        형사소송에서 피고인의 증거동의와 철회가능 여부- 대법원 2019. 3. 28. 선고 2018도13685 판결 -

        In the Criminal Procedure Act, the principle of trial-centeredism restricts the introduction of various kinds of records or professional evidence of investigative agencies submitted outside the courtroom. However, there is a limit to reviewing all materials at the trial. In Article 318(1) of the Criminal Procedure Act, the parties are required to confirm whether or not they agree to make the data available as evidence for the efficient progress of the trial before the attack and defense. This means that proceed with the proceedings efficiently by making the testimony possible by confirming the consent of the parties prior to the proceedings and to the court will summon the original testimony as a witness only to the evidence without consent. However, evidence agreement can lead to the loss of the opportunity to discover the substantive truth by giving up confrontation to the expert evidence without evidence. Therefore, it is necessary to pay attention to the consent of the evidence. Evidence of consent already made can be withdrawn in principle, but there are conflicting views on the timing and conditions. In this paper studied the time allowed for withdrawal of consent, the interpretation of consent and implied consent, the cancellation by mistake, the evidence of illegal collection, the legal fiction of withdrawal of consent and withdrawal based on the Supreme Court recently sentenced to March 28, 2019. The court’s ruling is appropriate because the accused can not cancel due to his mistake and the accused's withdrawal of consent is possible until the investigation of the evidence is complete. 형사소송법에서는 공판중심주의의 원칙상 공판정 외에서 수집된 수사기관의 각종 조서 또는 전문증거의 유입을 제한하고 있다. 그리고 공판정에서 모든 자료에 대하여 신문, 검토하는 것은 한계가 있다. 제318조 제1항에서는 재판의 신속한 진행을 위해 공판심리 이전에 당사자에게 해당 자료를 증거로 함에 동의하는지 여부를 확인하도록 규정하고 있다. 이는 증거조사절차에 앞서 당사자에게 동의 여부를 확인함으로써 공판정에서 동의가 없는 증거에 한하여 원진술자를 증인으로 소환, 신문하게 함으로써 반대신문권을 보장하고 재판 과정을 효율적으로 진행하려 함이다. 그런데 증거동의는 증거능력 없는 전문증거에 대하여 반대신문권을 포기함으로써 실체적 진실을 밝혀낼 수 있는 기회를 놓쳐버리는 결과를 초래할 수 있으므로, 당사자의 의사표시는 신중해야 할 필요가 있다. 이미 행한 증거동의도 원칙적으로 철회가 가능하나, 그 시기나 조건 등에 관하여는 견해가 대립하고 있다. 본 논문에서는 최근 선고된 대법원 2019. 3. 28. 선고 2018도13685 판결을 중심으로 증거동의 철회의 허용시기, 변호인 동의와 묵시적 동의에 관한 해석, 착오에 의한 취소, 위법수집증거에 대한 동의 가부, 증거동의의 의제와 철회 여부 등에 대하여 검토하여 보았다. 증거동의의 철회는 증거조사완료시까지가 적절하며 본인의 귀책사유로 인한 착오에 의한 취소가 가능하지 않다는 점에서 항소심에서 피고인의 증거동의 철회는 인정되지 않다고 본 대상 판결의 결론은 타당하다.

        스토킹처벌법의 실무상 운용과 보완점 - 스토킹의 해석과 잠정조치를 위한 심문제도를 중심으로 -

        Stalking crime is a crime that causes severe mental and physical damage to the victim to the extent that normal daily life is difficult. There is a very high possibility that it can develop into a violent crime that threatens the body or life. Korea's stalking punishment law distinguishes and stipulates the stalking act and the stalking crime under the premise of prompt and preliminary prevention of the victim, and has provisions to take certain temporary measures against the stalker. From the viewpoint of victim protection against stalking, more flexible legislation and interpretation are required, and similar trends are observed in other countries' legislation. From a procedural aspect, provisional measures operated to protect victims are considered administrative action (police action) or quasi-judicial action, which must consider not only legitimacy but also purpose. So we need to operate more carefully. Nevertheless, even though there is no interrogation system in the stalking punishment law, setting up an interrogation system as an internal regulation, not a law, is contrary to the reservation principle of the law called the reservation of the National Assembly. If necessary, it is reasonable to review the introduction of the system through legislation through a resolution by the National Assembly.

        형사제재의 행정법적 제재로의 전환

        If you look at the numerous laws in our country now, it is easy to see regulations that raise doubts about whether they are excessive criminal sanctions. In other words, most of the individual laws other than the Criminal Act or the Special Criminal Act were enacted to achieve the administrative purpose stipulated in the Act, and legal sanctions are adopted to ensure the fulfillment of that purpose. However, it is not difficult to find cases where criminal sanctions (mainly in the form of criminal fines) rather than administrative law sanctions are adopted in relation to the means of sanctions. Under this awareness of the problem, the government recently launched a task force (TF) to improve economic punishment regulations to change the provisions of criminal punishment into administrative sanctions such as fines. It is necessary to examine in general whether there are objects that need to be converted into administrative law sanctions among the provisions of criminal penalties that are being set. In selecting the criminal punishment to be converted in the process of converting the existing criminal punishment into an administrative sanctions, the legality of the purpose of criminal punishment, the appropriateness of the means of sanctions, the minimization of infringements due to sanctions, and the balance between public and private interests opposing performance (comparative sentence) It is necessary to check whether it conforms to the principle of proportionality in consideration of such factors. In other words, it is necessary to carefully consider whether a new type of sanction rather than a fine or the existing administrative law sanction method or whether it is necessary to mobilize several sanction methods together is necessary. In addition, it is necessary to review whether the change in these legal sanctions is to avoid the harshness of the existing criminal punishment regulations. In other words, individual laws often prescribe rather than a means to achieve a set end. Even if it is inevitable to eliminate social risks through criminal punishment, it is also necessary to examine whether conversion to administrative law sanctions is being attempted in consideration of the practical difficulties of avoiding the characteristics of the strict criminal law. Each ministry should review whether the provisions of criminal punishment scattered in each law are effective sanctions against the rule of law, whether they should be converted into administrative law sanctions, and which administrative law sanctions conform to the rule of law.

        농촌체험관광마을의 실태조사를 통한 활성화 방안 - 통합 청주시를 중심으로-

        In this study the location condition and the management of the Rural Experience Tourism Villages located around unified Cheongju city has been surveyed or investigated. On the basis of the results of the survey or investigation this study is to suggest a way to make activate the Rural Experience Tourism Villages which have been inactive. The ways of the research include the understanding of what means the activation of rural areas and then this study is to find the problems with the Rural Experience Tourism Villages and to suggest final ways or plans after the field investigation of the condition of the location and management of the Villages. In this study I had full understanding of the concept of the activation for rural areas and the humanistic and geographical characteristics and then made a wide investigation and analysis of the location condition and the management of the Rural Experience Tourism Villages in this area. Based on the theory and the results of the actual investigation I made a suggestion of basic direction for the improvement of the Villages and the ways for activation of the Villages. I really expect these suggestions of mine to make active contribution to make the actual plan through the promotion of the Rural Experience Tourism Villages.
