중소기업 전략특허 개발에 관한 R&D PMMS 활용사례

경영환경의 글로벌화로 인하여 선도 기업들은 시장의 조기 선점을 위해 전략특허를 활용한 치열한 특허분쟁을 하고 있으나, 대부분의 중소기업들은 제품생산 활동을 우선시하는 정책으로 특허로 초래되는 위협적인 문제에는 아직까지 관심이 없는 실정이다. 본 연구는 이러한 위협적인 문제를 해결하기 위해 중소기업의 R&D 프로세스 매칭관리 시스템(PMMS: Process Matching Management System)을 활용하여 전략 특허권을 확보할수 있는 방안을 제시하였다. 본 사례의 분석결과는 두 가지로 요약될 수 있다. 첫째, 연구개발 초기단계부터 R&D 프로세스와 매칭으로, 핵심기술의 권리화에 중점을 두고 전략특허의 개발 및 출원이 양산단계 이전에 체계적으로 이루어지도록 하였다. 둘째, R&D 부문과 특허부문이 실무적 차원에서 융합함으로서, 전략특허의 개발 기간을 단축하도록 개선하였다. 본 연구의 한계점은 첫째, 전략특허를 선정하기 위한 기준이 되는 발명의 평가요소가 기업마다 다르기 때문에 평가요소의 표준화가 선행되어야 한다. 둘째, 중소기업의 특허전담조직의 미비로 인한 특허권의 부실에 대한 보완이 필요하다. 향후에는 특허업무를 담당할중소기업의 인력확보와 사업투자 대비 특허출원 규모에 대한 표본 데이터를 분석하는 정책적인 보완이 필요할 것으로 사료된다. In today``s global business environment, leading companies aim for the early domination of new markets with aggressive patent litigations based on strategic patents. However, Most small and medium sized enterprises (SMEs) focus more on production activities and are generally indifferent and oblivious to the threats incurred by competitors’ patents. To improve this type of environment, this study suggested a plan for acquiring powerful strategic patent rights based on the R&D Process Matching Management System (PMMS) for SMEs. The analysis result clarified two things. The study provided a system of developing strategic patents. The development of strategic patents proceeds concurrently with the R&D process from the initial stages, focusing on obtaining protection rights for core technologies. In addition, the R&D efforts and patent-related efforts were combined in a practical level so that the times expended for developing and prosecuting the strategic patents may be reduced. The first limitation of this study is that there was not enough standardizing work. Standardizing the factors for evaluating inventions is needed since different factors for each company serve as a criteria for selecting strategic patents for each company. The second limitation comes from inadequate patent-related departments in SMEs, where there is a difficulty in preventing insufficient property rights. In the future, the patent-related workforce in SMEs should be strengthened. Also, statistical data on the amounts of business investment and the numbers of patent applications need improvements for making policies.
