특별기고 : 판례의 변경을 중심으로 살펴본 교수재임용제도

현재 우리 나라의 법률에 의하면 교수는 기간을 정하여 임용되며, 기간이 만료된 때 같은 학교에서 다시 임용되어야 그 신분을 유지할 수 있다. 과거 실무에서는 기간이 만료된 후 재임용되지 못한 경우 이에 불복하더라도 다툴 수 있는 방법이 없어, 제도 자체가 악용된 측면이 있었다. 그러나 대법원과 헌법재판소의 판례 변경을 계기로 하여 관련 법률이 개정되어 운용되고 있다. 이 논문에서는 과거 법률 및 그 해석에 어떤 문제가 있었으며, 대법원과 헌법재판소에서의 견해 변경이 어떤 쟁점에 대한 것이었고, 이를 관련 법률이 어떻게 반영하여 개정됨으로써 문제를 해결하였는지를 추적하였다. In the Korean law-system, professors are appointed by the limited terms; when their terms completed, professors could maintain the job through the reappointment at the same school. In the past, even though they had failed to get the reappointment and made and objection to the result, the way of claim was virtually none. Therefore, the reappointment system for professors was often misused. In 2003 and 2004, the Supreme Court and the Constitutional Court changed their views and the National Assembly revised the laws. The purpose of this study is to clarify the problems of the past laws and its interpretation, the issues in the change of the Supreme Court and the Constitutional Court, and the way of dealing with the issues to solve the previous problems through the progress of revision.

유치원 원장 대상 인성교육에 대한 모듈식 연수 프로그램의 개발

이 연구의 목적은 유치원 원장 대상 인성교육에 대한 모듈식 연수 프로그램을 개발하는 것이다. 교원의 인성교육 역량은 연구자에 따라 다양하게 제안되고 있음을 확인하였다. 아울러 유치원 원장 대상 인성교육 연수 프로그램이 개발되어야 한다는 필요성을 논의하였다. 중앙교육연수원에서 시행 하고 있는 유아교육 관리자 인성교육 연수과정의 강점과 약점을 분석한 결과 국내 유일한 유치원 원장 대상 인성교육 연수과정이라는 사실, 다양한 교육기관에로의 확대 시행의 필요성, 표준 연수 과정의 연구와 핵심 모듈 개발, 그리고 현업적용도 평가 시행 등이 시사점으로 도출되었다. 이 연구에서는 유치원 원장의 인성교육 리더십을 함양하기 위해서 인성교육 역량을 기반으로 하여 인성교육정책, 인성교육 지도 전략, 가정·지역사회와의 연계 방안, 그리고 유치원 현장 적용 실천 등 4가지 핵심 모듈을 구성하여 모두 20개 교과목을 제시하였다. 또한 연수담당자의 요구에 따라 15시간으로 편성된 3일 연수과정과 30시간으로 편성된 5일 연수과정을 구체적으로 제시하였다. The purpose of this study is to develop character education modular training programs for kindergarten directors. We have confirmed that the character education competency of teachers are variously proposed according to researchers. In addition, we discussed the necessity of developing a character education training program for kindergarten directors. And the strengths and weaknesses of the early childhood education manager training course conducted by the National Education Training Institute were analyzed. Four core modules such as character education policy, character education instructional strategy, linkage with home and community, and application of kindergarten field were presented. And 20 subjects in the training program were selected. In addition, we presented the 3-day training course organized in 15 hours and the 5-day training course organized in 30 hours.
