미국 메이저리그야구선수협의 선수에이전트 관리 규정에 관한 고찰

한국 스포츠는 ‘프로스포츠의 발전과 시대적 요청 그리고 선수들의 권익보호’를 위해 스포츠에이전트 제도가 절실히 필요하며, 이에 대한 법적 근거 마련 및 육성에 대한 논의가 이루어져야 한다고 본다. 이에 본 연구에서는 한국형 스포츠에이전트 제도가 잘 도입되고 정착되기 위해서는 우선 준거가 필요하다고 판단하여 그 준거가 될 수 있는 모델을 미국 메이저리그 선수협이 수행하고 있는 ‘선수에이전트 관리 규정’으로 선정하였다. 스포츠에이전트 제도가 가장 잘 발달되어 있는 미국 메이저리그 선수협의 선수에이전트 제도를 검토하는 것은 의미가 있을 것으로 판단된다. 따라서 본 연구는 우선 미국 메이저리그 선수협의 ‘선수에이전트 관리 규정’을 면밀히 검토한 후 한국형 스포츠에이전트 제도 기반 마련에 응용할 수 있는 중요한 시사점을 발견하여 이를 제시하고자 한다. 미국 메이저리그 야구선수협의 ‘선수에이전트 관리 규정’을 고찰한 결과 다음과 같은 시사점을 제시할 수 있다. 첫째, 한국형 스포츠에이전트를 정확하게 정의하고 규정할 필요가 있다. 스포츠에이전트의 정의가 명확히 설정이 되어야 그들의 업무 범위를 결정지을 수 있기 때문이다. 둘째, 한국형 스포츠에이전트는 모든 스포츠산업 분야를 총괄할 수 있는 하나의 일원화된 ‘스포츠에이전트’로 규정할 것인지 아니면 메이저리그 야구선수협과 같이 ‘선수에이전트만’을 규정할 것인지 판단해야 한다. 셋째, 스포츠에이전트 선발에 있어서 시험제도를 둘 것인지 아니면 단순히 교육이수만을 할 것인지 판단해야 한다. 넷째, 스포츠에이전트의 결격사유에 관해서도 명확히 규정할 필요가 있다. 다섯째, 스포츠에이전트의 금지행위 및 금지행위에 따른 징계에 관해 규정할 필요가 있다. 여섯째, 한국형 스포츠에이전트 역시 선수와 에이전트의 고용관계를 어떻게 규정할 것인지에 대해 고민할 필요가 있다. 일곱째, 에이전트 계약기간과 보수에 대해서도 명확하게 규정할 필요가 있다. 여덟째, 선수와 에이전트간의 분쟁을 어떻게 해결할 것인가에 대한 문제를 고민하여 규정할 필요가 있다. Sport agent system in Korea is required to be established by development of professional sports, demands of the times, and protection of player’s human rights. To be well introduced and settled Korean version of sport agent system, this study chose and reviewed ‘MLBPA Regulations governing player agent’ as a criterion for Korea Sport. The purpose of this study was to closely review on ‘MLBPA Regulations governing player agent’ and then to find some implications from that for setting solid foundation of Korean version of sport agent system. The results were as follows: First, the meaning of ‘sport agent’ should be closely defined to regulate the task range of sport agent in Korea. Second, the meaning of sport agent in Korea should be defined whether as a sport agent of unification encompassing all sport business fields or only for player’s agent. Third, policy for screening and selection of sport agent should be well organized. Fourth, standards of disqualification should be regulated. Fifth, the forbidden behavior and discipline action for sport agent should be regulated. Sixth, employment relation between player and agent should be regulated. Seventh, the policy for contract period and compensation should be regulated. eighth, policy for disputes and arbitration between player and agent should be regulated in Korean version of sport agent system.

본 연구는 한국 법령과 국내외 문헌을 고찰하여 스포츠시설 안전관리 매뉴얼에 포함될 수 있는 구성요소들을 추출하고 이러한 내용들을 토대로 델파이 기법과 심층면접을 활용하여 한국 실정에 맞는 표준화된 스포츠이벤트시설 안전관리 매뉴얼을 제안하고자 한다. 우선 스포츠이벤트시설에서의 안전관리 매뉴얼에 포함될 구성요소들을 추출하기 위하여 한국 법령 9개와 국내외 문헌 18개를 고찰하였다. 여기서 추출된 구성요소들은 델파이 기법의 설문조사에 사용하기 위하여 재구성되었다. 매뉴얼의 구성요소들을 검증하기 위하여 델파이 기법을 활용하였고, 델파이 기법의 결과를 수렴 및 보완하기 위하여 심층면접을 수행하였다. 우선 델파이 기법은 전문가 패널 선정이 가장 중요한데, 본 연구에서는 스포츠산업경영 전공 대학교수를 전문가 패널로 선정하고, 스노우볼 표집을 통해 추출하였다. 전문가 패널들은 1라운드에서는 총 29명 그리고 2라운드에는 4명이 누락된 25명이 참여하였다. 자료수집은 설문지를 활용하였고, 자료분석은 동의수준을 파악하기 위하여 중앙치를 그리고 의견일치 정도를 파악하기 위하여 사분위 범위를 활용하였다. 심층면접은 서울 소재 프로야구구단 OO의 관계자 1명과 경기도 소재 프로 축구구단 OO의 관계자 1명과 실시하였다. 본 연구를 수행한 결과 스포츠이벤트시설 안전관리 매뉴얼에는 6개의 분류 하에 63개의 하위항목들이 포함될 수 있음을 발견하였다. 또한 매뉴얼 개발과 더불어 위기 상황에 발 빠르게 대처할 수 있도록 조직 구성원 대상 정기적인 모의훈련과 교육이 무엇보다 중요할 것으로 사료된다. 또한 매뉴얼을 특정인이 보관하기 보다는 모든 조직 구성원이 손쉽게 볼 수 있는 곳에 보관하는 것이 중요할 것으로 사료된다. 그리고 안전관리 강화를 위한 조례 제정과 시설운영권의 프로구단 귀속이 안전관리 개선의 선결과제일 것으로 사료된다. 마지막으로 체육시설관리사와 같은 전문인력 양성역시 시급한 과제라 사료된다. The purpose of this study was to develop standardized manual of safety management in Korean sport event facilities by using delphi technique and in-depth interview. This study extracted factors which would be possibly included in safety management manual of sport facilities from examination of Korean Statutes and Orders, and various domestics and international literatures. In order to accomplish purpose of study, 9 Statutes and Orders, and 18 literatures were reviewed to extract factors of safety management in sport event facilities. Delphi technique was used to verify included factors of manual and in-depths interview was used to converge and supplement the results of Delphi technique. Most of all, selection of expert panel is very important for Delphi technique and thus professors majoring sport industry and management were selected by snowball sampling method in this study. A total of 29 experts participated in the 1st round and 25 experts with 4 missing in the 2nd round. The survey was used for data collection. Median for level of agreement and Interquartile Range for consensus were used for data analysis. In-depths interviews were performed with a staff of professional baseball club in Seoul and a staff of professional soccer club in Kyeonggido. In conclusion, this study found that 63 main factors under 6 categories could be included in safety management manual of sport event facilities. Besides, with development of manual, regular rehearsal and staff education are also suggested because it is very important to quickly cope with emergency situation. The manual is recommended to keep any certain place that every staff can take a look at it easily. Establishment of municipal ordinance related to safety management consolidation and facility operation rights belonging to professional sport club should be assured as a prior task. Last but not least, fostering expert of sport facility management is also very urgent.
