비정규노동자의 공적연금, 고용보험 미가입에 관한 한일 비교 연구

한국과 일본 양 국가 모두 비정규노동자의 사회보험 미가입문제가 사회적으로 심각하게 제기되고 있는데, 이런 비정규노동자의 사회보험 미가입 문제를 해결하기 위해서는 비정규노동자의 사회보험 가입에 영향을 미치는 요인을 구체적으로 살펴보는 것이 필요하다. 이를 위해 본 연구는 한국과 일본 비정규노동자의 사회보험 미가입에 영향을 미치는 요인을 사회보험적 요인, 노동시장적 요인으로 구분해서 살펴본다. 한국은 통계청에서 2005년 「경제활동부가조사」를 활용하고, 일본은 21세기직업재단(21世紀職業財團)이 조사한 「파트타임노동자실태조사(パ―トタイム勞動者實態調査)」 원자료를 활용한다. 분석결과 첫째, 한국과 일본 모두 사회보험 제도 설계가 비정규노동자의 사회보험 가입을 막고 있다. 한국은 고용계약기간에 따른 국민연금, 고용보험 가입제외 규정이 비정규노동자의 사회보험 가입에 영향을 미치며, 일본은 연소득 130만엔 이상이여야 후생연금에 가입할 수 있는 가입제외 규정이 비정규노동자의 후생연금 가입에 영향을 미친다. 둘째, 일본 비정규노동자의 저임금은 사회보험 가입에 영향을 미치지만 그 수준이 미미한 반면, 한국의 비정규노동자의 경우 저임금·고용불안 특히, 고용의 지속가능성이 연금·고용보험 미가입에 중요한 영향을 미친다. 따라서 일본의 경우 사회보험 의무가입대상 비정규노동자의 10%정도만이 사회보험에 미가입 되어 있는 등 불법적인 기여회피가 거의 없음에도 불구하고 비정규노동자의 상당수가 후생연금에 가입되지 않은 점을 고려해볼 때, 한국 정규노동자의 사회보험 미가입문제를 해결하기 위해서는 사회보험 관리운영체계의 개편뿐만 아니라 고용계약기간에 따른 보험 가입제외규정을 완화할 필요가 있다. 또한 한국 비정규노동자의 불법적인 기여회피의 중요한 요인이 고용불안에서 발생한다는 점에서 노동시장에서의 고용안정성을 높이는 노력뿐만 아니라 사회보험제도에 `고용 크레딧`제도 도입을 검토하는 것이 필요하다. It is important to solve the problem that the nonstandard workers were not covered by the public pension and the unemployment insurance. To solve this problem, it is necessary to know why the nonstandard workers were not covered by a public pension and a unemployment insurance. So, the purposes of this article is to analysis the reason of nonstandard worker`s un-affiliation to public pension and unemployment insurance in Korea and Japan. The results are first, the reasons of that nonstandard workers were not covered by public pension and unemployment insurance is because of the frame of social insurance. The Part-time workers and the day workers were not covered by the law of public pension and unemployment insurance in Korea and Japan. The results are second, the reasons of that nonstandard workers were not covered by public pension and unemployment insurance is because of that nonstandard worker are located in precarious labor market. So First, To solve this problem of nonstandard worker`s un-affiliation to public pension and unemployment insurance, reformations of public pension and unemployment insurance are necessary. So to relax of the rules that it is need to be covered by the public pension and unemployment insurance are necessary. Second, introduction of `work credit` for nonstandard worker is necessary.
