Vol.24 No.2
This paper discusses the claim that the artist’s sanction has a decisive effect on the identity and the meaning of his or her work: the ‘Sanction Thesis’. The sanction is a public statement of the artist’s intention that determines the identity and the boundary of his or her work, which may include official or verbal contracts with the museum. The Sanction Thesis can be regarded as an application of the ‘intentionalist-nonintentionalist debate’, which is one of the main issues of the philosophy of criticism. The debate is about how and to what extent we can consider artist’s intentions in the interpretation and the evaluation of his or her work, or whether it is appropriate to consider it in the first place. The Sanction Thesis places a theoretical burden on the nonintentionalists, since considering that the artist’s sanction is ultimately a public expression of artistic intentions related to the creation and completion of his or her work, acknowledging that sanctions can determine the identity and meaning of a work at first glance amounts to acknowledge that the artist’s intention ultimately influences the meaning of the work. In this paper, I first clarify the position where the Sanction Thesis places in the intentionalist-nonintentionalist debate and introduce Sherri Irvin’s argument on it. Then, I point out the theoretical flaws of Irvine’s argument and suggest my own answers to solve them from a nonintentionalist’s viewpoint.
