美軍政期의 社會福祉制度에 관한 硏究

이 論文의 目的은 美軍政期 福祉制度의 形成過程과 福祉 需要 實態, 關聯制度 등을 考察하므로써 우리나라의 近代的 福祉政策에 있어서 發展을 도모하고자 한다. 즉, 오늘날 近代化의 産物로 모든 사람들은 편안하게 삶을 영위할 수 있을 만큼 충분한 물질적 재화가 생산되었다. 그러나 최근까지도 소수 지배층을 제외하고 모든 사람들은 궁핍한 상태 내지는 이보다 조금 나은 상태의 생활을 하고 있다. 이러한 인류 역사에 있어서 중요한 변호는 지난 200년에 걸친 經濟發展의 결과이다. 經濟發展은 經濟的·社會的 不平等을 해소하고 일반인들에게 自己實現을 위한 전례 없는 기회를 제공하였으며, 또한 개인의 권리에 대한 새로운 해석의 여지를, 그리고 社會正義의 새로운 차원을 제시하고 있다. 인류의 풍요로움의 시대는 갑자기 다가온 것은 아니며 지구상의 모든 곳에 이러한 혜택이 다 돌아간 것은 아니다. 그러나 적어도 언젠가는 풍요로움이 인간에게 가져다주는 기회와 이것에 수반되는 문제점들의 해결을 위해서는 상당한 시간을 요하며 이 작업은 앞으로도 계속될 것이다. 따라서 現代社會에 들어와서 모든 국가들은 비록 理念과 制度의 特性은 다를지라도 福祉社會 건설을 최대한 목표로 삼고 있음을 알 수 있다. 이것은 바로 국가존립의 목표가 일차적으로 국민전체의 삶의 안전망을 증진시키는데 있고, 또한 모든 인간이 보편적으로 추구하고 있는 基本欲求에 바탕을 두고 있기 때문에 社會福祉의 개념이 나타난다. 따라서 해방 후 美軍政期는 우리의 福祉制度에 있어 매우 중요한 時期이라고 볼 수 있다. 이 時期를 통하여 植民地 政策의 일환으로 시행되었던 日帝時代의 각종 福祉制度들이 청산되고 近代的 福祉制度들이 나타나느냐 아니면 기존 제도들이 그대로 유지되느냐를 가름할 수 있는 시기이기 때문이다. 이 당시의 政策은 救護的 차원에서 救護行政의 강화와 朝鮮救護令을 보완한 救護制度의 정비로 福祉政策을 폈으나 기본적으로 過渡期的 성격의 것으로서 곧바로 높은 수준의 구호시책으로는 연결되지는 않았다. 결국 救護의 範圍와 水準은 要救護者들이 상황을 근본적으로 개선하는 것을 불가능하게 하는 최저한의 수준에 머물렀다고 볼 수 있고, 그 원인은 당시의 전반적인 경제적 상황에 있었던 것 뿐만 아니라 美軍政이 政策遂行이 문제의 본질적인 해결보다는 사회적 갈등에 대한 통제를 목적으로 했기 때문인 것으로 평가된다. 그러나 결과적으로 아동 및 女性福祉 부분에 있어서는 개선적 노력이 나타났다고 볼 수 있으나 근대적 福祉制度로서의 완전한 전환보다는 아직도 전근대적 성격을 많이 띠고 있다고 볼 수 있다. 그러나 우리나라에 있어서 近代的 福祉國家의 기초를 마련하는 데 중요한 時點으로 보아야 하겠다. The purpose of this paper is to help develop modem welfare policies of this nation by reviewing the formation, demand and related institutions of social welfare system during the period of the U.S. military administration. Today modernization has produced a great deal of goods and services enough to make everyone live a more comfortable and happier life. Nevertheless, until recently most people except few power elites have been in poverty or non-affluence. In the history of human beings, there were significant changes by economic development over the past 200 years. Economic development has eliminated economic and social inequalities, provided unprecedented opportunities if self-realization to ordinary people and offered new dimensions of translating individual rights and social justice. An age of abundance hasn't shown up in a surprise before human beings, and its profits are not still extending to the every corner of the world. But it has been widely believed that some day everyone of the world would enjoy such an age. That will be followed by a new society providing opportunities. It will take many years to solve problems which would be accompanied by such opportunities. Thus all of modern countries emphasize the construction of welfare society as their foremost objective, even though they are different with each other in ideologies and institutions. This is because the purpose of the existence of a nation lies in the promotion of social safety nets for the whole people and is based on basic demands commonly pursued by all human being. Hence comes the concept of social welfare. The period of the U.S. military administration after liberation from the Japanese colonial rule may be considered as very significant to the social welfare system of this nation, Seeing through the period, it could be determined whether a variety of welfare systems as part of colonial policies by Japan were gave way to modern welfare ones, or remained. During the U.S. military rule, welfare policies were carried out by ways of strengthening relief administration and improving existing relief institutions such as the Chosun Relief Ordinance, but they were basically transitional not fundamentally change situations of those who needed relief. This could be attributed to the U.S. military government office focusing on controlling social conflicts rather than on resolving inherent problems, as well as a general economic situation of the period.

韓國 社會保障法制의 改善方案에 관한 硏究

社會保障法制는 社會政策學을 중심으로 經濟學, 社會學, 法學, 財政學 등, 여러 갈래로 건너온 학문이 같이 존재하면서 경쟁하고 있기 때문에 가치 있는 學問的 硏究領域을 가지고 있다고 할 것이다. 그러나 戰後 우리나라에서는 잘 알려지지 않았던 Social Security의 개념과 法의 도입이 지금 우리의 憲法 제34조 제1항 '모든 국민은 인간다운 생활을 할 권리를 가진다'라는 규정을 중심으로, 동조 제2항 '국가는 사회보장·사회복지의 증진에 노력할 의무를 가진다', 동조 제5항 '신체장애자 및 질병 ·노령 기타의 사유로 생활능력이 없는 국민은 法律이 정하는 바에 의하여 국가의 보호를 받는다'는 규정에 의거 우리나라의 社會保障法도 社會法의 한 분야로 연구·발전되어 왔다. 하지만 아직은 모든 社會保險의 실현에 있었던 社會保障 생성기에는 대부분 기여하지 못했으나, 88올림픽 이후에 法學硏究者들에 의해 연구내용에 있어서 착실한 전진을 했다고 볼 수 있다. 그렇지만 社會保障 法制의 발전은 勞動法 분야만큼이나 그 국민생활로의 관계에 깊은 관련성으로 인하여 아직은 法的 體系化가 미비하다고 하나, 우리나라의 社會保障法도 건 반세기에 걸쳐 지속적인 고도경제성장의 성공적인 수행의 결과 先進福祉國家를 전망하는 국가발전단계에 이르렀다고 볼 수 있다. 따라서 福祉國家 내지 福祉社會 건설의 수단·제도·정책으로서의 社會福祉의 증진이 民主化에 따른 국민욕구의 동시 다발적인 분출과 더불어 절실히 요구되고 있다. 이와 같은 社會福祉의 行政과 實踐은 어디까지나 法的 根據에 의거하여 시행되어야 한다는 것을 감안할 때, 우리나라 사회보장관계 法制에 대한 올바른 인식과 이해가 절실히 요망된다고 하겠다. 따라서 法制는 국가경영의 기본 틀로써 한 시대가 추구하는 이념의 산물이며, 그 시대의 사회상을 반영한다고 할 수 있을 것이다. 사람들이 살아가는 사회에서는 각종 사회가 형성되기 마련이고, 특히 사회의 최고형태라 할 수 있는 국가는 자신이 추구하는 정책을 갖게 되는데, 이러한 制度와 政策을 法令이라는 형식으로 나타내는 法制는 무릇, 國家의 모든 제도와 정책은 法制를 통하여 비로소 구체화되고 국민에게 전달·집행되어진다고 본다. 결국 現代國家에서의 法制는 그 구성원인 전체 국민의 의사를 반영하여 국가경영의 기본 틀을 이루는 것으로서 法規 특유의 강제력으로 인하여 국민의 일상생활의 규율을 지배하지만, 그것은 사회 현황의 변동에 부응하여 變遷을 거듭하고, 이러한 變遷은 受規者인 국민들의 의사에 기초하여 이루어진다는 점에 특색이 있는 것이다. 따라서 法制의 變遷과정을 추적해 보는 것은 사회의 발전과정을 파악하는데 매우 유용하며, 새로운 시대에 걸 맞는 法制를 마련함에 있어 과거에 이룩한 성과나 法制運營과정에서 겪었던 시행착오를 거울로 삼을 수도 있다. 다시 말하면 과거와 현재, 그리고 미래는 서로 단절될 수 없다고 볼 때 과거의 法制는 현재 시행중인 法制가 태어난 바탕 내지 배경을 이루며 미래사회의 法制需要를 파악하고 立法方向을 설정하는데 준거가 될 것이다. 法制는 수많은 法令이 정교한 체제를 갖추고 있기 때문에 法制史 硏究에 있어서는 法理的 側面의 考察과 立法 政策的 側面의 接近을 병행하고자 한다. It may be said that the social security law has valuable study areas because various sciences such as social policy, including economics, sociology, law, financial economics, etc. coexist in competition. Since the Korean War, the concept and institution of social security was introduced to Korea, and then, it occupied an important position as a large-scale social system, and a lot of researches on it have been made. However, it may be said that researches on laws regarding social security have fallen behind comparatively. The law community did not contribute much to the realization of all the social insurances during the early era. However, there have been many researches and outcomes by jurists on that area since the 1988 Olympic Games. Although the social security law has not been developed so enough yet in that it is as deeply related to the life of the public as the labor law, Korean social security system is deemed to reach such a national development stage that may expect a developed welfare state, considering that the nation has successfully accomplished continuous rapid growth over half a century and GNP per capita is over US$8,000. The development of social security laws originated from British 'Poor Law' which was launched to solve the poverty problem which was social ills of the early capitalism based on private property and free competition, and the Social Security Act of 1935 which was enacted in America as a part of New Deal established a system of social security laws for the first time. The promotion of social welfare as a means, system and policy for construction of welfare state or welfare society is pressingly needed together with the gust of people's needs in line with democratization. Considering that the administration and practice of social welfare should be executed on a legal basis, proper recognition and understanding of Korean legal system related to social security is pressingly required. The legal system, one of basic frames of the national management is a product of ideology an era pursues, and reflects the social aspect of an era. Various societies comprises the human society, and the state as the highest form of society come to have its own policies and systems. The legal system in a form of law embodies such policies and systems and executes them toward the nation's people. The legal system in the modem state reflecting the will of the whole nation comprises the basic frame of the national management, and controls and governs the daily life of people based on the rule's inherent compulsion. It is characterized by continuous changeability according to the changes of social situations and, such changes are made based on the will of people who should observe the rules. In this respect, reviewing the history of legal system is very useful for identifying the evolution of society, and helps provide such opportunities to reflect the past performances and trials and errors. In other words, assuming that the past, the present and the future cannot be severed, the past legal system is the root that produced the present one in force, and plays a role of a standard for identifying the demand of legal system and establishing legislative direction.

신병교육훈련 병사들의 정서지능과 사회적 지지가 병영생활 적응에 미치는 영향

우리나라의 병영제도는 의무병제도로서 일정한 연령에 도달한 성인 남성들은 의무복무기간동안 자신의 의지와 상관없이 군대에서 국방의 의무를 수행해야 하며 국민의 의무이기도 하다. 군 생활을 하는 대부분의 현역 병사들은 청년기에서 성인기로 넘어오는 불안정한 과도기적 시기로 급격한 신체적,생리적 성장과 함께 정체성을 형성해야 하는 중요한 시기이다. 이를 통해 문제점을 분석 및 평가하여 군대에 입대한 신병들의 적응력 향상 방안을 제시하였다. 아울러 본 연구는 신병교육훈련 병사들의 정서지능과 사회적 지지가 군생활 적응에 어느 정도 영향을 미치는지 분석하여 적용방안을 중심으로 제시하였다.

The purpose of this study is to examine the effect of learning achievement in Army's initial training and it has difference among difference trank. Also, this study is to grope for the direction to improve the commissioned education system by the current situation, focusing on the training of the military specialists. For the operation of the purpose, have referenced the previous studies and homecoming reports. Next, the Army have to do part improvement is the first, special ability divide function have to accomplishment. The second, Special Skill Divide Guidebook and Inspection Guidebook of modification protection. The thirdly, special skill soldier invitation a system improve of improvement. The fourth, military special skill system improvement this study shows that using multi time dia is effective in Army's education and training. Therefore, Army's education and training is considered to introduce in Army's ability. A soldier special skill system is receive be influenced affected by society grow up development and change for manpower management a means, besides, system for reconsideration efficiency of confirmed specialty for military. Recent the early period, special manpower has education in military function as proper go to the society but, present actuality don't suit that military the period of service reduction of master new skill in military and follow transferred practical use in society. The military specialists who has the qualities with more professional parts than the ones with general military knowledge in necessity of the more technology integrated knowledge as the 21st century 68military is getting high tech. Lastly, in order for trainees to concentrate themselves on learning, the military should set up a system to support them and also should provide practical assistance in order for them to write theses regarding the military. The Korea Army, dictatorial leadership dominated in the past cannot effectively manage its members. Furthermore, soldiers in their new generation, who have remote difference in their views and characters with former generation, account for more than 80 percent of the military. When the Korea Army effectively manage those new generation soldiers, it can manage its current military force. Despite its interest and importance, research on leadership have not been made in an integrate and systematic way. The korean army has also changed in many ways as well as in the life of the army since the 1990s when the new generation young man started to join the military service. So it has new point s of view about the quality of the commanders. It was the reflect of the rapidly changing world and the fact that the army and the commander s that try to follow the change can have a victory. The main element of the command is made when the commander the soldier, and the situation exist. Because It is really difficult to know and identify what the soldiers think and who they are.
