좋은 논문 쓰기 : 법사회학적 방법론을 중심으로

좋은 논문을 쓰는 것은 학문활동에서 가장 중요한 일 중 하나이지만 연구자가 과연 무엇이 좋은 논문인지, 좋은 논문이란 어떻게 써야 할 것인지에 대해서 분명히 인식하지 못하는 경우가 종종 있습니다. 이러한 인식을 기초로 BK 21 법을 통한 사회적 갈등관리 연구팀은 미국의 법사회학자 테렌스 할리데이(Terence Halliday)교수를 초청하여 ‘좋은 논문쓰기’에 관한 워크샵을 개최하였습니다. 이 워크샵은 사회과학의 시각에서 좋은 논문으로 평가되는 연구의 특징과 방법론을 자세히 살펴보기 위한 것으로, 향후 BK21 연구팀의 학술활동에 큰 도움이 될 것으로 기대합니다. 이 워크샵에서 할리데이교수는 미국 법사회학회(Law and Society Association)에서 우수논문상을 수상한 세 편의 논문들의 연구방법론과 학문적 기여도, 바람직한 글쓰기 등을 검토함으로써 좋은 논문의 구체적인 예를 제시하였습니다. 좋은 논문에 대한 할리데이교수의 설명과 이에 대한 참석자들의 질문과 토론, 평가를 통해 연구자들은‘학술적으로 가치가 있는 논문을 어떻게 쓸 것인가?’에 대한 밑그림을 그려볼 수 있었습니다. 또한 법사회학적 방법론에 입각한 논문을 공부하면서 미시적인 해석론에서 벗어나 거시적인 시각에서 법률적 쟁점을 파악하는 방법론을 배우는 기회가 되었습니다. 적절하고 효율적인 연구방법의 설계와 검증을 통해 새로운 시각을 제시함으로써 좋은 논문으로 선정된 세 편의 연구논문 요지와 워크샵의 내용을 정리하여 게재합니다.

Creating the Conditions for Peace in Korea: Promoting Incremental Change in North Korea

This article examines the vexing problem of bringing peace to Korea. Success will require fundamental change to the North Korean regime and its behavior. However, North Korea faces a dangerous security environment with external and internal threats making regime survival its chief goal. Consequently, North Korea’s strategic world view is firmly anchored in the international relations theory of realism. Increased pressure makes it more difficult for North Korea to move beyond the constraints of realism and the North’s collapse would create even more serious problems for the region. This paper argues that a long-term, three-prong approach by South Korea, the United States and others in the region may be the best way to create the foundation for peace: diplomatic engagement that begins to reduce North Korea’s security concerns; economic engagement to open up the North Korean economy to encourage forces within to push for change; and continued military preparedness as a hedge to ensure stability.

South Korea, Foreign Aid,and UN Peacekeeping:Contributing to International Peace and Security as a Middle Power

For many years, South Korea was largely a consumer of security,protected and supported by the United States and others to ensure peace and stability on the peninsula. South Korea’s economic takeoff and ascent as a rising middle power has changed these circumstances and as the years progressed, the Republic of Korea increased its contributions to international peace and security becoming more of a provider of global security than solely a consumer. Two areas where South Korea has made particularly important contributions have been in international development assistance and peace keeping operations. Though these contributions are significant, South Korea continues to lag behind other foreign assistance donors relative to the size of its economy. Yet, South Korea’s increases to development assistance have been substantial and larger than most in the midst of the global economic turmoil, and it remains a staunch supporter of peacekeeping operations.

Ocean Park Hong Kong: The Risen Dead Miracle of Hong Kong

The purpose of this study is to identify the strategies that Ocean Park used to face different kinds of threats and challenges, and discover the success factors that transformed the park from a local theme park with little global vision and recognition into one of the most popular amusement parks in the world. The major challenges include the Financial Crisis in 1997, the closure of Water Park in 1999, the outbreak of SARS in 2003 and, most critically, the emergence of Hong Kong Disneyland in 2005. Based on our analysis on relevant data, we found that the key success factors of Ocean Park are speedy repositioning and flexible in coping with major challenges by adopting relevant strategic actions such as (1) redefining the market position, (2) adding innovative attraction, education, and charity programs, (3) creating effective social cause marketing with UNICEF, and (4) committing to major redevelopment programs. We believe that Ocean Park will have great development and performance if it maintains these factors. Hopefully, this study will be useful in understanding and exploring the success of a theme park or a business in Hong Kong.

A summary of the Malaysian Clinical Practice Guidelines on the management of postmenopausal osteoporosis, 2022

Objectives: The aim of these Clinical Practice Guidelines is to provide evidence-based recommendations to assist healthcare providers in the screening, diagnosis and management of patients with postmenopausal osteoporosis (OP). Methods: A list of key clinical questions on the assessment, diagnosis and treatment of OP was formulated. A literature search using the PubMed, Medline, Cochrane Databases of Systematic Reviews, and OVID electronic databases identified all relevant articles on OP based on the key clinical questions, from 2014 onwards, to update from the 2015 edition. The articles were graded using the SIGN50 format. For each statement, studies with the highest level of evidence were used to frame the recommendation. Results: This article summarizes the diagnostic and treatment pathways for postmenopausal OP. Risk stratification of patients with OP encompasses clinical risk factors, bone mineral density measurements and FRAX risk estimates. Non-pharmacological measures including adequate calcium and vitamin D, regular exercise and falls prevention are recommended. Pharmacological measures depend on patients’ fracture risk status. Very high-risk individuals are recommended for treatment with an anabolic agent, if available, followed by an anti-resorptive agent. Alternatively, parenteral anti-resorptive agents can be used. High-risk individuals should be treated with anti-resorptive agents. In low-risk individuals, menopausal hormone replacement or selective estrogen receptor modulators can be used, if indicated. Patients should be assessed regularly to monitor treatment response and treatment adjusted, as appropriate.

Review : Colonic Migrating Motor Complexes, High Amplitude Propagating Contractions, Neural Reflexes and the Importance of Neuronal and Mucosal Serotonin

The colonic migrating motor complex (CMMC) is a critical neurally mediated rhythmic propulsive contraction observed in the large intestine of many mammals. It seems to be equivalent to the high amplitude propagating contractions (HAPCs) in humans. This review focuses on the probable neural mechanisms involved in producing the CMMC or HAPC, their likely dependence on mucosal and neuronal serotonin and pacemaker insterstitial cells of Cajal networks and how intrinsic neural reflexes affect them. Discussed is the possibility that myenteric 5-hydroxytryptamine (5-HT) neurons are not only involved in tonic inhibition of the colon, but are also involved in generating the CMMC and modulation of the entire enteric nervous system, including coupling motility to secretion and blood flow. Mucosal 5-HT appears to be important for the initiation and effective propagation of CMMCs, although this mechanism is a longstanding controversy since the 1950s, which we will address. We argue that the slow apparent propagation of the CMMC/HAPC down the colon is unlikely to result from a slowly conducting wave front of neural activity, but more likely because of an interaction between ascending excitatory and descending (serotonergic) inhibitory neural pathways interacting both within the myenteric plexus and at the level of the muscle. That is, CMMC/HAPC propagation appears to be similar to esophageal peristalsis. The suppression of inhibitory (neuronal nitric oxide synthase) motor neurons and mucosal 5-HT release by an upregulation of prostaglandins has important implications in a num -ber of gastrointestinal disorders, especially slow transit constipation.

The aim of this study is to identify different impressive strategies that Kweichow Moutai Company Limited (Kweichow Moutai) has implemented to counter various difficulties and obstacles, but also scrutinizing reasons that made Moutai as successful as the “National Liquor” of China. The path of Kweichow Moutai was not all plain sailing. In fact, they have faced many hardships along the way. Nevertheless, they still persevered with their business and overcame hurdles blocking their success. Although the anti-corruption campaign in 2013 has beaten the whole spirit industry, Kweichow Moutai has managed to maintain their position and become one of the World's 500 Most Influential Brands recently. Actually, their success in overcoming the hard times can be attributed to their timely and appropriate strategies and decisions, such as 1. Price Reduction, 2. Rebranding and Expanding the Market, 3. Enriching Product Mix and 4. Setting up E-commerce and Establishing Global Cooperation. We envision Moutai to be the best liquor brand soon, supported by their continuous improvements, strategic policies, and product quality as well as rarity. We hope our research will be useful to all companies in Asia under abrupt political changes.
