaration and behavior plan 5) human right treaty adopted by UN. However, the essential common feature of the function is to protect and promote the basic right of natural person, i.e., Human Beings, transcending border line.

A Tale Two cities Is not only a work of art, it is also a tract for times, a conditional prophecy Dickens saw the Revolution as an inevitable course In the organic historical process bringing about the retributive destruction orginating from the conflict between the oppressor and the oppressed He implied in the tale that either side uncontrollable of their violent inclinations could be seriously· harmful to the other side and its result could be mutual destruction The Marquis is convinced that ‘repression is the only lasting philosophy’, whereas Darnay seeks mercy and Justice for the peasants on the estate Dickens attacked aristocratism by showing inhuman Marquis de Evr´emonde, and his influence upon peasant family Madam Defarge undercuts herself through an ironic imitation, She dedicates herself to destroying the Darnay´s family Just as her own family was destroyed The aristocracy must pay the price of the iniquities it has perpetrated, and the revolutionaries will pay the price of their own terrible violence Sydney Carton, who possesses the greatest love, to lay down his life for his friend, achieves an imitation of Christ in his death The novel´s scheme of symmetric contrasts culminates in his ascent to the scaffold, the stage of the Revolution's central rite, reciting the words of Christ, "I am the Resurrection and the Life" Dickens prophesied by the example of Carton's sacrifice that only the heartbreaking repentance and sacred sacrifice on the part of misbehaved classes could reform and Improve the present and future society What Dickens is ultimately concerned with in A Tale of Two Cities is not a particular historical event but rather the relationship between history and evil, how violent oppression breeds violent rebellion which becomes a new kind of oppression

      • 발자크와 렘브란트

        회화가 발자크의 소설 창작에 많은 영향을 주었다는 것은 이미 알려진 사실이다. 필자는 <발자크와 회화>라는 논문1)에서 발자크의 [인간 희극]에 회화가 비친 영향을 검토한 바 있다. 발자크는 100여 편의 장 단편 소설들로 구성된 [인간 희극] 전체에서 절반이 넘는 59편의 소설에서 실존 화가의 이름을 420회에 걸쳐 인용하고 있으며, 33편의 소설들에서 그들의 작품 이름을 65회에 걸쳐 구체적으로 언급하고 있다. 발자크가 인용한 이 화가들은 세 부류로 분류할 수 있다. 즉 라파엘과 같은 이탈리아의 르네상스기의 화가들, 렘브란트와 같은 17세기 플랑드르 화가들, 그리고 드라크루와와 같은 프랑스 화가들로 분류가 가능할 것이다. 그런데 이들 화가들의 인용 빈도수를 살펴보면 발자크는 프랑스 화가들보다 이탈리아 화가들과 네델란드 화가들에 대해 훨씬 더 많은 관심을 보여주고 있음을 알 수 있다. 즉 와또2)(11회), 지로데3)(18회), 게렝4)(14회) 모니에(4회), 엥그르5)(13회), 드라크루와6)(8회), 제리꼬(6회), 고야(2회), 밀레7)(7회), 드깡(6회) 등과 같은 프랑스 화가들보다 라파엘(89회), 레오나르도 다빈치(74회), 티치엥(74회), 미켈란젤로(28회)등과 같은 이탈리아 화가들과 루벤스8)(31회)나 렘브란트9)(36회)와 같은 17세기 플랑드르 화가들이 훨씬 더 자주 인용되고 있다

      • 충북복지의 발달과정과 평가

        본 연구는 해방 이후 2000년대 최근까지 충북복지의 발달과정을 시대별로 고찰함과 더불어 충북복지의 현황소개와 이에 대한 평가 및 향후 발전과제를 제시함으로써 지방분권화시대 충북복지의 발전을 위한 기초 자료를 제공하려는데 연구의 목적이 있다. 충북복지의 발달과정은 해방이후~1959년, 1960년~1979년, 1980년~1999년, 2000년 이후와 같이 4단계로 구분하여 살펴보았다. 그리고 충북복지의 평가 및 향후 발전과제는 기본방향의 문제, 대상자의 사회복지 욕구문제, 사회복지 인력과 시설의 문제, 사회복지 재정의 문제, 사업내용의 문제에 관해서 평가하고 향후 발전과제를 제시하였다. The purpose of this study is to offer useful basic data for developing Chungbuk welfare through examining its historical development up to the 2000 present since the 1945 Liberation of Korea, and suggesting the present status of Chungbuk welfare and the developmental tasks based on its evaluation. The historical development process analysis of Chungbuk welfare shows it is divided into 4 steps such as unsettled period(1945~1959), settled period(1960~1979),activated period(1980~1999) and systematized period(since 2000). The developmental tasks based on the status evaluation of Chungbuk welfare are summarized as the followings. First, it is important to formulize the basic direction of Chungbuk welfare suitable to the characteristics of Chungbuk region and the residents' needs considering the change of social welfare environment. Second, some efforts to secure and reinforce the human resources that can make social welfare policies suitable to Chungbuk region should be made. Third, public welfare professional personnels to cope the rapid increase of the elderly population and their needs should be increased, and the delivery system of welfare and health should be integrated, too. Fourth, the Chungbuk Social Welfare Center should be completed shortly and its operation should be supported to be fair and faithful. Fifth, private welfare professional personnels should be participated in public policy-making process for meeting community welfare needs. Sixth, social welfare facilities personnels should be supported legally and materially for the better treatment and wage. Seventh, legal measures should be taken for the local autonomous authorities' allocated welfare budget to be surely executed based on community welfare plan. Eighth, regarding all residents of Chungbuk as social welfare subjects, the basic living security and various social welfare services for them should be taken in institutional perspective.
