일본의 데이트 폭력 문제와 예방에 관한 검토

최근 연인 간에 발생한 데이트 폭력이 심각한 사회적 문제로서 논의되고 있다. 더욱이 데이트 폭력은 그 자체에 대한 일반인 및 당사자들의 인식이 낮고, 게다가 데이트 폭력을 경험하고도 결혼에 이르는 경우도 있어 가정 폭력 및 아동학대 등으로 연결된다는 점에서 더욱 심각한 문제를 발생시키고 있다. 또한 일반적으로 연인 간의 데이트 시기에는 폭력이 거의 발생하지 않으리라는 생각과는 달리, 최근 한국여성의전화에서의 데이트 폭력에 관한 조사 결과 및 경찰청의 집중 신고기간 운용 결과와 같이 데이트 관계에서 상당한 정도의 폭력적 행동이 발생하고 있다는 점에서 데이트 폭력에 대한 정확한 인식과 이에 대한 적절한 대응방안을 검토하는 것은 매우 유의미한 것이라 할 수 있다. 예를 들어, 배우자 폭력과 데이트 폭력은 동일한 구조를 가지는데 친밀한 사람에 대한 폭력(학대)이라는 점이 그러하며, 그 관계성에 있어서 상하, 우열, 주종의 관계를 만들어 폭력을 통해 약자(피해자)에 대한 지배(집착)를 목적으로 한다. 이러한 지배(집착)적 행위는 신체적 폭력이외에도 정신적, 성적, 경제적, 사회적(통제적) 폭력 등 다양한 종류로 분류되며, 개별적으로 이루어지는 것이 아니라 대부분 복합적으로 발생하기 때문에, 이로 인하여 폭력이 점진적으로 악화된다는 점에서 각각의 폭력에 대한 과소평가를 경계해야 한다. 따라서 적절한 예방교육 및 피해상담의 중요성이 강조되고 있다. 이러한 논의 과정 속에서 본 논문에서는 보다 효과적인 정책추진 및 입법적 대응을 위하여 일본의 데이트 폭력 실태와 예방조치에 관한 비교 검토를 통해 그 시사점을 모색하고자 한다. In recent years, dating violence has become a social problem beyond a private issue. The results of various articles and statistics proves this. Dating violence is defined as the perpetration or threat of an act of violence by at least one member of an unmarried couple on the other member within the context of dating. This violence can take a number of forms: sexual assault, sexual harassment, physical violence, verbal, mental, or emotional abuse. It is also when one partner tries to maintain power and control over the other through violence. And even though without self-awareness, we can be a assailant or victim. Dating violence is easy to think that the violence between the dating relationship is not real violence. Unfortunately, about the seriousness of dating violence in South Korea, the recognition is not enough to prevent dating violence. In addition, among the various violence factor, like domestic violence, dating violence has a high possibility of a second damage. Dating violence is more serious than other violence, because sometimes the violence lasted owing to maintenance of relation after the damage occurrence. Moreover, the necessity of police intervention increase in that petty violence may develop into more serious crimes(rape or murder). But police involvement is not enough to solve this problem. Therefore a change in the social awareness through prevention policy and education about the dating violence is required to protect the victim(women). For now, though, there is no proper legal basis to make it possible to intervene in dating conflicts before they escalate to violence crimes. In South Korea there is not yet legislative measures about dating violence and stalker, revenge porn. On the other hand, Japan enacted or amended the so-called ‘Anti-Stalking Act’, ‘Act on the Prevention of Domestic Violence’ and ‘Anti-Revenge Porn Law’ to tackle dating violence problems. Also, its Japan government, and a growing number of schools(university) nationwide are committed to increasing awareness of young people's dating violence by educating the public about healthy relationships. In addition, this makes it possible to identify the accurate situation of dating violence, which is a meaningful proactive approach in that it minimizes the problems of police intervention and misuse. In this respect the prevention policy to deal with dating violence in Japan can be an reference in establishing prevention policy in South Korea.

This study aims to explore the risk factors for each development stage and to analyze the importance of the risk factors as the first step for risk management of the Small and Medium-sized Buildings development project. To this end, the AHP analysis methodology was implemented as a part of increasing the objectivity and reliability of the survey, and the Fuzzy-AHP methodology was used to correct the calculated survey results. According to the results of the empirical analysis of relative importance, it was analyzed that the project preliminary validity stage is the most important in the importance of each development stage. According to the results of the Fuzzy-AHP corrected overall importance, the error in reviewing the market survey (property of building location, sales price and rent of similar buildings, regional status) was analyzed as the most important factor. Failure to construct MD for maximization of rental income due to insufficient analysis of commercial districts around the target site, miscalculation of business profits when development is completed due to the derivation of the business size and balance analysis due to errors in planning design, and problems with compensation, and overall construction management of real estate asset management companies (project cost execution, construction process, out-of-the-box management), etc., and the results were similar to the AHP overall ranking chart.

딥페이크(Deepfake) 영상물에 관한 법적 대응조치 검토

최근 미성년자를 포함한 성인 여성들의 성착취 영상을 SNS를 통해 공유 및 판매한 ‘n번방 사건’이 사회적으로 큰 물의를 일으키면서, 이들이 벌인 여러 범죄 가운데 인공지능(AI) 기술을 활용한 ‘딥페이크(deepfake) 영상물’이 디지털 성범죄로서 심각한 문제가 되고 있다. 또한, 최근 저명인사의 딥페이크 영상물이 유포되면서 딥페이크가 가짜뉴스의 위협을 더욱 증가시킬 수 있음에 우려가 커지고 있다. 이러한 딥페이크 영상물에 대한 논란은 우리에게 한정되지 않고 전 세계적으로도 확산되고 있다. 주지하는 바와 같이 딥페이크는 딥러닝(Deep learning) 기술을 통해 특정 영상에 특정 인물의 얼굴, 음성 등을 합성한 영상물이 실제 사람들에게 허구의 말과 행동을 하는 것을 보여주는 것이다. 문제는 ① 딥페이크 영상물이 컴퓨터그래픽 기술에 인공지능 기술이 가미됨에 따라 더욱 손쉽게 제작할 수 있다는 점과 ② 이렇게 공유된 딥페이크 영상물을 완전히 필터링할 수 없다는 점, ③ 정밀하게 합성된 딥페이크 영상물로 인해, 가짜뉴스 등이 대중을 오도할 위험이 있는 수단으로 떠오른 점, ④ 더욱이 한번 인터넷상에 공유된 이상 완전히 삭제되지 않아 피해자가 계속 피해를 받아야 한다는 점 등이다. 이렇듯 실제와 구분이 힘들 정도로 자연스러운 영상 구현이 가능한 딥페이크 기술이 온라인상에 범람함에 따라 이를 이용한 음란물(딥페이크 포르노 등)이나 가짜뉴스 생산 등 대중을 오도하거나 사회적 혼란을 야기하는 악용사례에 대한 우려 또한 높아지고 있다. 이에 대하여 현재 형법상 명예훼손, 모욕죄, 업무방해죄, 사기죄나 정보통신망법상 허위사실적시 사이버명예훼손죄 및 사이버 음란물유포죄, 성폭력처벌법상 허위영상물 등의 반포 등 처벌, 선거사범의 경우에는 허위사실공표죄로서 대응하고 있으나, 사후적 대응에 그치므로 보다 선제적으로 피해를 최소화할 수 있는 다양한 방안들에 대한 검토도 요구된다. The term ‘deepfake’ describes a face-swapping technique, whereby images of an individual are used by artificial intelligence (AI) technology to generate digital doppelgangers (look-alikes) and then superimposed onto different bodies. Deepfakes generated with only one source image are often obvious as fakes, but those generated with thousands of images or video clips can be very realistic. Recently while media, politicians, and technologists panic over the risk of deepfakes impacting elections, a new study has found that the vast, vast majority of deepfakes are pornographic in nature. On top of that, to the surprise of absolutely no one, all of the pornographic deepfakes analyzed in the study exclusively targeted women. In addition the harm posed to individuals and companies are no less important to consider, and include false endorsements, fraudulent submissions of documentary evidence, loss of creative control over audiovisual content, extortion, harassment and reputational damage. In this way, deepfakes pose many potential systemic socio-political risks such as manipulation of civil discourse, interference with elections and national security, as well as the erosion of trust in journalism and public institutions more generally. Therefore, it is necessary to have a attitude to establish a predictable level of the response system and to develop a gradual step-by-step legal policy plan within a long-term framework.
