본 논문은 복합적 문제에 대한 대처가 필요한 현대 공공정책 거버넌스에 있어서 연성법의 중요성에 착안하여, 한국 이주노동자 문제를 사례로 그 구체적 활용 현황을 살펴본다. 이를 통해 현실적 맥락에서 연성법의 기능과 개선이 필요한 과제를 도출하여 비구속적 수단을 활용한 공공정책 거버넌스에 대한 한정적 함의를 도출한다. 이 사례에서는 인권, 경제, 사회의 영역에 걸친 복잡한 문제에 대해 선언적 법률조항이나 노력목표, 업무지침 그리고 이를 이행하기 위한 행정계획, 위탁규정, 우수사례집, 정책평가 등 많은 연성법이 도입되어 문제 개선에 직·간접적으로 기여했다고 본 다. 사례 관찰을 통해 연성법의 활용을 촉진하여 효과적인 공공정책 거버넌스를 구현하기 위해서는 사업운영의 투명성이나 전문성 제고, 지역 네 트워크 확대 등 현장 행위자의 내부통제능력의 강화와 법적 구속력 없는 다양한 도구와 장치를 목표규정, 실천규정, 조정규정으로 조화롭게 조합하 는 입법기술의 향상이 중요한 과제임을 지적한다. The paper reviews how the soft law instruments improved the multiple problems of foreign migrant workers in South Korea. The case includes a variety of non-binding instruments such as declarative articles, guidelines, administrative plans, best practice samples, policy evaluation tools, regulations for contracting out. Through a close look at the operative process of these instruments, the paper points out that these were especially helpful in improving the specific types of problems which are difficult to manage by hard law system; the mitigation of overall social discrimination and development of multicultural society, the freedom of return, the right of family union, support for undocumented workers and so on. Finally, the paper concludes with two remarks for the effective operation of soft law instruments. First, the sound internal governance of the local actors, such as NGO and local governments, is a necessary pre-condition for carrying out public collaborative projects with governmental bodies. Second, the competence of soft law system can be improved when the various instruments are well-organized along with the three functions; mission or objective statement, operating regulations and steering rules or guidelines.
