고교(고등교육기관의 총칭) 학생 관리 법치화는 고교가 법에 따라 학교를 관리하는 전략과 과학발전을 관철하는 필연적인 요구이다. 중국 법치국가(依法治国) 전략의 추진에 따라 사회주의 법치이론이 끊임없이 사람들의 마음속에 깊이 파고들고 있고, 각 사업에서 법치화의 요구를 수행하는 것은 이미 필연적인 추세가 되었다. 고교 학생 관리 사업은 고등교육 사업의 중요한 구성부분이며, 고교 학생 관리 사업의 수준이 고교의 인재 양성의 질과 관계가 있다. 고교 학생 관리의 법치적 사고는 고교 관리자들이 법치의 사상 · 원칙과 방법을 활용하여 학생의 교육 관리 활동을 지도하고 교육 관리에서의 관련 갈등과 곤경을 처리할 것을 요구함으로써 교육 · 관리와 서비스 등 측면의 법치화를 실현하며, 따라서 현대 법치정신이 고교 학생관리의 구체적인 실무에 침투하게 하고, 더 나아가 법치방식에 기초한 다원적 통치주체의 합동적인 관리 요구에 도달하여 고등교육의 기능과 목표를 실현한다. 중국고교 환경 발전 변화의 새로운 시기에는 고교 학생 관리 업무의 복잡성이 갈수록 커지고 사회성이 끊임없이 부각되는 등의 요인으로 인해 고교 학생 관리 제도에서의 인성화 · 민주화 · 법치화 · 소양화의 관리 방법의 폐해가 드러나고 있으며, 이것은 우리로 하여금 과거의 고교 학생 관리 제도의 합리성을 다시 검시하고, 고교 학생 관리의 제도적 기능을 재정의하여 발휘하지 않을 수 없게 됐다. 이에 따라 고교학생 관리 업무의 실천에서 드러난 문제점들에 근거하여 고교 학생 관리의 법제화 · 민주화 제도 시스템 구축을 강화하고 제도 관계를 분명히 하여 고교 학생 관리 제도의 적기 변혁을 추진해야 한다. 이에 대해 본 연구는 중국 고교 학생관리 법제화 제도의 구축이 인본주의(以人为本)의 이념을 세우고 유연화된 학생 관리 메커니즘을 형성하여 권력의 효율적인 배치를 보장하며, 동시에 학생의 자각 의식의 향상을 중시해야 한다고 여긴다. The rule of law of university students is an inevitable requirement for universities to implement the strategy of governing the school according to law and scientific development. With the development of China's strategy of governing the country according to law, the theory of socialist rule of law has been deeply ingrained in the people's hearts, and it has become an inevitable trend to implement the demand for the rule of law in all kinds of work. The management of students in universities is an important part of higher education, and the management level of students in universities has a bearing on the quality of nurturing people. The thinking of the rule of law in the management of students in universities requires the university management workers to use the ideas, principles and methods of the rule of law to guide the students' educational management activities and deal with the related contradictions and difficulties in the management of education so as to realize the rule of law in education, management and so on. Thus, the modern rule of law permeates into the concrete practice of university students' management, and then meets the requirement of the coordinated governance of the multi-governance subject based on the rule of law, so as to realize the function and goal of higher education. In the new period of the change of the environment of university in China, the increasing complexity of the management work and the social character of university students make the malpractice of humanism, democratization, rule of law and quality management system manifest, which makes us have to reexamine the rationality of the management system of university students, redefine and activate the function of the system of university students management system. In view of this, we should strengthen the legalization of student management in universities, establish democratic system, clarify system relationship and promote timely change of student management system in colleges and universities. On the basis of this, this paper argues that the establishment of the system of legalization of students in China's universities should establish the human-centered concept, form a flexible management mechanism, ensure the efficient distribution of power, and pay attention to the promotion of students' consciousness.
