우리나라는 국민들이 흘린 땀과 노력으로 짧은 기간에 세계에서 유래를 찾아볼 수 없는 경제적 발전을 이루었다. 이와 같은 경제성장은 물질적 풍요와 삶의 질을 향상시키기도 했지만, 3D업종에 대한 기피현상으로 생산현장의 노동인력 부족을 심화시키고 고령화 사회를 촉진하는 등 많은 부작용을 초래하게 되었다. 교통·통신의 발달과 더불어 위와 같은 국내의 사회, 경제적 여건으로 인해, 90년대부터 중국·동남아 등 외국인들의 국내 유입이 가속화되면서 국내에서의 각종 외국인 범죄 발생도 급속히 늘어나게 되었다. 법무부에서도 늘어나는 외국인 수용자들의 효율적인 관리와 처우의 전문화를 위해 대전과 천안 및 청주여자교도소를 외국인 전담교도소로 지정하여, UN「피구금자 처우에 관한 최저기준규칙」을 비롯한 각종 국제준칙에서 요구하고 있는 수준에 맞게 외국인 수용자 관리와 처우에 만전을 기하기 위해 노력해 오고 있다. 그러나 내국인 수용자와는 달리 외국인 수용자들은 교정시설 내에서 언어소통의 곤란, 외부교통권 행사의 어려움, 음식물, 종교, 생활습관 및 문화 등의 차이를 극복하는데 적잖은 고충을 겪고 있다. 본 연구에서는 설문서 분석을 통해 위와 같은 외국인 수용자의 신분상 특수성과 사회·문화적 차이에서 오는 수용생활 적응의 문제점을 파악하여 이를 효율적으로 극복하기 위한 관리 방안을 제시하고자 노력하였다. 특히 외국인 수용자의 관리와 처우에 있어서 내국인 수용자와 대등하게 인권과 권리가 보장되고, 수용생활 과정에서 어떠한 불이익도 일어나지 않도록 세심한 배려가 필요할 것이다. 교정시설에서 교정교화를 위한 작은 노력이 출소 후 선량한 시민으로서의 성공적인 사회복귀와 건전하고 올바른 삶을 살아갈 수 있는 밑거름이 되리라 믿는다. As an exchange of human resources between countries has become very active from 1990's, the traditional meaning of 'national border' has been fading. The rapid growth of national economy affected people's attitude toward jobs in a way that they have a tendency of avoiding ‘3D’ (Difficult, Dangerous, Dirty) industries and also the country has faced a shortage of workers due to a rapidly aging population and low birth rate. That's the reason why the country accelerate its 'Open Boarder Policy' for foreign workers. The number of foreigners pursuing 'Korean Dream' has been increasing rapidly after the 'Open Boarder Policy' gave more chances to foreign workers to make money in the country. And, at the same time, the number of illegal entrants keeps increasing. Some of them has found it difficult to adjust to Korean society. Their maladjustment in the society contributed to one of the main reasons of various crimes committed by foreigners, and, nowadays, it has become a serious issue in the society. The purpose of this study is to suggest various solutions for the effective treatment and management of foreign inmates with a fair manner in comparison to native inmates. To accomplish this purpose, the survey in this study is focusing on finding out the way to overcome their handicaps derived from different cultures, lifestyles, diets, languages, and the restrictions derived from their status as foreigners. Based on the survey with questionnaires which is written in Korean, English, and Chinese, most of the foreign inmates turned out to be typically satisfied with communication, diet, religious activity and very interested in earnings of prison work and international transfer of prisoners. It believes this survey will help improve the treatment and management of foreign inmates in our system when the solutions suggested will be reflected in a government policy. Finally, we should really try to make fairer treatment for inmates, regardless of their nationalities; it is time for all of us to have consistent interest and concern for their successful rehabilitation.
