        In the recent we has witnessed a large number of oil spills that been caused by a variety of marine accident. Many areas of the world's oecean and coasts are threatened by oil spill pollution from marine accidents. Especially catastrophic oil spills form tankers have polluted the marine environment at Korean coasts. This article, therefore, investigates for conditions and compensations of oil spill pollution stipulated by various systems in order to suggest practical understanding to the parties concerned. For this purpose, in the first part of this paper, states of the art of marine oil spills and major oil pollution accidents such as Sea Prince, The Exxon Valdez etc. are introduced. In the second, compensations for oil pollution damage stipulated by Marine Insurance, Protection and Indemnity Insurance, International Convention, and Korea Compensation Act for Oil Pollution Damage have explained. And in the conclusion, this article provides several suggestions. First, shipowners must regard both the scope of liability and exclusion, strive prevention and compensation for oil pills. Second, it is necessary for government to share for above a certain money of indemnity according as limits of liability are increased by international convention. Third, shipowners shall have a fund as self insurance to provide for marine accidents as well as a method transfers risks to the international fund convention. Forth, speciality respose system need to be introduced to prevent marine ecosystem from oil spills in demension a state level at port in area of marine accident of high frequency.

      • C형 간질환에서 C형 간염 바이러스 유전자형의 분포

        It has been suggested that different genotypes have different clinical outcomes with regard to disease severity and response to interferon treatment. We studied the distribution of hepatitis C virus genotypes in 29 patients with liver disease by polymerase chain reaction with capsid - specific primers. Hepatitis C virus genotype lb(Ⅱ) was present in 15 patients(51.7%), and 2a(Ⅲ) in 6(20.6%). Five parients(17.2%) had evidence of dual infectiondype lb(Ⅱ) and type 2a(Ⅲ)). Three patients were untypable by the method used. These data showed that two genotypes, type lb(Ⅱ) and 2a(Ⅲ) account for most cases in our cohort of patients with a relatively higher frequency of type lb(Ⅱ).

      • 한국과 중국의 FTA 체결이 한국 경제에 미치는 영향

        Korea experienced rapid increase in international trade with China since they established diplomatic relations in 1992. The international trade, in diverse goods shows both quantitative increases and structural changes during this period. And Korea gets much benefit from rapidly-growing trade with China in electronic industry, the heavy and chemical industry. However, the dependences of Korea on Chinese economy have intensified gradually. Accordingly the purpose of this article is to study the Korea-China FTA and the impact of its on Korean Economy. The prospects of Korea-China FTA, which has been recently discussed in public, are not clear. But Korea-China FTA would have mutually economic benefit. In practice, the effects of Korea-China FTA for Korean economy may vary according to the coverage and content of mutual agreement. And the conclusion of Korea-China FTA would increase the dependency of Korea on China. However Korea-China FTA must contract for the continuous growth of Korean economy even if the decision of both Korea and China will not easy. The altematives will be either to establish a low-level traditional FTA in a short period or to negotiate a high-level broader-ranged FTA in long-term perspective.

      • 측두골 골절 : 임상적 및 방사선학적 분석 Clinical and Radiological Analysis

        The objective of this study is to review of the incidence of temporal bone fractures and complications resulting from temporal bone fractures and to analyze the correlation between clinical and radiological findings. A series of 49 patients who were diagnosed temporal bone fracture with rhinorrhea, bloody otorrhea, admitted to Soonchunhyang University Chon-an Hospital from January 1997 to September 1999, were studied retrospectively. Clinical analyses were focused on age, sex, type of accident, external wound site, CSF leakage, hearing loss and facial nerve palsy. The high resolution CT scan consisted of a series of 3-mm thick sections through the temporal bone using the GE CT scanner (General Electric Inc.). In radiologic analyses, fracture types of temporal bone were divided into longtudinal fracture(LF), transverse fracture(TF) and mixed fracture(MF) respectively. The CT scans were examined for mastoid antral haziness(MH), middle ear cavity haziness(MeH), ossicular chain disruption(OD), otic capsule fracture(OF), pneumocephalus(Pn). The type of facial canal fracture was classified as fracture of internal auditory canal portion(FIAC), fracture of perigeniculate portion(FPG), fracture of tympanic portion(FT), fracture of mastoid portion(FM). The correlation between clinical and radiological findings was analysed. A total of 49 fractured temporal bones resulted in 9 CSF fistula, 23 hearing loss( 13 conductive type, 7 sensorineural type), 17 facial nerve injuries ranging from mild paresis to complete paralysis. The mose common etiology of the injury was from a motor vehicle accident(28%). The type of fracture observed on high resolution CT scanning was a LF in 39(78%) patients, a TF in 7(14%) patients and a MF in 3(6%) patients. The majority of fractures terminate in the floor of the middle cranial fossa in LF and passed lateral to the otic capsule in TF. Average time of onset of delayed facial palsy was 3.5 days. No patient developed prolonged otorrhea or meningitis during hospitalization and there was no requirement of surgical management. Hearing loss was the most common complication of temporal bone fracture(48%). Conductive hearing loss was associated with middle ear cavity haziness and ossiclular chain disruption. in temporal bone CT. A total of 29 cases facial canal fracture in temporal bone CT resulted in 14 perigeniculate portion(FPG), 12 tympanic portion(FT), 3 mastoid portion(FM). There was no correlation between radiological facial canal fracture and clinical facial nerve palsy. Four of 17 patients with facial nerve injury required facial nerve exploration under general anesthesia. We thought that prognosis and therapeutic planning in patients with temporal bone fractures were based on the clinical and radiological findings.

        In recent years, the literatures on electronic commerce and electronic marketplace have recognized the importance of intermediaries and the functions they serve. This study also reveals the multimodal carrier as intermediaries in international multimodal transportation market, because it has been widely stated that structural changes in international transportation markets, such as dismultimodal carriers, would occur due to the impact of electronic trade and electronic information exchange. But these statements are oversimplified and exaggerated as argued by Sarkar, Butler and Steinfield, because different outcomes changed by dismultimodal carrier are possible, such as cyber-multimodal carriers, direct multimodal carriers supplemented by electronic commercem and re-multimodal carriers as off-line carrrier. Accordingly this paper attempts to explan the model developed by Sarkar et at., by applying the model to international multimodal transprotation market. In this paper, it is explan that a understanding of the evolutionary impact of electronic commerce on existing international transportation market structures and multimodal carrier roles is reached by taken into account both theoretical approach and case studies concerned.

      • 신용장거래에서 전자적 제시에 대한 매입은행의 내용검토의무에 관한 연구

        The purpose of this paper enhances the understanding of the eUCP among parties concerned dealing electronic documents, examines the responsibility of negotiating banker's content examination for the electronic letter of credit under eUCP articles. The eUCP is a supplement to the Uniform Customs and Practice for Documentary Credits (UCP 500), which provides necessary rules for the electronic presentation of letters of credit. The eUCP was in force as of 1 April 2002, provided definitions to allow current UCP terminology to accommodate electronic presentation. And eUCP allows the UCP and the eUCP to work together. The eUCP covers matters like definitions of key terms such as electronic record, electronic signature, format, paper document, received. An eUCP must specify the formats in which electronic records are to be presented and if not, electronic records may be presented in any format. Electronic records may be presented separately and need not be presented at the same time. The Problems of eUCP are flexibility of format of electronic record, heavy burden on the side of negotiation banks, and the problems such as the number of presentation, the notice of completeness of presentation, no provisions in regard to the time to examine the electronic records.

      • 순결의 딜레마 : 셰익스피어의 Measure for Measure 와 판소리계 『춘향전』의 문화적 비교연구 a Cultural Comparison of Shakespeare`s Measure for Measure and Pansori Chunhyang Jeon

        This study is a comparative exploration of the eastern and western ideologies of chastity reflected in the literatures of two different societies, Renaissance England and 19th century Korea. The two heroines of this study, Isabella in Shakespeare's Measure for Measure and Chunhyang in the famous Korean P'ansori Novel, Chunhyang Jeon, both belong to the only legitimate group of single women in their respective societies where every women else were restrained under the surveillance of marriage institution: Isabella a (would-be) Catholic nun and Chunhyang a kisaeng, the Korean female entertainer. Despite their institutional rights of remaining unmarried, however, both Isabella and Chunhyang are forced to yield their chastity to the illicit desire of high male authority, and threatened to death, of her brother for Isabella and of her own for Chunhyang, if they refuse to. Thus, they face a dilemma of each own: whether Isabella has to disavow her religious pledge over her moral duty; and whether Chunhyang must give up her wifely duty to obey her class role. In order to understand the social and cultural implications underlying these dilemmas, this study examines the way in which the chastity ideology worked into other patriarchal institutions such as marriage and class system in Renaissance England and 19th century Korea. Eventually, the study will lead to the conclusion that no woman in any patriarchal society can ever be fully autonomous of her own sexuality.

      • 국제무역에서 전자식 선하증권의 법률적인 문제와 해결방안

        Many merchants are increasingly using computers to facilitate international transactions, and many observers believe that electronic commerce is nearing reality. At present, the buinsess community uses a system known as electronic data interchange(EDI). Because EDI is both quick and efficient, the shipping industry is expected to benefit greatly from its adoption, particularly in the areas of bills of lading, with the legal requirement of paper-based documentations. The purpose of this paper discusses the legal obstacles to use of EDI system for electronic bills of lading. In particular, problems concerning the function of paper bills of lading as negotiable documents of title and evidential documents of carriage contract. The first part of the paper covers the general aspects of electronic bills of lading in the maritime transport industry. Secondary, there is an legal problems raised in using bills of lading by electronic data interchange. The third part reviews some laws to facilitate the use of electronic bills of lading. Lastly, the paper considers some solutions to the problems which arise from the use of electronic bills of lading.
