        부동산 경매절차상 허위⋅과장유치권 근절을 위한 대책

        Lien is a legal collateral security to occupy other's object, keep the object till the redemption of credit, and compel the repayment of liabilities, and adopts the principle of undertaking, not that of cancellation. Also right relations of real estate seek for the stability of transaction by being publicly announced at the register, while lien has a preferential repayment effect to other real rights as it is a legal collateral security right even though it is not publicly announced. Thus it is difficult to know if lien is real or false in the court auction, resulting in decline of the auctioning price of auction object. As a result, there are many cases that one makes wilful use of this, ex tends the auction period, and if the auctioning price falls, then makes a huge fortune by purchasing it at a low price. As a solution to such problems o f lien, we c an t hink about r evising t he c ivil e x ecution law, but t his researcher come up with following institutional reform plan. If lien is definitely established at real estate execution procedure, then the creditor, persons interested, and buyer will be all satisfied, and the people will have a positive recognition of the court auction. Ultimately, it will activate national economy, curtail social and economic loss, and enhance out legal culture and set up the foothold of an advanced society.

        부동산 거래사고 예방을 위한 제도적 개선방안

        In this study, we proposed various measures to prevent transaction accidents of real estate based on the actual condition survey. Institutional improvements for preventing transaction accidents of real estate are as follows. First, escrow system should be activated. Escrow plays a role of protecting both sides of the seller and the buyer and carrying out fairly all the work arising in connection with real estate transactions such as financiers, lawyers, real estate agents related to real estate transactions and the interests of the stake holders etc. Second, title examination and registration system should be improved. Safety real estate transactions are the most fundamental and important in real estate transaction activities. Third, the licensed real estate agent system should be improved. Generally lowered professionalism of real estate brokerage services in Korea results from the mass production of low-skilled experts by massive production of realtors. Fourth, exclusive organizations dealing with real estate transaction accidents should be established. Real estate transaction accidents are becoming increasingly intelligent. Real estate transaction accidents can be prevented when systems are improved as above.

      • 부동산 에스크로우 제도의 문제점과 활성화 방안

        본 논문에서는 에스크로우 제도 활성화를 위한 방안을 제시하였다. 에스크로우 제도가 많은 장점이 있음에도 불구하고, 현재 우리나라에서는 에스크로우 서비스가 전무한 실정이다. 에스크로우 제도의 의의와 필요성, 절차와 운영현황을 살펴보고 에스크로우 제도 활성화를 위한 방안을 마련하기 위하여 공인중개사 52명을 대상으로 에스크로우 및 권원보험에 대한 인식조사를 실시하였다. 이를 토대로 하여 활성화 방안을 마련하였으며, 본 논문에서는 활성화 방안으로 에스크로우 제도 관련 법률 정비, 에스크로우 제도 관련 정보 및 홍보 활성화, 에스크로우 전문 사업자 및 전문 인력 양성, 부동산 권원보험 활성화 4가지를 제시하였다. The alterative that real estate transactions in advance to avoid an accident is the escrow system Accordingly, it is necessary to present the proposal for real estate brokers engaged in practical affairs to take active part by reorganizing the legal and institutional part of the escrow system In order to activate the escrow system requires a lot of publicity. Should also be training escrow professionals. The escrow system is necessary to revitalize the concurrent implementation of the title insurance system In this study, Analysing the status of escrow system in the real estate market and presenting the activation plans.
