공무상 재해에 대한 보상차등화 모형에 관한 시론적 연구

공무원 연금제도 등 공직복지에 대한 논란이 지속되고 있는 가운데, 공무상 재해판정의 비합리성 문제가 지속적으로 제기되고 있다. 공무원의 업무상 질병, 부상 등의 재해발생은 공무원의 수행업무에 따라 각종 사고의 발생상황과 질병의 형태가 다르다. 그럼에도 공무상 재해여부를 판단할 때 공무가 어느 정도 재해발생에 기여했는지, 공무원의 과실은 어느 정도 있는지, 공무수행 중 신체적 위험에 노출되는 정도는 어느 정도 인지와 관계없이 전체인정제도 형태인 전부 아니면 전무 원칙의 판단으로 공무상 재해 인정여부가 결정되어 급여수급을 전액 받거나 혹은 전액을 받지 못하는 경우가 발생되고 있다. 이에 따라 공무상 재해보상 결정에 문제를 제기하는 이의신청이 지속되고 있으며, 재해보상제도의 합리성, 형평성, 적정성 등에도 논란의 소지가 있다. 따라서 본 연구에서는 공무기인정도와 위험노출정도 그리고 본인과실정도 등에 따라 공무상 재해 여부를 판단하는 부분인정제도 형태인 보상차등화의 가능성을 전제로 ① 5단계 차등모형, ② 5단계 발전모형, ③ 다변수 평가모형, ④ 매트릭스 응용모형, ⑤ 방사형 그래프모형 등 5가지의 재해보상 차등화 모형을 개발하고 제시하였다. The occurrence of disasters such as injuries and diseases due to occupational cases of public official is different in situation of various accidents and the form of disease and it depends on the performance of officials. Nevertheless, whether it is official disaster or not doesn't depend on following three criterions. First, how many works contributed to the occurrence of disaster. Second, how many mistakes were made by official and Third, how much they were exposed to physical harm during the performance of public work. Government judge the occurrence of disasters as the principle(consisted the full reference system) of all or nothing. Therefore, there exist the case that suffered officials receive the full wage or nothing. Accordingly, It has continuously raised formal objections about the decision of compensation for official disaster and the disaster compensation system has many controversial questions about rationality, equity and propriety. For this reason, 5 concepts of differentiated model of compensations for disaster were developed and proposed in this study. ➀ 5 stages of differential model. ② 5 stages of development model. ③ multi variate evaluation model. ④ matrix applied model ⑤ radial graphical model. They are based on the possibility of differentiated compensation. It is the partial reference system that decided by degree of the commitment for public works, danger exposure, negligence of officials.
