L`intertextualite est-elle une limite du traduisible?

A text is not only related to the author and the reader, but also to other texts. It contains intertextual links, such as quotations, allusions and references, which are especially difficult to translate. By translating them literally, the meaning may be lost. The translator has to help the reader by providing explicitations, notes and so on, but this may change the overall effect of the text. The problem is especially acute when the quoted text is not well-known in the target culture. A possible solution is to stress the function of the intertextual links. Several examples taken from German literature (Kafka, Fontane) are given to illustrate the above difficulties. Each text exists within a general network which is like a vast society of texts. In the second part of the article, it is shown that a translated text has its own place on the intertextual web, which can never be the same as that of the original. The translator must accept this reality, which turns a translation into a living work. Intertextuality does not limit translation - the two enjoy a close and very fruitful relationship.

The case law of the Constitutional Council has taken into account the requirement of quality of the law, mainly in two ways. First the Constitutional Council considers that the legislation should set out normative rules and then cancels the non-normative provisions as policy statements or wishes of the legislator. Moreover, it tries to impose on Parliament, the respect of the constitutional objective of accessibility and intelligibility of the law whose scope remains uncertain. 프랑스 헌법재판소(Conseil constitutionnel)는 법률의 법적 성격과 관련하여반드시 다음의 두가지 점에 대하여 심리하는 원칙을 판례로 확립하고 있다. 첫째, 헌법재판소는 법률이 법규창조력의 능력을 가지고 있어야 한다는 점에서법률규정이 단순히 원칙을 선언하고 있거나 입법부에 의한 기대(souhaits) 정도에 해당하여 규범적 성격이 없다고 판단하는 경우에는 이를 통제하고 있다. 나아가 헌법재판소는 입법부로 하여금 법률의 일반성과 명확성(accessibilité et intelligibilité)이라는 헌법적 가치 목표를 준수할 수 있도록 하는 관점에서 법적성격이 불명확한 법률에 해당하는지 여부에 대하여도 심리하고 있다.

In this note we introduce the concept of a lower radical for ${\Gamma}$-rings. As an application we also characterise the prime radical introduced by Barnes [1] as a lower radical. Furthermore it is shown that the prime radical can also be determined by the class of all semiprime ${\Gamma}$-rings.

The study suggests elements of thoughts on foreign language development aimed at (future) translators and interpreters from the specific case of French language teaching. After emphasizing the importance of a preliminary work with the students focusing on the imagery of language and the reality of learning needs, the study suggests possible avenues for teaching based on the effects of discourse and various linguistic achievements. A particular emphasis is placed on the benefits and importance of using the literary corpus in language courses and linking it with other types of speeches and texts. The study is thoroughly supported by various examples, and the last argument, in particular, describes more precisely two cases of teaching activities aimed at translators and interpreters respectively.

Due to the structure of the translation market, translators whose mother tongue is a language of lesser importance have to defend their native language and their culture by translating into B, not only into English, but also into other languages. At E.S.I.T., these translators are trained at under a special programme by teachers who are not familiar with the students` mother tongue. Based on her teaching experience, the author shows, in the first part of this article, that such training is possible and even that the presence of a group leader who embodies the future reader presents several advantages, such as the impossibility of transcoding, the necessity of deverbalization, the importance of making sense and the need for intercultural clarification. Under this circumstances, translating as a communication skill is considerably improved. The second part poses the problem of evaluation and demonstrates which strategies make it possible to compare several translations of the same text and so to evaluate them without having any comprehension of the source text. Both parts show the theoretical background of this practice and are illustrated by practical examples of class room experience and by the translations that result.
