지방의회와 집행기관간의 관계에 관한 평가 : 포항시 의회의 사례연구

본 연구는 지방의회와 집행기관간의 관계에 관한 평가연구로서 포항시를 사례로 하였다. 평가를 위한 제 측면은 구조·기능적 측면과 행태적 측면으로 구분되어진다. 여기서 고려되어 진 주요 변수로는 지방의회의 집행기관에 대한 감시 통제와 지원 ·조장 변수이다. 그리고 양기관의 갈등도 주요 변수로 파악하여 그 원인에 대한 행태적 평가를 시도하였다. 평가의 결과를 보면 구조 기능적 측면에서는 어느 정도 문제점도 노출되었지만 일반적으로 긍정적이었던 반면 행태적 측면에서는 상당히 부정적인 태도가 지배적이었다. 이는 구조 기능과 행태간에 상당한 괴리현상을 보이고 있는 것이다. 그리고 평가결과에 입각하여 문제점과 개선과제를 추출하였으며 이에 따라 향후의 개선방안이 제시되었다.

지방의회 행정사무감사의 실태와 효율적 수행방안

Korean Local Council has Audit and Inspection Power on the administrative affairs of executive branch of local government. Local Autonomy Act stipulates this power in article 36. The Purpose of this power is to ensure that the executive branch of local government implements local administration democratically and efficiently. But not a few problems have been happened on the implementing processes of this power. These problems were examined in this article by institutionally and behaviorally. And the ways of correction on these problems were examined and also proposed desirable remedies. Two key points emphasized here are as followers. The one is that all councilors should prepare a lots of related information for the audit and inspection committee's activities and should make strategic plans. And if needed, they should visit on the spot happened the very problems. The other one is that every councilor as a member of inspection committee should have some standards to audit and inspect the administrative affairs such as rationality, efficiency, effectiveness, productivity, fairness, responsiveness, priority, innovativeness.

지방의회 사무기구의 관리실태와 인사권 독립방안에 관한 연구

본 연구는 지방의원들의 의정활동을 보조ㆍ지원ㆍ협력하는 의회사무기구의 구성과 운영에 관한 제도적 문제점의 심각성을 인식시키고, 개선방안을 탐색하였다. 현재 지방자치법령은 지방의회 의회사무기구(처, 국, 과)의 조직과 인사를 지방의회가 아니라 법령과 자치단체장에 맡김으로써 지방의회의 의정활동을 저해하고 있다. 이러한 문제점은 지방자치제도를 실시하기 시작한 1991년부터 문제점으로 지적되어왔지만, 제도실시 16년이 지난 오늘에까지 부분적으로도 개선되지 않고 철저히 외면 받아왔다. 따라서 본고에서는 관련법령을 중심으로 제도내용의 실체와 이 제도가 안고 있는 문제점을 분석하고, 여기에 대한 찬반론을 소개하였다. 또한 우리나라와 같은 기관분리형 지방정부구조를 취하고 있는 미국과 일본 등 외국의 관련제도를 검토하였다. 이러한 연구를 기반으로 현재의 문제점을 개선할 수 있는 정책대안을 제시하였다. 즉 제도개선을 위한 기반조성, 과도기(단기적)대책과 장기적 대책 등으로 나누어 의회사무기구를 명실상부한 지방의회의 기구로 독립시킬 수 있는 대안을 제시하였다. 요컨대 본 문제의 핵심은 의회사무기구의 장과 직원 그리고 전문위원들에 대한 인사권을 지방자치단체장으로부터 분리하여 지방의회가 갖도록 하는 법령개정에 있음을 분명히 밝히며, 향후 그 개선을 위해 지방의원들의 적극적이고 강력한 활동을 촉구하였다. This study is intended to deal with the controversies surrounding the right over the personnel management of the office of local council in Korea. The office of local council is composed of a secretary general, supporting staffs(advisory staffs and working officers). During session of the local council, the staff are doing many different tasks, and carrying out very important roles in making decisions, making local ordinances and so on. Korean local governments have check and balance system by establishing legislative councils and executive bodies. Because of this unique structure, the office of local council should maintain independent status from the executive body. But in reality, the situation is quite different. The office of local council is established by local ordinance and the staff are appointed by local chief executive. But to sustain the principle of check and balance, and maintain the independence status of local council, the personnel power over local council staff should also be independent, by giving the power to the local council. This study, in these connection, analyzes the present provisions of related ordinance, comparative case studies abroad, and suggests better ways of solving the problems, in both short and long term perspectives.

Perfluorinated Compounds (PFCs) 안정화 시스템의 연구

PFCs는 독특한 사용감과 특성으로 인하여 화장품에 응용되어질 때 많은 특장점을 가지고 있다. 그러나 이러한 장점에도 불구하고 화장품 제형에 적용하기에 많은 어려움을 가지고 있다. 즉, 물과 오일에 불용성, 높은 비중, 높은 증기압 등과 같은 원료의 특징으로 인하여 PFCs는 화장품에 적용하기 위하여 특별한 안정화 시스템을 필요로 한다. 본 연구에서 PFCs를 안정화하기 위하여 gel network, spherulite lamellar, nanosturucture 이상의 세 가지 시스템을 이용하였으며 사용된 세 가지 시스템 중 nanostructure system이 가장 안정함을 알 수 있었다. When Perfluorinated Compounds (PFCs) are applied in cosmetic products, they have many merits because of unique feeling and characters. However, it is very difficult to use them as cosmetic ingredients because they are insoluble material in oil and water and have high specific gravity. To develop a special system to stabilize PFCs in cosmetic products, we compared three systems, of gel network system, spherulite lamellar system, and nanostructure system. We found that nanostructure system was the optical system for stabilizing PFCs.

한국지방자치발전을 위한 지방정부의 역할과제

지난 19년간의 경험에 의하면 가까운 장래에 중앙정부가 자발적으로 지방분권을 추진하거나 솔선하여 지방자치와 지역균형발전을 추진할 것이라고 기대하기는 어려운 실정이다. 때문에 이제부터는 한편으로는 지방정부가 적극적으로 중앙정부를 설득하고, 압박함으로써 지방분권과 자치제도 등을 유도하고, 다른 한편으로는 스스로의 노력으로 자체역량강화, 지역발전, 주민에 대한 서비스제고 등 보다 적극적이고 주도적인 역할을 추진해야 할 때가 되었다. 이러한 관점에서 본 연구는 지방정부가 추진해야 할 역할과제들을 다음과 같은 세 가지 관점에서 검토하였다. 첫째 중앙정부와 지방정부간의 관계측면에서는 "지방의 자율성을 확충하고 실질적인 자치발전을 위해 개선해야 할 과제"들을 검토하였다. i) 경직적 법령을 통해 전국을 획일적으로 지배하고 있는 현행 지방자치제도의 개선을 위한 과제, ii) 중앙집권적 권력의 지방분권화를 위한 과제, iii) 중앙집중적 기능의 지방분산과 조정 문제, iv) 지방을 과잉통제하고 있는 국가의 지도감독의 문제점과 개선과제를 검토하였다. 둘째 지방정부 내부관리에 대해서는 자치역량강화를 위해 요구되는 구조와 기능혁신의 과제들을 검토하였다. 즉 i)지방자치단체 기관구성의 자율성 확보와 기관간 권한의 합리적 조정문제, ii) 인사관리혁신과 재정력 확충을 위한 과제, iii) 지방정부의 구조기능혁신 및 자치단체장의 리더십 확충, iv) 자치구역조정에 대한 유연성확보와 지방정부간 협력체제구축, v)지방의회의 전문성 제고와 집행부와의 견제 및 협력증진방안 등을 검토하였다. 셋째 지방정부와 지역주민간의 관계에서는 주민참여증대와 행정서비스질의 향상을 위한 과제들을 검토하였다. 즉 i)주민참여의 증대와 주민의 민주시민적 역량제고, ii) 지방정부의 책임성과 투명성제고를 위한 행정정보공개, iii) 행정서비스의 품질제고와 로컬거버넌스 체제의 구축 등에 관해 문제점과 개선과제들을 검토하였다. The local self-government systems in Korea have been remarkable improvement since 1991. However, compared it with those in more developed countries, there are still numerous rules and elements which should be upgraded and advanced. In particular, since the launch of Lee Myung-bak government, the local government systems in Korea have been at a standstill. Furthermore, it is hard for citizen and local government to expect more advanced local autonomy from this government. Thus, from now on, it is time for local government itself to actively engage in the development of local autonomy and regional welfare. On this account, this study examines the roles and assignments for the local government to perform them. First, this paper focuses on the roles which local government should perform to central government in order to advance the local autonomy system. Second, this paper examines the roles which local government should perform to strengthen local government`s own capabilities. Third, this paper searches the roles which local government should do in relationships with local citizen.

지방정부의 자치역량요소와 역량강화에 관한 연구

This study is on the self-governing capacity of local government. The capacity of local government is consisted of intrinsic and extrinsic factors. But the purpose of this paper is to examine some essential factors of intrinsic capacity of local government. And the meaning of 'capacity' here is 'the ability to do something or the level of the ability' and is mainly understood as an individual ability or special quality to achieve in an organization. Local government in this paper is regarded as political system. According to the Political System Model, it has two important aspects such as structure and function. And the self-governing capacity of local governmen is usually decided by these two factors. As structural aspect of local government, there are power structure, manpower structure, organizational structure, financial structure. and Functional aspect has management service function, development drive function and innovative creation function. Each structural and functional factor has also several sub-factors. Some factors examined and selected in this paper are considered as most important factors on self-governing capacity of local governmen. This paper also studied on how to improve the self-governing capacity of local governmen. Resources improvement, institutional enlargement, leadership enforcement are explained and prescribed here.
