우리나라의 온실가스 배출 규모는 연간 8억 8천만 톤으로 전 세계 7위를 차지하며 매년 증가율은 OECD 국가 중 가장 높다. 기후변화의 주요 원인인 이산화탄소 감축 문제가 인류생존을 위해 불가피한 숙명적 과제가 되었다. 이를 계기로 미국, 캐나다 등 선진국에서는 CCS를 기존 유전사업, 자원사업 등의 연계선상에서 연구 및 실증 사업화하는 방향으로 나아가고 있어 중국과 일본 등도 기술종속국으로 전락하지 않기 위하여 CCS에 과감한 투자를 하고 있다. 이에 우리 정부도 ‘국가 CCS 종합추진계획’을 수립하여 대책마련을 위하여 노력하고 있으나 이러한 정책을 뒷받침하기 위한 법제는 아직까지 마련하지 못하고 있다. 본 논문에서는 이러한 문제점을 염두에 두고 먼저 CCS의 개념과 기술에 대한 개관, 해외주요국의 CCS 입법례 순으로 살펴본 후에 우리나라 CCS에 관련된 법률을 검토하고 바람직한 입법 방향 및 입법안의 골격을 제시하고자 한다. 요컨대, 개별법을 개정하는 것이 하나의 해결책이 될 수 있다. 그러나 CCS의 포집, 수송, 저장이라는 전 과정의 측면에서 볼 때 현존하는 개별법의 개정만으로는 한계가 있다. 따라서 통합된 CCS 단일법을 마련하는 것이 바람직하다. CCS 연구 및 개발의 성공적 연착륙을 위하여 국민들 사이에 대중소통을 구축하는 것 또한 대단히 필요하다. The amount of South Korean greenhouse gas emission is approximately 880 million tons a year as it ranks 7<SUP>th</SUP> in the world, and its annual rate of increase is the highest among OECD countries. Therefore, the average temperature of South Korea has risen about 1.7℃ resulting in damages by typical climate change, such as flood, drought, and ecosystem change. At this point, it is a fateful challenge of a country to reduce large scale of CO2 emission for human life. the largest task. To this end, the United States, Canada and other CCS advanced countries proceed research and demonstration projects in connection with an existing oil industry, and resources industry. Therefore, China and Japan make bold investments to CCS technology development projects in order not to be a failure in technology competition. Korean government also makes every effort to prepare for measures by formulating a ‘national comprehensive implementation plan on CCS’ but legislation to support these policies is not made yet. In this paper, bearing these problems in mind, this writer firstly give an overview of concept and technique of CCS and then legislative examples of major foreign countries such as United States, Canada and other advanced countries. In the end, this writer tries to examine Korean individual laws on CCS and then suggest direction of desirable legal framework on CCS and gist of CCS bill. In short, it is a solution to amend individual laws in order to resolve the conflicts between the individual laws that need an amendment. But there is limitation in amending existing individual laws in aspect of life cycle management of CCS. Accordingly, it is desirable to prepare for CCS unified single law. It is also very necessary to construct public understanding among people for successful soft landing of CCS Research and Development.
