Realistically Road eligibility issue being discussed in an apartment complex parking lot and walkways and the removal and analysis of eligibility for the other places of the road on the traffic happening on the road all the risks and prevent interference ensure a safe and smooth traffic to specifically established by the meaning of the ‘Road Traffic Act’ laws of the road and the concept is to examine whether the application of the general traffic police authority. 도로교통법은 운전자에게 무면허 운전금지, 음주운전금지, 안전운전의 의무부과 등 다양한 금지 및 의무규정을 통하여 운전을 전제로 한 도로에서의 안전 확보를 목적으로 하고 있다. 이러한 도로교통법의 제반 규정은 동법의 도로적격성이 인정되는 “도로”에서의 운전에 해당될 경우 적용되며, 만약 도로적격성이 인정되지 아니하여 일반교통경찰권이 미치지 않는 장소에서의 운전행위로 판단될 경우에는 도로교통법의 각종 금지ㆍ의무ㆍ벌칙규정은 적용되지 아니한다. 도로교통법은 도로의 정의규정인 제2조 제1호에서 “도로법에 따른 도로”, “유료도로법에 따른 유료도로”, “농어촌도로정비법에 따른 농어촌도로”, 그리고 “그 밖에 현실적으로 불특정 다수의 사람 또는 차마(車馬)가 통행할 수 있도록 공개된 장소로서 안전하고 원활한 교통을 확보할 필요가 있는 장소”로 구분하여 도로를 정의하고 있다. 이 연구의 목적은 도로교통법 제2조 제1호 소정의 “그 밖에 현실적으로 불특정 다수의 사람 또는 차마(車馬)가 통행할 수 있도록 공개된 장소로서 안전하고 원활한 교통을 확보할 필요가 있는 장소”의 법률적 의미를 파악하여 도로교통법상의 도로적격성 인정 여부에 관한 도로의 불확정 개념을 구체적으로 정립하는 것이다. 특히 현실적으로 도로교통법상의 도로적격성 문제가 논의되고 있는 아파트단지 내 주차장 및 통행로, 그리고 기타 장소의 도로적격성 여부를 중심으로 도로의 법률적 의미를 판례의 구체적 분석을 통하여 재정립하고, 이와 더불어 도로에서 일어나는 교통상의 위험을 방지하고 안전하고 원활한 교통 확보를 목적으로 하는 도로교통법의 입법취지를 고려하여 도로적격성이 문제되고 있는 통행로(장소)가 일반교통경찰권의 적용대상에서 불합리하게 배제되는 경우를 최소화하여 도로교통법의 적용범위를 확대하는 방안을 모색하고자 한다.
