한국무용 저작권 제도를 위한 기초 항목 분석과 개선방안 연구

이 연구의 목적은 한국무용의 저작권 제도를 위한 기초 항목 분석과 개선방안을 제시하는 것이다. 이에 저작권관련 법률 전문가 6명을 대상으로 델파이(Delphi) 조사를 실시하였다. 델파이 조사 결과를 토대로 무용저작권 기초 항목의 우선 순위를 도출하기 위해 의사결정계층기법(Analytic Hierarchy Process: AHP)을 적용하였다. 15년 이상의 경력을 지닌 한국무용가 20명을 대상으로 자료의 수집 및 분석을 실시하였으며 다음과 같은 결론을 얻었다. 첫째, 한국무용 저작권 활용의 제도적 개선방안에 대한 전문가들의 종합적인 견해를 도출하였다. 법률 전문가들에 의하여 무용저작물 보호범위의 요소, 고정화 수단의 요소, 창작성에 따른 요소, 활성화에 따른 요소에 대한 의견이 제시되었다. 둘째, 범주화된 무용저작권의 제도적 개선방안 요인에 대한 우선순위 및 상대적 중요도를 산출하였다. 최종적으로 무용저작권 활용에 관한 제도적 개선의 방안은 무용저작물 보호범위의 요소(플롯의 구체적인 구성, 특정한 장면으로 연출된 장면, 안무 되어진 일련의 동작, 소품이나 장치), 고정화 수단의 요소(동영상 촬영본, 대본 또는 안무노트, 무보, 모션 캡처 제작본), 창작성의 요소(독자적 작성 및 창조적 개성의 조합, 창조적 개성, 독자적 작성, 예술적·학술적 가치), 활성화의 요소(저작권 등록 인식의 보편화, 저작권 관련 교육, 도제제도 하 폐쇄적 구조의 변혁, 신탁단체 도입)로 도출되었다. The purpose of this study is to suggest institutional improvement measures for the use of copyright in Korean dance. Delphi research was conducted on six copyright law experts. In order to establish the measurement items for dance copyright, the Analytic Hierarchy Process (AHP) was conducted for 20 Korean dancers with more than a Ph. D. than data was collected and analyzed. The results were as follows. First, a comprehensive view of experts on institutional improvements on the use of copyright in Korean dance was drawn. Second, the priority and relative importance of the institutional improvement measures of categorized dance copyright were derived. As a result, elements of protection range of dance works (specific composition of the plot), elements of fixed means (video clip), elements of creativity (combination of self-creating and creative personality) and element of activation (universalization of copyright registration recognition) were derived as a method of institutional improvement on the use of dance copyright. This study is meaningful as a basic study to improve the conflict between these values in order to balance between the protection of the dancer's creativity and the dissemination of the dance.
