The purpose of this study aims to analyse the security and lien action of the general average related to the Somali pirates with the Lehmann Timber Case. The owners'vessel Lehmann Timber was captured by Somali pirates on or about 28 May 2008 during her maiden voyage and eventually released following the payment of a ransom by the shipowners. She was released after 42 days, and she sailed for Salalsh in Oman as a port of refuge on 8 July 2008. Whilst en route the Vessel suffered a main engine breakdown on or about 12 July 2008, and had to be towed into port, where she arrived on 21 July 2008. The shipowners declared general average and exercised a lien over the cargo to secure payment of the cargo interest' general average contribution. The arbitrators awarded the shipowners the storage and other costs incurred in exercising that lien, but the Commercial Court reversed this decision and found in favour of the cargo receivers.

벤처기업의 리더십 유형과 팔로워특성, LMX의 질이 조직성과에 미치는 영향

본 연구의 목적은 거래적ㆍ변혁적 리더십 모델을 사용하여 리더십의 영향력을 받고 있는 팔로워가 인지한 리더십의 유형과 팔로워 자신이 가지고 있는 팔로워의 특성이 조직성과에 미치는 영향에 대해 알아보고, 더 나아가 리더-구성원 교환관계(Leader-Member Exchange: LMX)의 매개 효과에 대하여 검증하는 데 있다. 이를 위한 실증연구의 대상인 창업초기의 벤처기업의 경우 실질적인 리더가 분명하고 조직구조의 규모가 소규모로 구성되어 있기 때문에 리더십의 영향력을 파악하는 데 좋은 표본이 될 수 있을 뿐만 아니라, 각 팔로워들의 핵심역량이 그 벤처기업의 성공여부를 가늠하는 데 중요한 지표가 되기 때문에 리더십의 영향력을 파악하는 데 좋은 표본이 될 수 있을 것이다. 본 연구에서는 실증연구에 들어가기에 앞서 리더십과 팔로워십, LMX의 질에 대한 이론적 논의를 위해 선행연구결과를 토대로 가설을 설정하고 연구모형을 제시한다. This study is aimed at understanding effects of the type of leadership recognized by the follower who is under its influence and the follower’s characteristics on the organizational performance using transactional and innovative leadership model and furthermore at verifying intervening effect of Leader-Member Exchange (LMX). In case of venture businesses in the earlier stage which are targets of verification study for this, as they have clear practical leader and the size of their organizational structure is small, they can be good examples for understanding leadership’s influence. Besides, key capacity of each follower becomes an important indicator to measure whether a venture business will succeed or not, therefore they can be good examples for grasping leadership’s influence. Prior to starting verification study, this study sets up hypotheses and provide study models based on results of preceding studies for theoretical discussions regarding quality of leadership, followership and the LMX.
